ORDER APPROVING APPLICATION
This cause came onto be heard upon the above application and the Tequesta Village Council
having considered the evidence presented by the applicants and other interested persons at a hearing
called and properly noticed, and the Tequesta Village Council, being otherwise duly advised,
THEREUPON, THE TEQUESTA VILLAGE COUNCIL FINDS AS FOLLOWS:
1. The subject property is located in the C-2 Zoning District in the Village of Tequesta.
2. The applicant has submitted all documents required by the Village's Code of
Ordinances.
3. The application and all supporting documentation and presentation materials as

reviewed by the Village Council at its March 12, 2009 meeting, and as kept on file by
the Village, are made a part hereof and are hereby incorporated by reference.
4. According to Section 78-334(h), site plan approval remains valid for one (1) year
from the date of issuance unless a building permit is issued within that year and the
project is continuing in good faith.
5. The applicants applied for a one (1) year extension of their site plan approval on
January 5, 2009 which was prior to the expiration date of January 9, 2009.
6. Under the provisions of the Village Code of Ordinances, the Village Council has the
right, power and authority to act upon the request herein made since the request was
made prior to the expiration date.
IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE
COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS:
The application for Site Plan Extension, Case No. 1-09 with reference to the above described
property within the Village of Tequesta, Palm Beach County, Florida, to permit the following:
Extension of the existing site plan for one (1) additional year to expire on
January 9, 2010 for property located at 691 US Highway One North,
Tequesta, Florida 33469
is hereby APPROVED since the Village Council hereby finds that the applicants have met the
requirements set forth in Section 78-334(h) of the Tequesta Zoning Code for site plan extension with the
following Conditions of Approval.
1. The site must be cleared and restored to a natural state; and
2. All foundations, slabs, utilities, trash and other debris must be removed and the site
must be continuously maintained clear of all such material until such time as the
property is developed or sold; and
3. Trees shall be planted along the U.S. Highway No. 1 corridor in accordance with the
landscape plan attached hereto as Exhibit A and made a part hereof; and

4. A bond in favor of the Village of Tequesta in the amount of $30,000.00 shall be
provided within ten (10) days of approval to cover the cost of maintenance for a period
of one (1) year in the event there is a failure to maintain as required by Condition of
Approval No. 2 above; such bond shall be subject to approval by the Village Attorney.
* The term Aapplicant(s)@ as used herein shall include all successors and assigns.
* The applicant's= site plan approval shall expire on January 9, 2010 unless a building permit has
been obtained in accordance with Section 78-334(h). If the building permit, if issued, expires or
is voided, the site plan approval as hereby extended also expires or becomes void.
* Failure to comply with any or all of the above listed conditions shall render the site plan
extension automatically null and void and of no force and/or effect.

I have not heard back from you on the maintenance plan for Regions Bank. We discussed a survey of the property
showing Rt #1 Corridor Landscaping, clearing and stabilization of the site and a maintenance schedule. We are
proposing to bring this back to the Council in March. Please let me know your plans. As I mentioned, the Council has no
problem with extending the site plan but will need to address the vacant lot. Thanks,

This project is now on hold with Regions, which means that this property will either continue to be maintained by
Regions while on hold or will be put up for sale. I do not know the direction that Regions plans on taking for this site at
this time. Since an extension was not granted, this project, with site and building approvals, will expire. Regions is
aware of this.

We would like to formally request a one (1) year time extension of the Site Plan
Approval for the proposed Regions Bank to be located at 691 U.S. Highway 1 North,
Tequesta, FL. The Site Plan was approved by the Village on January 10, 2008. This
approval will be expiring on Friday, January 9, 2009.

SUBJECT: Regions Bank, 691 U.S. Highway One, Site Plan Extension
The Site in question consisted of two lots located in Tequesta. Ordinance No. 620 in ?007
approved the Annexation of a third parcel to be united in title to form one lot for the purpose of
building a new building for Regions Bank. An existing building on the lot was demolished in
preparation for the new Bank. The Alley running across the rear of the property remained in the
ownership of Tequesta as a public right-of--way. This Alley partitions the property, with the
proposed bank on the frontage of Rt. # i and parking in the rear, using the Alley for access.
Improvements to the Alley were part of the site plan approval.
Regions Bank did not secure construction permits within the one year required to preserve their
site plan approval. They are now asking for an extension of one more year. The Building
Permits were approved and are waiting for pick-up; however, they have chosen to put them on
hold.
If the extension were approved, it would give Regions Bank or any other bank the right to build
the approved site plan within the next year, after securing the proper permits. It would also give
them an approved site for resale within the next year.
Our main concern at this time is who will maintain the site now and possibly in the years to
come and to what standard will the site be maintained. In consideration of this. I recommend the
following as a condition of approval:
• The site should be cleared and restored to a natural state.
• All foundations, slabs, debris, utilities, etc., should be removed and suitable trees planted
along the U.S. #l Corridor.
• T11e site should be maintained by Regions Bank until such time as they either develop or
sell the property.

A reasonable bond should be secured to cover the cost of maintenance over the next year
in the event Regions Bank tails to maintain the property. If Regions Bank sells the
property. the bond should continue for the remainder of the year and the unused portion
returned.
Teguesta has had experience in the past with properties that have been abandoned due to market
conditions. Maintaining these properties has taken time, diligence and Code Enforcement. If we
do not address this situation now, we will invite more of the same.
