HomeMy WebLinkAboutMinutes_Special Master_10/25/2007• VILLAGE OF TEQUESTA SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES October 25, 2007 • PRESENT: Special Master Lara Donlon; Code Enforcement Officer Joe Petrick, and Recording Secretary Betty Laur The hearing was called to order at 10:05 A.M. Code Enforcement Special Master Donlon approved of minutes of the Special Master Hearings held on August 6, 2007, August 23, 2007, August 30, 2007, and September 27, 2007 as submitted. The following cases were heard by the Special Master: 1) Case No. 2007-00167 WRB LLC 400 Cypress Drive Suite 1 Tequesta, FL 33469 PCN #60-43-40-30-57-001-0010 Violation Hearing Florida Building Codes Adopted Chapter 14, Article II, Section 14-31 The Respondent, WRB, LLC, was represented at the hearing by Attorney Donald L. Brooks, and took the position that the owner of the corporation, William R. Bell, was not a party in this case. The Tequesta Code Enforcement Officer testified to the violation. Catherine Harding, Director of Community Development, testified for the Village. Special Master Donlon directed Attorney Brooks and the Village's Attorney Halverson to provide her with additional information by November 26, 2007. 2) Case No. 2007-00167 Joann Zummo 418 Tequesta Drive Tequesta, FL 33469 Fine Assessment Hearing Violation of Chapter 30, Article II, Section 30-33 Special Master Hearing October 25, 2007 Page 2 The Respondent, Joann Zummo, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the ongoing violation. Conclusion of law was that Respondent remains in violation of Chapter 30, Article II, Section 30-33 of the Code of Ordinances of the Village of Tequesta. Special Master Donlon ordered that Respondent, Joann Zummo, shall immediately comply with Chapter 30, Article II, Section 30-33 of the Code of Ordinances of the Village of Tequesta. A fine of $250.00 per day is hereby assessed beginning October 12, 2007 and shall continue to accrue at $250.00 per day until the violation comes into compliance. Respondent shall be assessed $252.80 for administrative costs to be paid immediately. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the • original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. 3) Case No. 20-00169 Thomas Avvenire 408 Beacon Street, Tequesta, FL 33469 Tequesta, FL 33469 PC N : 60-42-40-25-06-025-0060 This case was withdrawn by the Village as Respondent was in compliance. 4) Case No. 2007-00173 Herbert Sandler 225 Fairway West, Tequesta, FL 33469 Tequesta, FL 33469 Legal: Tequesta LT 259 PCN: 60-42-40-26-01-000-2590 Violation of Code of Ordinances Chapter 78 Article IX Sec 78-585 Child Restraint Barrier Required This case was withdrawn by the Village as Respondent was in compliance. i 5) Case No. 2007-00177 Cornerstone Tequesta LLC 223 Village Blvd, Tequesta, FL 33469 Legal: ALS PLAT OF VILLAGE OF C] Special Master Hearing October 25, 2007 Page 3 TEQUESTA PAR 2, TH PT OF TR A LYING WITHIN & TRS K THRY M K/A RETENTION AREAS Violation of Code of Ordinance Chap. 30, Art. II, Sec. 30-33 Prohibited Property Conditions • The respondent, Cornerstone Tequesta, LLC, was not present at the hearing and there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. Respondent has made attempts to comply, but the soffits remain in violation. Conclusion of law was that Respondent is in violation of Chapter 30, Art. II, Section 30- 33 of the Code of Ordinances of the Village of Tequesta. The Special Master ordered that Respondent, Cornerstone Tequesta, LLC, shall comply with the above listed code sections of the Code of Ordinances of the Village of Tequesta. A Status and Fine Assessment Hearing will be held before the Special Master on the 6tn day of December, 2007, at 10:00 a.m., at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. 6) Case No. 2007-00205 Estate ofl Daniel Robillard 140 Country Club Drive, Tequesta, FL 33469 Legal: Country Club Point PCN #: 60-42-40-25-12-005-0010 Fine Assessment Hearing Violation Code of Ordinances Chap. 30, Art. II, Sec. 30-33 & 30-32 Prohibited Property Conditions Excessive Accumulations Prohibited The respondent, Estate of Daniel Robillard, was not present at the hearing; however there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the ongoing violation. • Special Master Hearing October 25, 2007 Page 4 Conclusion of law was that Respondent is in violation of Chapter 30, Article II, Sections 30-33 and 30-22 of the Code of Ordinances of the Village of Tequesta. The Special Master ordered that Respondent, Estate of Daniel Robillard, shall immediately comply with Chapter 30 Article II, Sections 30-33 and 30-22 of the Code of Ordinances of the Village of Tequesta. A fine of $3,750.00 is hereby assessed for the violation that has existed. The fine is imposed for the period from October 12, 2007, through October 25, 2007, and will continue to accrue at $250.00 per day for each day the violation continues to exist. The Respondent shall be assessed $175.81 for administrative costs to be paid immediately. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal • property owned by the Respondent, pursuant to Chapter162, Florida Statutes, for the original amount. 7) Case No. 07-00203 Cynthia Courtney 300 River Drive, Tequesta, FL 33469 Legal: Tequesta in PB 25 PGS to 15 INC PCN: 60-42-40-26-01-000-1020 Violation of Code of Ordinances Chap. 30 Art. II, Sec. 30-32 Declaration of a Nuisance Excessive Accumulations The respondent, Cynthia Courtney, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. Conclusion of law was that Respondent is in violation of Chapter 30, Article II, Section 30-32 of the Code of Ordinances of the Village of Tequesta. The Special Master ordered that Respondent, Cynthia Courtney, shall comply with Chapter 30, Article II, Section 30-32 of the Code of Ordinances of the Village of • Tequesta by November 8, 2007. If Respondent does not comply within the time specified, Respondent shall be assessed a fine of up to $250.00 per day until the property is m full compliance. Special Master Hearing October 25, 2007 Page 5 A Fine Assessment Hearing will be held before the Special Master on the 6t" day of December, 2007, at 10:00 a.m. at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida. Respondent shall be assessed $223.92 for administrative costs to be paid by the 8t" day of November, 2007. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to $500.00 per day may be imposed beginning on the date the violation begins.
