Code Enforcement Special Master Donlon approved the minutes of the January 24, 2008 Special Master Hearing as submitted. The following cases were heard by the Special Master: Violation Hearings: Case No. 2008-00019 Robert Miller 80 Willow Road Tequesta, FL 33469 Legal: Ridgewood Homes Sec 2, Lot 76 Violation: Chapter 10, Article I Section 10-8 of Code of Ordinances The Respondent, Robert Miller, was present at the hearing and there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the repeat violation. The Officer testified that the property was not in compliance on January 16, 2008, February 3, 2008, February 17, 2008, and February 18, 2008. Laurel Maginsky, 331 Tequesta Drive, testified to the repeat violation that occurred on February 17, 2008. Patricia Caslin, 331 Tequesta Drive, testified to the repeat violation that occurred on February 17 and February 18, 2008. Conclusion of law was that ~tespondent Robert Miller is in repeat violation of Chapter 10, Article I Section 10-8 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent Robert Miller, shall continue to • comply with Chapter 10, Article I Section 10-8 of the Code of Ordinances of the Village of Tequesta. • Special Master Hearing February 21, 2008 Page 2 A fine of up to $150.00 per day is hereby assessed for the repeat violation that has existed. The fine is imposed for the four days the violation existed, for a total fine of $600.00. Respondent shall be assessed $445.21 for administrative costs to be paid immediately. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. Case No. 2008-00027 Ronald Brown 371 Evergreen Ave Tequesta FL 33469 Legal: Jupiter in the Pines • SecBLt6Blk21 Violation: Prohibited (Property) Conditions Chapter 30 Article 11 Section 30-33 The Respondent, Ronald Brown, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the repeat violation. Russell Von Frank, 489 Dover Road, testified to the repeat violation. Respondent was. in repeat violation beginning February 7, 2008. Conclusion of law was that Respondent, Ronald Brown, is in repeat violation of Chapter 30, Article II, Section 30-33 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Ronald Brown, shall immediately comply with Chapter 30, Article il, Section 30-33, of the Code of Ordinances of the Village of Tequesta. A fine of $50.00 per day is hereby assessed for the repeat violation that has existed. The fine is imposed beginning February 7, 2008 and will continue to accrue at $50.00 per day for each day the violation continues to exist. Respondent shall be assessed $319.21 for administrative costs to be paid immediately. • • Special Master Hearing February 21, 2008 Page 3 A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, #or the original amount. Case No. 2007-00202 TB Sea Corp and Brooke and Samphou Khanthavong 351 Cypress Drive Tequesta FL 33469. Legal: Jupiter in the Pines Sec C Lt 14 Blk 23 Chapter 30 Article II Section 30-33 Of Code of Ordinances Village of Tequesta The Respondent, Samphou Khanthavong, was present at the hearing and there was a • finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photos of the violation. Conclusion of law was that Respondents, TB Sea Corp and Brooke and Samphou Khanthavong, is in violation of Chapter 30, Article II, Section 30-33 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondents, TB Sea Corp and Brooke and Samphou Khanthavong, shall comply with Chapter 30, Article II, Section 30-33 of the Code of Ordinances of the Village of Tequesta by the 27th day of February, 2008. If Respondents do not comply within the time specified, Respondents shall be assessed a fine of up to $250.00 per day until the property is in full compliance. A Fine Assessment Hearing will be held before the Special Master on the 27th day of March, 2008, at 10:00 a.m. at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida. Respondents shall be assessed $330.42 for administrative costs to be paid by the 28th day of February, 2008. Future violations of the aforementioned code sections may be considered a repeat • violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins. • Special Master Hearing February 21, 2008 Page 4 A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.
