A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AUTHORIZING AN APPROPRIATION OF
$36,000.00 FROM THE UNDESIGNATED FUND
BALANCE FOR ENGINEERING AND CONSTRUCTION
OF THE PHASE I JUPITER HEIGHTS PROJECT,
AND AUTHORIZING THE VILLAGE MANAGER TO
EXECUTE THE APPLICABLE TRANSFER ON BEHALF
OF THE VILLAGE.

NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS

Gentlemen:
We are pleased to submit this pmposa] for engineering services in connection with
the design, permitting and contract administration of a water distribution system
within the Jupiter Heights subdivision. ARCADIS REESE, MACON and
ASSOCIATES, INC., hereinaftq' referred to as the Engineer, shall perform the
services as documented below for the Village of Tequesta, hereinafter referred to as
the Client.

• The Engineer understands that the intent of this project is to provide engineering
services related to the design, permitting and constrttetion contract administration of
a water distribution system within the following streets of the Jupiter Heights
subdivision; Canal Court, Inlet Court and Palm Gaunt. It is our intent to bid and
construct this project along with the low pressure sewer system being done by the
Laxahatchee River District.
The following specifsc tasks will be performed by the Engineer:
1. Prepare plans & technical specifications and submit to the Owner for review.
2. Prepare an estimate of construction cost.
3. Prepare permitting documents for the followirtb agencies, submit for review
and act as the Owner's liaison during the review process.

4. Assist the Owner in soliciting bids for the project.
5. Review the qualifications of bidders, make a recommendation of award and
prepare contract documents.
6. Provide engineering services during construction, including administration of
the construction contract and performance of all duties of the Engineer and

construction contract. Note that construction observation will be on a non
full time basis.
7. CCrtify completion of the project to the appropriate agencies.
The above scope is predicated on the assumption that the Client shall furnish, at no
cost to the Engineer, all available pertinent information including previous reports,
plans, specifications, permits and other data relevant to the performance of the above
services for the project. in addition, the Client shall designate, in wriring, a person to
act as the representative for services performed under this agreement.
The fallowing specific information and/or items shall be furnished at no cost to the
Engineer.
1. Surveys: topographic, property, boundary, right-of way, permanent refiarence
monuments, permanent control points, Village utility infrastructure record
drawings.
2. Appropriate professional interpretations.
• 3. Data prepared by or services rendered by others such as subsurface
explorations laboratory tests and inspections of samples.
4. All permit application and government inspection fees.
Title search and abstract of property.
TIME OF PERFORMANCE
The Engineer will commence work within ten (10) days of receipt of an executed
authorization.
FEES
For Scope ltems 1 - 5 the engineer shall be paid a lump sum fee of Six Thousand
T~vo I~undred Fifty Dollars (56,250).
For Scope Items 6 and 7 the Engineer shall be paid a lump sum fee of rive Thousand
Eight Hundred Fi~,fty I?ollars (55,850). (Note that this amount assumes normal
construction progression in accordance wish the contract allotted time of 45 days).
If services are required in the performance of the above scope, beyond those
normally provided by the Engineer, which must be sublet, the Engineer shall order
the work after obtaining the written authorization of the Client. The subcontractor
shall bill the work directly to the Client. Tf the Engineer is requested to subcontract
• the work directly, a 10% handling charge will be added to the subcontractors invoice.

Invoices for services rendered are issued on a monthly basis and are due within thirty
(3d) days of the invoice date. Interest at a compound rate of one and one-half percent
per month shall be charged to any past due statements. Interest shall be computed on
past due statements from the date of the invoice.
COST ESTIMATES
Construction cost estimates are developed from knowledge of market conditions and
based on the experience of the Engineer. However, the Engineer exercises no control
over the competitive bidding process and, therefore, makes no guarantee of the
accuracy of the estimate when compared to previous estimates or actual bids.
TERMINATION
This agreement may bt terminated by either party by giving thirty (30) days written
notice. The Engineer shall be paid for all services rendered prior to the termination
date.
ACCEPTANCE
• Acceptance of this proposal may be indicated by executing this document in the
space provided below. This contract shall be considered void if not executed within
thirty (30) days from the above date. Upon execution of this agreement the Client
shall return one copy to the Engineer.
