VILLAGE OF TEQUESTA
SPECIAL MASTER CODE ENFORCEMENT HEARING
MINUTES
January 24, 2008
PRESENT: Special Master Lara Donlon; Code Enforcement Officer Joe Petrick, and
Recording Secretary Betty Laur
The hearing was called to order at 10:10 A.M.
Code Enforcement Special Master Donlon approved the minutes of the December 6,
2007 Special Master Hearing as submitted.
The following cases were heard by the Special Master:
Fine Assessment Hearing:
Case No. 2007-00162 Palm Corp Inc and William Bell
Construction
400 Cypress Drive
Tequesta, FL 33469
Tequesta Commerce Building Condo
The Respor~ients, Palm Corp, Inc. and William Bell Construction, were represented at
the hearing by Attorney Donald Brooks, and there was a finding of proper notice.
Attorney Scott Hawkins represented the Village at the hearing. The Tequesta Code
Enforcement Officer testified to the ongoing violation.
Conclusion of law was that Respondent remains in violation of Florida Building Codes
Adopted Chapter 14 Article II, Section 14-31 and Building Code(s) Chapter 1 Section
110 of the Code of Ordinances of the Village of Tequesta.
Special Master Lara Donlon ordered that Respondents, Palm Corp, Inc. and William
Bell Construction, shall immediately comply with Florida Building Codes Adopted
Chapter 14 Article II, Section 14-31 and Building Code(s) Chapter 1 Section 110 of the
Code of Ordinances of the Village of Tequesta.

A fine of up to $250.00 per day is hereby assessed for the violation that has existed.
The fine is imposed beginning January 6, 2008, and will continue to accrue at $250.00
per day for each day the violation continues to exist.
Respondents shall immediately pay the administrative cost of $3,072.78 that was
assessed at the hearing held on December 6, 2007. '
A certified copy of this Order may be recorded in the Public Records of Palm Beach
County, Florida, and once recorded, shall constitute a lien against the property of the
original amount upon which the violation existed and upon any other real or personal
property owned by the Respondent, pursuant to Chapter162, Florida Stafutes, for the
original amount.

The Respondent, Monica Rodgers, was present at the hearing and there was a finding
of proper notice. The Tequesta Code Enforcement Officer testified to and produced
photographs of the violation.
Conclusion of law was that Respondent, Monica Rodgers, is in violation of Chapter 30,
Article II, Section 30-33 and Chapter 14 Article V Section 14-121 Appendix B Chapter 3,
of the Code of Ordinances of the Village of Tequesta.
Special Master Lara Donlon ordered that Respondent, Monica Rodgers, shall comply
with Chapter 30, Article II, Section 30-33 and Chapter 14 Article V Section 14-121
Appendix B Chapter 3, of the Code of Ordinances of the Village of Tequesta.
If Respondent does not comply within the time specified, Respondent shall be assessed
a fine of up to $250.00 per day until the property is in full compliance.

A Fine Assessment Hearing will be held before the Special Master on the 27th day of
March, 2008, at 10:00 a.m. at the Village of Tequesta, Code Compliance Division, 345
Tequesta Drive, Tequesta, Florida.
Respondent shall be assessed $163.42 for administrative costs to be paid by the 25th
day of March, 2008.
Future violations of the aforementioned code sections may be considered a repeat
violation for which a fine of up to $500.00 per day may be imposed beginning on the
date the violation begins.
A certified copy of this Order may be recorded in the Public Records of Palm Beach
County, Florida, and once recorded, shall constitute a lien against the property of the
original amount upon which the violation existed and upon any other real or personal
property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the
original amount.

Violation: Walls and Fences
Chapter 78 Article IX Section 78-284

The Respondent, Maurice Fishman, was present at the hearing and there was a finding
of proper notice. The Tequesta Code Enforcement Officer testified to and produced
photos of the violation.
Conclusion of law was that Respondent, Maurice Fishman, is in violation of Chapter 78,
Article IX, Section 78-284 of the Code of Ordinances of the Village of Tequesta.
Special Master Lara Donlon ordered that Respondent Maurice Fishman shall comply
with Chapter 78 Article IX Section 78-284 of the Code of Ordinances of the Village of
Tequesta by the 14th day of February, 2008.
If Respondent does not comply within the time specified, Respondent shall be assessed
a fine of up to $250.00 per day until the property is in full compliance.

Case No. 2007-00044 Kathleen Davis

Violation: Dogs running at large
Chapter 10 Article II Section 10-34

The Respondent, Kathleen Davis, was present at the hearing, and there was a finding
of proper notice. The Tequesta Code Enforcement OfFcer testified to and produced
CAD reports of the violation.
Conclusion of law was that Respondent, Kathleen Davis, was, but is no longer, in
violation of Chapter 10, Article II, Section 10-34 of the Code of Ordinances of the Village
of Tequesta.
Special Master Lara Donlon ordered that Respondent Kathleen Davis shall continue to
comply with Chapter 10 Article II Section 10-34 of the Code of Ordinances of the Village
of Tequesta.
Respondent shall be assessed $269.21 for administrative costs to be paid by the 23`~
day of February, 2008.
Future violations of the aforementioned code sections may be considered a repeat
violation for which a fine of up to $500.00 per day may be imposed beginning on the
date the violation begins.

The Respondent, Altmont Villas, LLC, was not present at the hearing; however, there
was a finding of proper notice. The tenant, Ron Grassi, was present at the hearing.
The Tequesta Code Enforcement Officer testified to and produced police reports of the
• violation.
Conclusion of law was that Respondent, Altmont Villas, LLC, was, but is no longer, m
violation of Chapter 30, Article X, Section 30-361 of the Code of Ordinances of the
Village of Tequesta.
Special Master Lara Donlon ordered that Respondent Almont Villas, LLC., shall
continue to comply with Chapter 30 Article X Section 30-361 of the Code of Ordinances
of the Village of Tequesta.
Respondent shall be assessed $396.60 for administrative costs to be paid by the 23rd
day of February, 2008.
Future violations of the aforementioned code sections may be considered a repeat
violation for which a fine of up to $500.00 per day may be imposed beginning on the
date the violation begins.
A certified copy of this Order may be recorded in the Public Records of Palm Beach
County, Florida, and once recorded, shall constitute a lien against the property of the
original amount upon which the violation existed and upon any other real or personal
property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the

Conditions
Chapter 30 Article II Section 30-33

The Respondent, Cornerstone Tequesta LLC, was not present at the hearing; however,
there was a finding of proper notice. The Tequesta Code Enforcement Officer testified
to and produced photos of the ongoing violation.
Conclusion of law was that Respondent remains in violation of Chapter 30 Article II,
Section 30-33 of the Code of Ordinances of the Village of Tequesta.
Special Master Lara Donlon ordered that Respondent, Cornerstone Tequesta LLC, shall
immediately comply with Chapter 30 Article II, Section 30-33 of the Code of Ordinances
• of the Village of Tequesta.
A fine of $250.00 per day is hereby assessed for the violation that has existed. The fine
is imposed beginning January 6, 2008, and will continue to accrue at $250.00 per day
for each day the violation continues to exist.
Respondent shall be assessed $1,781.63 for administrative costs, to be paid
immediately.
A certified copy of this Order may be recorded in the Public Records of Palm Beach
County, Florida, and once recorded, shall constitute a lien against the property of the
original amount upon which the violation existed and upon any other real or personal
property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the
original amount.
