~.C • RESOLUTION N0.21-03/04 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, APPROVING A CONTRACT WITH JLH ASSOCIATES, AT THE RATE OF $90.00 PER HOUR, FOR PROFESSIONAL PLANNING AND ZONING SERVICES IN THE DEPARTMENT OF COMMUNITY DEVELOPMENT ON A PART-TIlVIE BASIS, WITH AN APPROVED FY 2003/2004 BUDGET AMOUNT OF $40,000 IN COMMUNITY DEVELOPMENT, PLANNING SERVICES, ACCOUNT 415-150-531.322. • NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: SECTION 1. The Village needs to obtain professional planning and zoning services in the Department of Community Development on a part-time basis. The Village has authorized the Village Manager to secure such services from a qualified independent contractor, and the finds this contractor possesses the necessary skills, qualifications and abilities. SECTION 2. The contract with JLH Associates at the rate of $90.00 per hour for professional planning and zoning services in the Department of Community Development is hereby approved and attached as Exhibit A. SECTION 3. This Resolution shall take effect immediately upon its adoption. THE FOREGOING RESOLUTION WAS OFFERED by Council Member a~ ~~ {h~ who moved its adoption. STATUS OF CONTRACTOR A. Contractor's services hereunder shall commence an February 13 tll, 2004, and. continue through September 30, 2004. Nothing in this Agreement shall prevent, limit, yr otherwise interfere with the right of JLH Associates iv resign at any time frcnu its position with the Village by providing at least one {I) month written. notice giving a reasonable date of terlnirlation of such Agree- ment such that the Village shall have an appaminity to fill said vacancy. C. Nothing in this Agrecmetlt shall prevent, liuliit, or otherwise interfere with the right of Recy~ded Paper Village to terminate the services of JLH Associates at any time by providing at least one (1) month written notice stating the date of termination of services. IV. HOURS OF SERVICE AND COMPENSATION A. The hours of service to be provided by the Contractor hereunder shall be as agreed upon by Conractor and the Director of the Department of Community Development. B. The Contractor shall be paid in monthly installments at the regular rate of $90.00 per hour for services provided. C. The Village shall compensate for other reimbursable expenses, if necessary, with the prior approval of the Director of the Department of Community Development {e.g. out-of- pocket support services D. As an Independent Contractor, Contractor shall receive a 1099 IRS Tax Form fro the Village, and the Village will report monies earned by the Contractor to the IRS. Con- tractor shall be responsible for all applicable taxes. IV. MISCELLANEOUS A. This contract sets forth all terms and conditions for the provision of services hereunder and no modification shall be made to this Agreement without the express written con- sent of the parties hereto. B. This Agreement shall be construed in accordance with the laws of the State of Florida. Venue for any litigation shall be in Palm Beach County, Florida.
