HomeMy WebLinkAboutMinutes_Special Master_06/26/2009 VILLAGE OF TEQUESTA SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES June 26, 2008 PRESENT: Special Master Lara Donlon; Code Enforcement Officer Joe Petrick, Recording Secretary Betty Laur. The hearing was called to order at 10:01 A.M. Code En#orcement Special Master Donlon approved the minutes of the May 22, 2008 Special Master Hearing as submitted. The following cases were heard by the Special Master: Fine Assessment Hearings Case No. 2008-000257 William Kennedy 226 Fairway West Tequesta, FL 33469 PCN: 602-40-26-01-000-2480 Prohibified Property Conditions Chapter 30 Article 11 Section 30-33 The Respondent, William Kennedy, was not presen# at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the ongoing violation. Conclusion of law was that Respondent, William Kennedy, remains in violation of Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, ~Iliam Kennedy, shall immediately comply with Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta. • Special Master Hearing • June 26, 2008 Page 2 • A fine of $100.00 per day is hereby assessed for the violation that has existed. The fine is imposed beginning May 27, 2008, and will continue to accrue at $100.00 per day for each day the violation continues to exist. Respondent shall immediately pay the administrative costs of $302.17 that were assessed at the violation hearing. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. Violation Hearings Case No. 2008-00072 Nancy Jones 250 Beach Road #402 Tequesta FL 33469 PC N : 60-43-40-31-12-000-4020 Plumbing Permit Chapter 14 Article VI Section 14-153 This case was withdrawn by the Village of Tequesta. Case No. 2008-00037 Tamwest Realty County Line Plaza Don Campbell 564 US HWY 1 N Tequesta FL 33469 PC N : 60-43-40-30-00-001-0190 Dumpster Requirements (Screening) Chapter 78 Article X Section 78-300 This case was withdrawn by the Village of Tequesta. Violation Hearings; Special Master Hearing June 26, 2008 Page 3 Case No. 2008-00092 Jeff Holtrman (Charles Lowery) 2 Pine Hill Trail West Tequesta FL 33469 PCN: 602-40-25-25-000-2020 Prohibited Property Conditions Chapter 30 Article II Section 30-33 The Respondent, Jeff Holtzman, was not present at the hearing. There was a finding of proper notice served on Jeff Holtzman, the attorney handling the Estate of Charles Lowery, who is listed as the property owner in the public records. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent, Jeff Holtzman is in violation of Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta. Special Master Cara Donlon ordered that Respondent Jeff Holtzman, shall comply with Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta by the 7th day of July, 2008. This violation constitutes an immediate threat to the public health, safety, and welfare. Due to the inoperative gate latch constituting an immediate threat to the public health, safety, and welfare, the ~Ilage is authorized to correct the violation with regard to the gate and charge the cost of repairs to the Respondent, if the Respondent does not comply by the time specified. If Respondent does not comply whin the time specked, Respondent shall be assessed a fine of up to $250.00 per day until the property isrn full compliance. A Fine Assessment Hearing will be held before the Special Magistrate on the 24th day of July, 2008, at 10:00 a.m. at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida. Respondent shall be assessed $433.19 for administrative costs to be paid by the 7th day of July, 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins.
