I r1 U RESOLUTION NO. 41-03/04 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VII.LAGE OF TEQUESTA, FLORIDA, PROVIDING FOR RATIFICATION OF AN AMENDMENT TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE FLORIDA STATE LODGE, FRATERNAL ORDER OF POLICE AND THE VILLAGE; AUTHORIZING THE VII.LAGE MANAGER TO SIGN THE AMENDMENT ON BEHALF OF THE VILLAGE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on September 18, 2003, the Village ratified the Collective Bargaining Agreement (the "Agreement") between the Village and the Florida State Lodge, Fraternal Order of Police (the "FOP"); and WHEREAS, the Village desires to ratify an Amendment to the Agreement (the "Amendment") (a copy of the Amendment is attached hereto as Exhibit "A"); and • WHEREAS, the Village finds that ratification of the Amendment is in the best interest of the Village. NOW, THEREFORE, BE TT RESOLVED BY THE VILLAGE COUNCII. OF THE VII.LAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. The foregoing Recitals are true and correct and are incorporated herein by this reference. Section 2. Ratification of the Amendment between the Village and the FOP in substantially the form attached hereto as Exhibit "A," is hereby authorized and approved. Section 3. The Village Manager is hereby authorized to execute the Amendment on behalf of the Village. Section 4. The Village Manager is authorized to take all actions necessary to implement the • Amendment. • Section 5. Effective Date. Article 12, Wages, Section 2.3 is amended to read as follows: Effective October 1, 2003, October 1, 2004 and October 1, 2005, Unit Members shall receive a one and one-half percent (1 '/z %) cost of living salary increase, in addition to an increase received pursuant to paragraphs 1 and 2, above. 2. Section i .A, paz. 4 of Article 14, Insurance, regarding alteration in coverage is deleted in its entirety. 3. Section 1.B of Article 14, Insurance, regarding reopening the article to renegotiate the payment of health insurance premiums is deleted in its entirety. WHITE Re: .First Amendment to Agreement Between the Village and the Fraternal Order of Police • Dear Mayor Watkins and Councilmembers: Pursuant to negotiations between the Village and the Fraternal Order of Polio ("FOP"). a tentative agreement has been reached regarding wages and health insurance for the remainder of the terns of the present contract between the parties (which expires September 30, 2006). A copy of the First Amendment to the Agreement between the Village of Tequesta, Florida and the Fraternal Order of Police is enclosed for your review ("Amendment"). In summary, FOP members shall receive a 1 '/2 % cost of living increase for years 2003, 2004 and 2005. In addition, both parties agreed that terms regarding health insurance coverage and premiums will remain the same during the life of the contract. All other terms and conditions shall remain the same until expiration of the current contract. The Amendment has been approved by majority vote of FOP members. Pursuant to law, it now must be ratified by the Village Council to be effective and to authorize the City Manager to execute the Amendment. I have been advised that this matter will be scheduled to be heard as an agenda item on the May 13, 2004 Village Council meeting.
