The hearing was called to order at 10:00 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the July 24, 2003 Special Master Hearing as submitted B. Violation Hearings: Case No. 03-101888 03-104167 Alvin Bergman 391 Norfolk Ave Tequesta, FL 33469 Legal: Jupiter in the Pines Sec B Lt 7 Blk 18 60-42-40-25-06-018-00705 Violation of Code of Ordinances, 263, Section 13-31, Abandoned Vehicles The Respondent, Alvin Bergman, was present at the hearing. The Tequesta Code Enforcement Officer test'rfied to the violation ~• Conclusion of law is that the Respondent is not in violation of Ordinance 263, Section 13-31 of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondent Alvin Bergman is not in violation of Ordinance #263, Section 13-31, of the Code of Ordinances of the Village of Tequesta. ~y~~~ ~~ • Special Master Hearing August 28, 2003 Page 2 Case No. 03-103685 03-105799 Yvorie Pfeiffer 18 Strathmore Lane, Westport, CT 06880 Legal: Tequesta Lt 220 so-42-4a2s-ol -000-2200 Violation of Code of Ordinances, #464, Appendix A, Restricted Parking R1A The Respondent, Yvorie Pfeiffer, was represented at the hearing by Charles Pfeiffer, the Respondent's son. The Tequesta Code Enforcement Officer test'rFied to the violation. • Conclusion of law is that the Respondent is in violation of Ordinance #464, Appendix A, of the- Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that aStatus/Fine Assessment Hearing will be held before the Special Master on the 25~' day of September, 2003, at 10:00 a.m., at the Tequesta Recreation Center Council Chambers, 399 Seabrook Road, Tequesta, Florida, at which time Respondent shall have planted the bamboo screen and brought driveway into compliance.. Case No. 03-104504 Inland Southeast Tequesta LLC & Southern Waste Systems & Browning-Ferris Industries 105 N. U.S. Highway 1 Tequesta, Florida 33469 Legal: 60-43-40-30-00-003-0050 ~• Violation of Village of Tequesta Franchise- Agreement, Article V, Subdivision 1, Page 1377 The Respondents, Inland Southeast Tequesta LLC and Browning-Ferris Industries, were not present at the hearing. Hartley, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer requested this case be reset for the next hearing. Legal: Tequesta Lt 207 60-42-40-26-01-000-2070 Special Master Paulette Torcivia ordered that Respondent Charles R. Hartley shall comply with Ordinance #464, Appendix A, of the Code of Ordinances of the Village of Tequesta. A status hearing will be held before the Special Master on September 25, 2003 at 10:00 a.m. at the Tequesta Recreation Center Council Chambers, 399 Seabrook Road, Tequesta, Florida. Repeat Violation of Code of Ordinances, #464, Appendix A Restricted Parking R1A Violation Hearing: ~• Case No. 03-106437 Legal: Tequesta Lt 174 60-42-40-26-01-000-1740 Gary Delisle 220 Country Club Drive Tequesta, Florida 33469 • Violation of Code of Ordinances, #464, Appendix A, Restricted Parking R1A The Respondent, Gary Delisle, was present at the hearing The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law is that the Respondent is in violation of Ordinance #464, Appendix A, Restricted Parking R1A of the Code of Ordinances of the Village of Tequesta. w Special Master Hearing August 28, 2003 Page 4 Special Master Paulette Torcivia ordered that Respondent, Gary Delisle, shall comply with Ordinance #464, Appendix A, Restricted Parking R1 A of the Code of Ordinances of the Village of Tequesta by the 29~' day of August, 2003. If Respondent is again found in violation of Ordinance #464, Appendix A, a fine of fifty dollars ($50.00) shall be assessed. Case No. 03-105492 Tamwest Realty Inc. 213-01 99~" Avenue Jamaica, New York 11429 Legal: 60-430-30-00-001-0080 Violation of Code of Ordinances of the Village of Tequesta, Ordinance Appendix A, Section XII(O)(8), Page 1208.4 Outdoor Merchandising Prohibited The Respondent, Tamwest Realty Inc., represented at the hearing by the property manager of County Line Plaza, Don Campbell. The Tequesta Code Enforcement Officer testirfied to the violation. It Conclusion of law is that the Respondent is in violation of Ordinance Appendix A, Section XII(O)(8) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Tamwest Realty Inc. shall comply with Ordinance Appendix A, Section XII(O)(8) of the Code of Ordinances of the Village of Tequesta by the 31st day of August, 2003. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Fine Imposition Hearings: The Respondent, Eric Fritz, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the ongoing violation. Conclusion of law was that Respondent was in violation of Ordinance #464, App. A of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that the Respondent Eric Fritz shall immediately comply with Ordinance #464, Appendix A, of the Code of Ordinances of the Village of Tequesta. A fine of seventy five dollars ($75.00) is hereby assessed for the violation that has existed. Said fine shall be paid by the 20~' day of September, 2003. Special Master Hearing August 28, 2003 Page 5 Case No. 03-105547 Eric Fritz 244 Fairway East Tequesta, FL 33469 Legal: Tequesta LT 219 60-42-40-26-01-000-2190 Repeat Violation of Code of Ordinances of the Village of Tequesta, Ordinance #464, Appendix A- Restricted Parking R1A A cert'rfied copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. i• Case No. 03-105703 John P. Funkey 124 Fairview East Tequesta, FL 33469 • Special Master Hearing August 28, 2003 Page 6 Legal: Tequesta LT 473 60-420-26-01-000-4730 Repeat Violation of Code of Ordinances of the Village of Tequesta, Ordinance #464, Appendix A- Restricted Parking R1 A The Respondent, John P. Funkey, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the ongoing violation. Conclusion of law was that Respondent is in repeat violation of Ordinance #464, Appendix A of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that the Respondent, John P. Funkey, shall comply with Ordinance #464, Appendix A, of the Code of Ordinances of the Village of Tequesta by the 6~' day of September, 2003. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. Case No. 03-105789 Christopher Orsini 128 Fairview East Tequesta, FL 33469 ~• Legal: Tequesta LT 472 60-42-40-26-01-000-4720 Repeat Violation of Code of Ordinances of the Village of Tequesta, Ordinance #464, Appendix A- Restricted Parking R1A U Special Master Hearing August 28, 2003 Page 7 The Respondent, Christopher Orsini, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the ongoing violation. Conclusion of law was that Respondent is in repeat violation of Ordinance #464, Appendix A of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that the Respondent, Christopher Orsini, shall comply with Ordinance #464, Appendix A, of the Code of Ordinances of the Village of Tequesta by the 6~' day of September, 2003. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Case No. 03-105789 Monica Armour 15 Bunker Place Tequesta, FL 33469 Legal: Tequesta LT 298 60-42-40-26-01-000-1980 Violation of Code of Ordinances of the Village of Tequesta, Ordinance #464, Appendix A- Restricted Parking R1 A The Respondent, Monica Armour, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer ! • testified to the violation. Conclusion of law was that Respondent is in violation of Ordinance #464, Appendix A of the Code of Ordinances of the Village of Tequesta. • Special Master Hearing August 28, 2003 Page 8 Special Master Paulette Torcivia ordered that the Respondent, Monica Armour, shall comply with Ordinance #464, Appendix A, of the Code of Ordinances of the Village of Tequesta by the 29th day of August, 2003. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. w Case No. 03-101504 John Dambrosio 438 Dover Road Tequesta, FL 33469 Legal: Jupiter in the Pines Sec B Lt 21 BIk15 60-42-40-25-06-015-0210 Violation of Code of Ordinances of the Village of Tequesta, Ordinance #512, Section 9-55 -Schedule of User Fees The Respondent, John Dambrosio, was not present at the hearing. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Ordinance #512, Section 9-55, of the Code of Ordinances of the Village of Tequesta. ~• Special Master Paulette Torcivia ordered that the Respondent, John Dambrosio, shall comply with Ordinance #512, Section 9-55 of the Code of Ordinances of the Village of Tequesta by the 15th day of September, 2003, for the January 11, 2002 emergency transportation. If Respondent does not pay the fee of four hundred two dollars and fifty cents ($402.50) within the time specified, a fine of twenty five dollars ($25.00) per day shall be assessed for each day the violation continues to exist. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, ,shall constitute a lien against the • Special Master Hearing August 28, 2003 Page 9 property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. Case No. 03-105319 Timothy A. Menzer 346 Beacon Street Tequesta, FL 33469 Legal: Jupiter in the Pines Sec D Lt 17BIk31 60-43-40-30-04-031-0170 • Violation of Code of Ordinances of the Village of Tequesta, Ordinance #511, Section 4-13, Page 259 -Leash Law The Respondent, Timothy A. Menzer, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Ordinance #511, Section 4-13, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that the Respondent, Timothy A. Menzer, shall comply with Ordinance #511, Section 4-13 of the Code of Ordinances of the Village of Tequesta. Respondent is hereby assessed a fine of fifty dollars ($50.00) for the violation that has existed. This fine is to be paid by September 19, 2003. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. Pryel 114 Chapel Lane Tequesta, FL 33469 Legal: Chapel Court Sec 3 LT 4 • Special Master Hearing August 28, 2003 Page 10 60-42-40-25-36-000-0040 Violation of Code of Ordinances of the Village of Tequesta, Ordinance #511, Section 4-13, Page 259 -Leash Law The Respondent, Robert O. Pryel, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Ordinance #511, Section 4-13, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that the Respondent, Robert O. Pryel, shall comply with Ordinance #511, Section 4-13 of the Code of Ordinances of the Village of Tequesta by August 32, 2003. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount.
