SPECTAL MASTER CODE ENFORCEMENT HEARING
MINUTES
September 27, 2007
PRESENT: Special Master Lara Donlon; Community Development Director Catherine
Harding, and Recording Secretary Betty Laur
The hearing was called to order at 10:00 A.M.
Code Enforcement Special Master Donlon postponed approval of minutes of the August 23,
2007 Special Master Hearing to the next hearing.
The following cases were heard by the Special Master:
1) Case No. 07-00175 KW & Elizabeth Anderson

This case was withdrawn by the Village; Ms. Harding stated the property was in compliance.
2) Case No. 07-00201 Hattie Siegel
498 Dover Road, Tequesta, Florida
Legal: Jupiter in the Pines

Fine Assessment and Repeat Violation of
Chapter 30 Article II Sec. 30-32 and 30-33
Prohibited Property Conditions
Excessive Accumulation Prohibited
The respondent, Hattie Siegel, was represented at the hearing by Attorney Ashley Girolamo for
Catholic Charities acting as pienary guardian of the property and limited guardian of the person.
There was a finding of proper notice. Catherine Harding, the Director of Community
Development, testified to the violation.

Conclusion of law was that Respondent was, but is no longer, in violation of Chapter 30, Art. II,
Section 30-32 of the Code of Ordinances of the Village of Tequesta.
The Special Master ordered that Respondent, Hattie Siegel, shall continue to comply with.
Chapter 30, Art. II, Section 30-32 of the Code of Ordinances of the Village of Tequesta., and
Respondent shall pay the cost of $795.00 for the removal of the beehive on or before the 26~' day
of November, 2007. The Respondent may also request an extension of time to pay said costs.
A certified copy of this Order maybe recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.
3) Case No. 07-00145 John Isleib (Fashion Mall)

• The respondent, John Isleib, was present at the hearing and there was a finding of proper notice.
Catherine Harding, the Director of Community development, testified that the property came into
compliance prior to August 25, 2007.
Conclusion of law was that Respondent was, but is no longer, in violation of Chapter 30, Article
II, Section 30-33 of the Code of Ordinances of the Village of Tequesta.
The Special Master ordered that Respondent, John Isleib, shall continue to comply with Chapter
30 Article II, Section 30-33 of the Code of Ordinances of the Village of Tequesta.
4) Case No. 07-00142 Roger Farber

The Respondent, Roger Farber, was not present at the hearing, however, there was a finding of
proper notice. Catherine Harding, the Director of Community Development, testified that the
property complied after the date set in the Order Finding Violation.
Conclusion of law was the Respondent was, but is no longer, in violation of Chapter 78, Art. IX,
Sec. 78-399 and Chapter 30, Art. II, Sec. 30-33 of the Code of Ordinances of the Village of

The Special Master ordered that Respondent, Roger Farber, shall continue to comply with
Chapter 78, Art. IX, Sec. 78-399 and Chapter 30, Art. II, Sec. 30-33 of the Code of Ordinances
of the Village of Tequesta. Respondent shall be assessed $208.71 for administrative costs, to be
paid immediately.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.

finding of proper notice. Catherine Harding, the Director of Community Development, testified
to and produced photographs of the violation.
Conclusion of law was that Respondent is in violation of Chapter 30, Article II, Sections 30-33
and 30-22 of the Code of Ordinances of the Village of Tequesta.
The Special Master ordered that Respondent, (Estate of) Daniel Robillard, shall comply with
Chapter 30 Article II, Sections 30-33 and 30-22 of the Code of Ordinances of the Village of
Tequesta by the l la` day of October, 2007.
If Respondent does not comply within the time specified, Respondent shall be assessed a fine of

be held before the Special Master on the 25t" day of October 2007 at 10 a.m. at the Village of

Prohibited Property Conditions
The respondent, Cornerstone Tequesta. LLC., was represented at the hearing by Tony Gizzi, Area
Construction Manager, and there was ~. finding of proper notice. Catherine Harding, the Director
of Community Development, testified to and produced photos of the violation. Tony Gizzi
testified at the hearing for the Respondent.
Conclusion of law was that Respondent is in violation of Chapter 30 Article II, Section 30-33 of
the Code of Ordinances of the Village of Tequesta.
The Special Master ordered that Respondent, Cornerstone Tequesta LLC, shall comply with
Chapter 30 Article II, Section 30-33 of the Code of Ordinances of the Village of Tequesta, by the
18th day of October, 2007. If Respondent does not comply within the time specified,
Respondent shall be assessed a fine of up to $250.00 per day until the property is in full
compliance.
A Fine Assessment Hearing will be held before the Special Master on the 25th day of October,
2007, at 10:00 a.m., at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive,

The Respondent shall be assessed $406.92 for administrative costs to be paid by the 18th day of
October, 2007.
Future violations of the aforementioned code sections may be considered a repeat violation for
which a fine of up to $500.00 per day may be imposed beginning on the date the violation
begins.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.

• Child Restraint Barrier Required
The respondent, Herbert Zandler, was present at the hearing; and there was a finding of proper
notice. Catherine Harding, the Director of Community Development, testified to and produced
photographs of the violation. The Respondent testified at the hearing.
Conclusion of law was that Respondent Herbert Zandler is in violation of Chapter 78 Article IX,
Section 78-585 of the Code of Ordinances of the Village of Tequesta.
The Special Master ordered that Respondent shall comply with Chapter 78 Article IX, Section
78-585 of the Code of Ordinances of the Village of Tequesta by submitting a complete permit
application within 24 hours from the date of this Order. Additionally, Respondent shall fiilly
comply with said Ordinance by erecting a proper barrier to the pool on or before October 2,
2007.
If Respondent does not comply within the time specified, Respondent shall be assessed a fine of
up to $250.00 per day until the property is in full compliance.
A Fine Assessment Hearing will be held before the Special Master on the 25~' day of October
2007 at 10:00 a.m. at the Village of Tequesta, code Compliance Division, 345 Tequesta Drive,
Tequesta, Florida.
• The Respondent shall be assessed $24192 for administrative costs to be paid by the 7th day of
October 2007.

Excessive Accumulations
The respondent, Cynthia Courtney, was not present at the hearing, however, there was a fording
of proper notice. The Respondent requested to continue this matter. The Village did not object
to a continuance.
The Special Master Ordered that this matter is continued and a hearing will be held before the
Special Master on the 25`" day of October 2007 at 10:00 a.m. at the Village of Tequesta, Code
Compliance Division, 345 Tequesta Drive, Tequesta, Florida.
10) Case No. 07-00167 Joann Zummo

The respondent, Joann Zummo, was not present at the hearing, however, there was a finding of
proper notice. Catherine Harding, the Director of Community Development, testified to and
produced photographs of the violation.
Conclusion of law was that respondent is in violation of Chapter 30, Article 11, Sec. 30-33 of the
Cade of Ordinances of the Village of Tequesta.

The Special Master ordered that Respondent Joann Zummo shall comply with Chapter 30,
Article II, Sec. 30-33 of the Code of Ordinances of the Village of Tequesta by the l lt" day of
October, 2007.
If Respondent does not comply within the time specified, Respondent shall be assessed a fine of
up to $250.00 per day until the property is in full compliance. A Fine Assessment Hearing will
be held before the Special Master on the 25`" day of October, 2007, at 10:00 a.m. at the Village
of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida.
Respondent shall be assessed $308.71 for administrative costs to be paid by the 11`" day of
October, 2007.
Future violations of the aforementioned code sections may be considered a repeat violation for
which a fine of up to $500.00 per day may be imposed beginning on the date the violation
begins.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapterl62, Florida Statutes, for the original amount.
