SPECIAL MASTER CODE ENFORCEMENT HEARING
MINUTES
August 23, 2007
PRESENT: Special Master Lara Donlon; Code Enforcement Officer Joe Petrick, and
Recording Secretary Betty Laur
The hearing was called to order at 10:00 A.M.
Code Enforcement Special Master Donlon approved the minutes of the July 26, 2007 Special
Master Hearing as submitted.
The following cases were heard by the Special Master:
1) Case No. 2007-00175 KW & Elizabeth Anderson
Location of Violation: 27 Tradewinds Circle
Tequesta, FL 33469
Ordinance Description: Building Permits
Chap. 14 Art. VI, Sec. 14-15
PCN #: 60-42-40-25-12-002-0070
The respondents, K.W. and Elizabeth Anderson, were not present at the hearing; however, they
were represented by the Contractor John Hayes. There was a finding of proper notice. The
Tequesta Code Enforce3ment Officer testified to and produced photographs of the violation.
Conclusion of law was that Respondents are in violation of Chapter 14, Art. VI, Section 14-15
of the Code of Ordinances of the Village of Tequesta.
The Special Master ordered that Respondents, K. W. and Elizabeth Anderson, shall comply with
Chapter 14, Art. VI, Section 14-15 of the Code of Ordinances of the Village of Tequesta by the
2"d day of September 2007. If Respondents do not comply within the time specified,
Respondents shall be assessed a fine of up to $250.00 per day until the property is in full
compliance.

A Fine Assessment Hearing will be held before the Special Master on the 27~' day of September,
2007, at 10:00 a.m., at the Village of Tequesta Code Compliance Division, 345 Tequesta Drive,
Tequesta, Florida.
Respondents shall be assessed $250.25 for administrative costs to be paid by the 22nd day of
September, 2007.
Future violations of the aforementioned code sections may be considered a repeat violation for
which a fine of up to $500.00 per day maybe imposed beginning on the date the violation
begins.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.
2) Case No. 2007-000031 Richard & Theresa Kozell
Location of Violation: 119 Point Circle
Tequesta, FL 33469
Ordinance Description: Fine Assessment Hearing

The respondent, Theresa Kozell, was present and represented by Attorney John Avery at the
hearing and there was a finding of proper notice. The Tequesta Code Enforce3ment Officer
testified to the ongoing violation.
Conclusion of law was that Respondents remain in violation of Chapter 30, Art. II, Section 30-33
of the Code of Ordinances of the Village of Tequesta, with respect to failing to finalize the fence
permit.
The Special Master ordered that Respondents, Richard and Theresa Kozell, shall immediately
comply with Chapter 30, Art. II, Section 30-33 of the Code of Ordinances of the Village of
Tequesta. A fine of up to $25.04 per day is hereby assessed for the violation that has existed.
The fine is imposed beginning July 19, 2007, and will continue to accrue at $25.00 per day for
each day the violation continues to exist.
Respondents shall be assessed $261.48 for administrative costs to be paid immediately.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.

The respondent, Nationwide Synergy, Inc., was represented at the hearing by Glenn Stefanos and
there was a fording of proper notice. The Tequesta Code Enforcement Officer testified to and
produced photos of the violation. The Code Officer also testified that the property was brought
into compliance on August 23, 2007.
Conclusion of law was that Respondent was, but is no longer, in violation of Chapter 70 Article
II, Section 70-43 and Chapter 30 Article II, Section 30-33 of the Code of Ordinances of the
Village of Tequesta.
The Special Master ordered that Respondent, Nationwide Synergy, Inc., shall continue to comply
with Chapter 70 Article II, Section 70-43 and Chapter 30 Article II, Section 30-33 of the Code of
Ordinances of the Village of Tequesta.
The Respondent shall be assessed $363.46 for administrative costs to be paid by the 2nd day of
September, 2007.
Future violations of the aforementioned code sections may be considered a repeat violation for
which a fine of up to $500.00 per day may be imposed beginning on the date the violation
begins.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.

The Tequesta Code Compliance Officer withdrew this case, advising it was now in compliance.
5) Case No. 2007-00182 Ronald Brown
Location of Violation: 371 Evergreen Ave.
Tequesta, FL 33469
Ordinance Description: Prohibited Conditions

The respondent, Ronald Brown, was present at the hearing and there was a finding of proper
notice. The Tequesta Code Enforcement Officer testified to and produced photos of the
violation.
Conclusion of law was that Respondent Ronald Brown is in violation of Chapter 30, Article II,
Section 30-33 of the Code of Ordinances of the Village of Tequesta.
The Special Master ordered that Respondent, Ronald Brown, shall comply with Chapter 30
Article II, Sec. 30-33 of the Code of Ordinances of the Village of Tequesta by the 28~' day of
• August, 2007.
If Respondent does not comply within the time specified, Respondent shall be assessed a fine of
up to $250.00 per day until the property is in full compliance. A Fine Assessment Hearing will
be held before the Special Master on the 27~' day of September 2007 at 10 a.m. at the Village of
Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida.
The Respondent shall be assessed $184.88 for administrative costs to be paid by the 22nd day of
September, 2007.
Future violations of the aforementioned code sections may be considered a repeat violation for
which a fine of up to $500.00 per day may be imposed beginning on the date the violation
begins.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount

The respondent, Thomas J. Awenire, was present at the hearing and there was a finding of
proper notice. The Tequesta Code Enforcement Officer testified to and produced photos of the
violation. The Village voluntarily dismissed the violation regarding Chapter 30, Article II, Sec.
30-33.
Conclusion of law was that Respondent is in violation of Chapter 14 Article VI, Section 14-152
of the Code of Ordinances of the Village of Tequesta. The violation regarding Chapter 30,
Article II, Sec. 30-33 is hereby dismissed.
The Special Master ordered that Respondent, Thomas J. Avvenire, shall comply with Chapter 14
Article VI, Section 14-152 of the Code of Ordinances of the Village of Tequesta by the 22nd
day of October, 2007.
• If Respondent does not comply within the time specified, Respondent shall be assessed a fine of
up to $250.00 per day until the property is in full compliance. A Fine Assessment Hearing will
be held before the Special Master on the 25~' day of October 2007 at 10 a.m. at the Village of
Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida.
The Respondent shall be assessed $115.25 for administrative costs to be paid by the 22nd day of
September, 2007.
Future violations of the aforementioned code sections may be considered a repeat violation for
which a fine of up to $500.00 per day may be imposed beginning on the date the violation
begins.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.
7) Case No. 2007-63 a) Carole Rajan

The respondent, Carole Rajan, was present at the hearing and there was a fmding of proper
notice. The Tequesta Code Enforcement Officer testified to and produced photos of the
violation. The Code Officer testified that the property was brought into compliance on August
13, 2007.
Conclusion of law was that Respondent was, but is no longer in violation of Chapter 14 Article
VI, Section 14-152 and Chapter 30 Article II, Section 30-33 of the Code of Ordinances of the
Village of Tequesta.
The Special Master ordered that Respondent, Carole Rajan, shall continue to comply with
Chapter 14 Article VI, Section 14-152 and Chapter 30 Article II, Section 30-33 of the Code of
Ordinances of the Village of Tequesta.
The Respondent shall be assessed $264.67 for administrative costs to be paid by the 22nd day of
September, 2007.

which a fine of up to $500.00 per day may be imposed beginning on the date the violation
begins.

Conditions

The respondent, FL1, was not present at the hearing; however, there was a finding of proper
notice. The Tequesta Code Enforcement Officer testified to and produced photos of the repeat
violation regarding the landscape and overgrowth. He also testified that the overgrowth and
• dead trees constituted an immediate and serious threat to the public health, safety, and welfare.

The Code Officer also produced a bee keeper bill for the removal of the bee hive, which was
authorized at a prior hearing.
Conclusion of law was that Respondent FL1 is in repeat violation of Chapter 30 Article II,
Section 30-32 and 30-33 of the Code of Ordinances of the Village of Tequesta with regard to the
landscape and overgrowth. Due to the serious nature of the violation, the Village is authorized to
correct the violation and charge the cost of repairs to the Respondent.
A fine of $500.00 per day is hereby assessed for the violation that exists. The fine is imposed
beginning August 2, 2007 and will continue to accrue at $500.00 per day for each day the
violation continues to exist.
The Respondent shall be assessed $1,262.00 for administrative costs and the bee keeper bill to be
paid immediately.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.
