RESOLUTION NO. 16-03/04
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA,
APPROVING A CONTRACT FROM ARCADIS, REESE, MACON
AND ASSOCIATES, FOR PROFESSIONAL ENGINEERING
SERVICES IN CONNECTION WITH DESIGN, PERMITTING
AND CONTRACT ADMINISTRATION OF A WATER
DISTRIBUTION SYSTEM WITHIN THE TROPIC VISTA
SUBDIVISION, IN THE AMOUNT OF $36,000.00, WITH
CONTINGENCY NOT TO EXCEED 10 PERCENT, HAVING A FY
2003/2004 ACCOUNT #401-241-531.302 WATER
ADMINISTRATION ENGINEERING SERVICES BUDGET
ALLOCATION OF $70,000.00 AND AUTHORIZING THE
VILLAGE MANAGER TO EXECUTE THE APPLICABLE
CONTRACT ON BEHALF OF THE VILLAGE.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS
FOLLOWS:
Section 1. The Arcadis, Reese, Macon and Associates, I
Professional Engineering Services contract in the amount
of $36,000 with a contingency not to exceed 10 percent, is
attached hereto as Exhibit "A" and incorporated by
reference as a part of this Resolution, is hereby approved
and the Village Manager of the Village of Tequesta is
authorized to execute the same on behalf of the Village of
Tequesta.

THE FOREGOING RESOLUTION WAS OFFERED BY Council Member von
Frank, who moved its adoption. The motion was seconded by
Council Member Watkins, and upon being put to vote, the
vote was as follows:

Water Distribution System
Gentlemen:
We are pleased to submit this proposal for engineering services in connection with date:
the design, permitting and contract administration of a water distribution system October 16, 2003
within the Tropic Vista subdivision. ARCADIS REESE, MACON and
ASSOCIATES, INC., hereinafter referred to as the Engineer, shall perform the
services as documented below for the Village of Tequesta, hereinafter referred to as contact:

The Engineer understands that the intent of this project is to provide engineering wreese@areadis-us.com
services related to the design, permitting and construction contract administration of
a water distribution system within the Tropic Vista subdivision in Martin County. ourret:
The Engineer will also provide support at neighborhood meetings and public 52PROSPE.CT00
hearings as requested by the Client.
The following specific tasks will be performed by the Engineer:
1. Prepare plans & technical specifications and submit to the Owner for review.
2. Prepare an estimate of construction cost.
3. Prepare permitting documents for the following agencies, submit for review
and act as the Owner's liaison during the review process.
a. Palm Beach County Health Department
b. Palm Beach County Engineering (right of way).
4. Assist the Owner in soliciting bids for the project.
5. Review the qualifications of bidders, make a recommendation of award and
prepare contract documents.

6. Provide engineering services during construction, including administration of
the construction contract and performance of all duties of the Engineer and
Resident Project Representative (construction observation) as set forth in the
construction contract. Note that construction observation will be on a non
full time basis.
7. Certify completion of the project to the appropriate agencies.
8. Attend and prepare for neighborhood meetings and public hearings as
required to outline the project scope/costs.
The above scope is predicated on the assumption that the Client shall furnish, at no
cost to the Engineer, all available pertinent information including previous reports,
plans, specifications, permits and other data relevant to the performance of the above
services for the project. In addition, the Client shall designate, in writing, a person to
act as the representative for services performed under this agreement.
The following specific information and/or items shall be furnished at no cost to the
• Engineer:
1. Surveys: topographic, property, boundary, right-of way, permanent reference
monuments, permanent control points.
2. Appropriate professional interpretations.
3. Data prepared by or services rendered by others such as subsurface
explorations laboratory tests and inspections of samples.
4. All permit application and government inspection fees.
5. Title search and abstract of property.
TIME OF PERFORMANCE
The Engineer will commence work within ten (10) days of receipt of an executed
authorization.
FEES
For Scope Items 1 - 5 the Engineer shall be paid a lump sum fee of Seventeen
• Thousand Six Hundred Fifty Dollars ($17,650).

For Scope Items 6 - 7 the Engineer shall be paid a lump sum fee of Eighteen
Thousand Three Hundred Fifty Dollars ($18,350). (Note that this amount assumes
normal construction progression in accordance with the contract allotted time of five
(5) months).
For Scope Item 8 the Engineer shall be paid according to the following schedule on
the basis of actual time spent plus any applicable sales tax and reimbursement for
non-salary expenses including, but not limited to, automobile travel at $.30/mile,
reproduction and long distance telephone. We estimate the total cost for the services
provided under this scope item will not exceed Three Thousand Dollars ($3,000).
This amount shall not be exceeded without prior written approval by the Client.

Senior Engineer $65.00/Hr.
Engineer/Sr. Technician $55.00/Hr.
Designer $50.00/Hr.
Draftsman $40.00/Hr.
Technician $37.50/Hr.
Secretary $25.00/Hr.
• If services are required in the performance of the above scope, beyond those
normally provided by the Engineer, which must be sublet, the Engineer shall order
the work after obtaining the written authorization of the Client. The subcontractor
shall bill the work directly to the Client. If the Engineer is requested to subcontract
the work directly, a 10% handling charge will be added to the subcontractors invoice.
Invoices for services rendered are issued on a monthly basis and are due within thirty
(30) days of the invoice date. Interest at a compound rate of one and one-half percent
per month shall be charged to any past due statements. Interest shall be computed on
past due statements from the date of the invoice.
COST ESTIMATES
Construction cost estimates are developed from knowledge of market conditions and
based on the experience of the Engineer. However, the Engineer exercises no control
over the competitive bidding process and, therefore, makes no guarantee of the
accuracy of the estimate when compared to previous estimates or actual bids.
TERMINATION
This agreement may be terminated by either party by giving thirty (30) days written
• notice. The Engineer shall be paid for all services rendered prior to the termination
date.

ACCEPTANCE
Acceptance of this proposal may be indicated by executing this document in the
space provided below. This contract shall be considered void if not executed within
thirty (30) days from the above date. Upon execution of this agreement the Client
shall return one copy to the Engineer.
