VILLAGE OF TEQUESTA
SPECIAL MASTER CODE ENFORCEMENT HEARING
MINUTES
June 28, 2007
PRESENT: Special Master Lara Donlon; Code Enforcement Officer Joe Petrick, and
Recording Secretary Betty Laur
The hearing was called to order at 10:04 A.M.
Code Enforcement Special Master Donlon approved the minutes of the May 24, 2007 Special
Master Hearing as submitted.
• The following cases were heard by the Special Master:
1) Case No. 2006-OO1S6 Beatrice Sahabi
Location of Violation: 34 Chestnut Trail
Tequesta, Florida 33469
Ordinance Description: Fine Assessment
Chap. 78, Art. IX, Sec. 78-284
PCN # 60-42-40-25-25-000-1010
This case was withdrawn by the Village of Tequesta.
2) Case No. 2007-00141 Robert Syler
Location of Violation: 88 Fairview W
Tequesta, Florida 33469
Ordinance Description: Repeat Violation
R1-A Chap. 78, Art. IX, Sec. 78-644
PCN # 60-42-40-26-01-000-5570
The respondent, Robert Syler, was not present at the hearing; however, there was a finding of
proper notice. The Tequesta Code Enforcement Officer testified to and produced CAD reports
of the repeat violation. Respondent testified and produced photos at the hearing.
Conclusion of law was that Respondent, Robert Syler, was, but is no longer, in repeat violation
of Chapter 78 Article IX, Section 78-644 of the Code of Ordinances of the Village of Tequesta.

The Special Master ordered that Respondent Robert Syler shall continue to comply with Chapter
78 Article IX, Section 78-644 of the Code of Ordinances of the Village of Tequesta. A fine of
$250.00 is hereby assessed for the repeat violation that has existed. The fine of $250.00 per day
is imposed for the repeat violation that existed on May 29, 2007.
The Respondent shall be assessed $170.92 for administrative costs for the repeat violation
hearing, to be paid immediately.
The Respondent shall immediately pay the remaining fine and administrative cost of $981.$1
that was assessed in Case No. 2006-00135
A certified copy of this Order may be recorded in the Public Records of Palm Beach Caunty,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real ar personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.
3) Case No. 2007-00123 William Palagonia
Location of Violation: 144 Magnolia Way
• Tequesta, Florida 33469
Ordinance Description: Dogs Running At Large
Chap. 10, Art. II, Sec. 10-34
PCN # 60-42-40-25-44-000-0430
This case was withdrawn by the Village of Tequesta.
4) Case No. 2007-00132 Kay-Lynette Roca
Location of Violation: 285 Golfview Drive
Tequesta, Florida 33469
Ordinance Description: Repeat Violation Rl-A
Chap. 78, Art. IX, Sec. 78-644
PCN # 60-42-40-26-01-000-3840
The respondent, Kay-Lynette Roca, was present at the hearing; and there was a finding of proper
notice. The Tequesta Code Enforcement Officer testified to and produced photos of the repeat
violation.
Conclusion of law was that Respondent, Kay-Lynette Roca, was, but is no longer, in repeat
violation of Chapter 78 Article IX, Section 78-644 of the Code of Ordinances of the Village of
Tequesta.

The Special Master ordered that Respondent Kay-Lynette Roca shall continue to comply with
Chapter 78 Article IX, Section 78-644 of the Code of Ordinances of the Village of Te~uesta.
The Respondent shall be assessed $202.71 for administrative costs to be paid by the 8 day of
July, 200?.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.
5) Case No. 2007-00131 Danny & Bambi Mingle
Location of Violation: 305 Country Club Drive
Tequesta, Florida 33469
Ordinance Description: Repeat Violation Rl-A

The respondent, Bambi Mingle, was present at the hearing; and there was a finding of proper
• notice. The Tequesta Code Enforcement Officer testified to and produced CAD reports of the
repeat violation.
Conclusion of law was that Respondents, Danny and Bambi Mingle, were, but are no longer, in
repeat violation of Chapter 78 Article IX, Section 78-644 of the Code of Ordinances of the
Village of Tequesta.
A fine of $100.00 is hereby assessed for the repeat violation that has existed. The Respondents
shall be assessed $271.72 for administrative costs to be paid immediately.
Future violations of the aforementioned code sections may be considered a repeat violation for
which a fine of up to $500.00 per day may be imposed beginning on the date the violation
begins.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.
6) Case No. 2007-00017 Mobil Oil Corporation
Location of Violation: ?64 N. U.S. Highway One

Chap. 30, Art. II, Sec. 30-33
PCN # 60-43-40-30-00-001-0160
The respondent, Mobile Oil Corporation, was represented at the hearing by Ken Sampson,
Territory Manager, and Neal Maligno, Store Manager; and there was a fording of proper notice.
The Tequesta Code Enforcement Officer testified to and produced photos of the ongoing
violation. The Respondent has made substantial progress on bringing the property into
compliance, even though compliance has not yet been achieved.
Conclusion of law was that Respondent remains in violation of Chapter 30 Article II, Section 30-
33 of the Code of Ordinances of the Village of Tequesta.
The Special Master ordered that Respondent, Mobil Oil corporation, shall immediately comply
with Chapter 30, Article II, Section 30-33 of the Code of Ordinances of the Village of Tequesta.
A fine of $200.00 per day is hereby assessed for the repeat violation that has existed. T'he fine is
imposed beginning June 28, 2007, and will continue to accrue at $200.00 per day for each day
the violation continues to exist. The Respondent shall be assessed $245.13 for administrative
• costs to be paid by the 8a` day of July, 2007.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and once recorded, shall constitute a lien against the property of the original amount
upon which the violation existed and upon any other real or personal property owned by the
Respondent, pursuant to Chapter162, Florida Statutes, for the original amount.
