• VILLAGE OF TEQUESTA SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES March 27, 2008 • PRESENT: Special Master Lara Donlon; Code Enforcement Officer Joe Petrick, and Recording Secretary Betty Laur The hearing was called to order at 10:00 A.M. Code Enforcement Special Master Donlon approved the minutes of the February 28, 2008 Special Master Hearing as submitted. The following cases were heard by the Special Master: Fine Reduction Hearing: Case No. 2008-00027 Ronald Brown 371 Evergreen Ave Tequesta, FL 33469 PCN: 60-42-40-25-06-021-0060 Violation of Chapter 30, Article II Section 30-33 The Respondent, Ronald Brown, was present at the hearing and requested a reduction in fine. The Village agreed to a reduction in fine and testified that compliance was not on February 11, 2008. Conclusion of law was that Respondent is no longer in violation of the above listed code sections of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent's fine shall be reduced to zero dollars. Violation Hearings: Case No. 2008-00049 Lou Raso 239 River Drive . Special Master Hearing March 27, 2008 Page 2 Tequesta FL 33469 PCN: 60-42-40-26-01-000-0610 Building (Structure) Permits Chapter 14 Article VI Section 14-152 The Respondent, Lou Raso, was represented at the hearing by Attorney Neil Litchblau. There was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. Conclusion of law was that Respondent, Lou Raso, is in violation of Chapter 14 Article VI Section 14-152 , of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Lou Raso, shall comply with Chapter 14 Article VI Section 14-152, of the Code of Ordinances of the Village of Tequesta by the 10tH day of April, 2008. If Respondent does not comply within the time specified, Respondent shall be assessed a fine of up to $250.00 per day until the property is in full compliance. • A Fine Assessment Hearing will be held before the Special Master on the 24tH day of April, 2008, at 10:00 a.m. at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida. Respondent shall be assessed $267.96 for administrative costs to be paid by the 10tH day of April, 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. Case No. 2008-00037 Tamwest Realty, Inc. County Line Plaza Don Campbell • 564 US Hwy 1 Tequesta FL 33469 • Special Master Hearing March 27, 2008 Page 3 PCN: 60-43-40-30-00-001-0190 Screening of Dumpsters Chapter 78 Article IX Section 78-300 The Respondent, Tamwest Realty, Inc., County Line Plaza, and Don Campbell, were present at the hearing and there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photos of the violation. The Respondent agreed to bring the entire plaza into compliance, Conclusion of law was that Respondents are in violation of Ghapter 78, Article IX, Section 78-300 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondents shall comply with Chapter 78 Article tX Section 78-300 of the Code of Ordinances of the Village of Tequesta by the 26th day of May, 2008. If Respondent does not comply within the time specified, Respondent shall be assessed a fine of up to $250.00 per day until the property is in fuA compliance. • A Fine Assessment Hearing will be held before the Special Mas#er on the 26th day of June, 2008, at 10:00 a.m. at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida. Respondent shall be assessed $497.38 for administrative costs to be paid by the 10th day of April, 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins. Case No. 2007-00251 Monica Rogers 121 Chapel Lane Tequesta FL 33469 • PCN: 60-42-40-25-36-000-0280 Violation: Chapter 34 Article II • Special Master Hearing March 27, 2008 Page 4 Section 30-33 and Chapter 14 Article V Section 14-121 Appendix B Chapter 3 The Respondent, Monica Rogers, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified that the property is in compliance. Conclusion of law was that Respondent was, but is no longer, in violation of Chapter 30 Article II Section 30-33 and Chapter 14, Article V, Section 14-121 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent Monica Rogers shall continue to comply with Chapter 30 Article II Section 30-33 and Chapter 14, Article V, Section 14- 121 of the Code of Ordinances of the Village of Tequesta. • Case No. 2008-00257 William Kennedy 226 Fairway West Tequesta FL 33469 PCN: 60-42-40-26-01-000-2480 Prohibited Properly Conditions Chapter 30 Article II Section 30-33 R1A Parking Violation Chapter 78 Article IX Section 78-644 The Respondent, William Kennedy, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. The Code Officer testified that the Respondent complied with Chapter 78, Article IX, Section 78-644 of the Code of Ordinances of the Village of Tequesta on March 26, 2008 and that Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta was not in compliance. Conclusion of law was that Respondent, William Kennedy, is in violation of Chapter 30, Article II, Section 30-33, and was, but is no longer in violation of Chapter 78 Article IX Section 78644 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent shall comply with Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta by the 26tH day of May, 2008. If Respondent does not comply within the time specified, • Respondent shall be assessed a fine of up to $250.00 per day until the property is in full compliance. • Special Master Hearing March 27, 2008 Page 5 The Special Master further ordered that Respondent shall continue to comply with Chapter 78 Article IX Section 78-644 of the Code of Ordinances of the Village of Tequesta. A Fine Assessment Hearing will be held before the Special Master on the 26"' day of June, 2008, at 10:00 a.m. at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta; Florida. Respondent shall be assessed $302.17 for administrative costs to be paid by the 10th day of April; 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the • original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the ongmal amount. Case No. 2007-00250 Milbrook Ventures/ SAG Hobe Sound LLC Stephen Garofalo and Patricia Trimble 331 River Drive Tequesta, FL 33469 PCN: 60-42-40-26-01-000-0840 Conditions for operation (business) Chapter 78 Article IX Section 78-515 The Respondents, Millbrook Ventures/SAG Hobe Sound LLC, and Stephen Garofalo and Patricia Trimble, were not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. The Code Officer testified that the Respondent complied on March 18, 2008, which was after the date set for compliance. Conclusion of law was that Respondents were, but are no longer, in violation of Chapter 78 Article IX, Section 78-515 of the Code of Ordinances of the Village of Tequesta. r~ U • Special Master Hearing March 27, 2008 Page 6 Special Master Lara ©onlon ordered that Respondents; shall continue to comply with Chapter 78 Article IX, Section 78-515 of the Code of Ordinances of the Village of Tequesta. Respondent shall be assessed $661.80 for administrative costs, to be paid by the 10t'' day of April, 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500 per day may be imposed beginning on the date the violation begins.
