Allison Chief of Police VILLAGE OF TEQUESTA SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES July 24, 2003 • Case No. 03-98767 Carolyn Moora, Arthur & Carolyn Hunter 331 Country Club Drive Tequesta, FL 33469 Legal: Tequesta in PB 25 60-42-40-26-01-000-1260 Violation of Code of Ordinances, Chapter 10, Section 17-20, Pages 581- 585, Health and Sanitation .] PRESENT: Special Master Paulette Torcivia; Code Enforcement Officer Sy Steinsaltz; Recording Secretary Betty Laur. The hearing was called to order at 10:00 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the June 26, 2003 Special Master Hearing, noting that she had approved the wrong date on a status hearing for Carolyn Morra for July 30 which should have been today, July 24; and that Ms. Morra's daughter was present at today's hearing. B. Status Hearing: The Respondent was represented at the hearing by her daughter, Carolyn Moora, who testirfied to her plans for complying. The Tequesta Code Enforcement Officer testified to and presented photographs of the violation. The Tequesta Code Enforcement Officer testified that the Village secured the swimming pool. No fine was assessed at this time. • Special Master Hearing July 24, 2003 Page 2 Conclusion of law is that the Respondent remains in violation of Chapter 10, Section 17-20 pf the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondents shall comply with Chapter 10. Section 17-20 of the Code of Ordinances of the Village of Tequesta by the 18~' day of September, 2003. If Respondents do not comply within the time specified, a fine of two hundred fifty dollars ($250.00) per day shall be assessed for each day the violation continues to exist. If Respondents fail to comply within the time specfied, a Fine Assessment Hearing will be held before the Special Master on the 25"' day of September, 2003, at 10:00 a.m., at the Council Chambers, Tequesta Recreation Center, 399 Seabrook Road, Tequesta, Florida. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. C. Fine Reduction Hearing: Case No. 03-97538 Kirk Bielski 454 Nortl~ Dover Road Tequesta, FL 33469 Legal: Jupiter in lfre Pines Sec B Lt 17BIk15 60-42.40-25-06-015-0170 Violation of Code of Ordinances of the Villag® of Tequesta, Ordinance #355 App. A, Sec. X(L)(2), Page 1184.1, Commercial Parking The Respondent, Kirk Bielski, was present at the hearing. The Tequesta Code Enforcement Officer testified that the Respondent is no longer in violation. • Conclusion of law is that the Respondent is no longer in violation of Ordinance #355, App. A, Sec. X(L)(2) of the Code of Ordinances of the Village of Tequesta. • Special Master Hearing June 26, 2003 Page 3 Special Master Paulette Torcivia ordered that Respondent's fine shall be reduced to two hundred fifty dollars ($250.00). This amount shall be paid by the 22"°~ day of August, 2003, or the original fine of two thousand dollars ($2,000.00) will be reinstated. D. Fine Imposition Hearing Case No. 03-08875 Riverside Oaks, LLC 3721 SW 47~' Ave, Suite 307 Ft. Lauderdale, FL 33314 Legal: Riverside Oaks Lot 1 60-420-25-44-000-0010 Repeat Violation of Code of Ordinances, #199 Sec 6.1(c) and #211 Sec 12 • The Respondent, Riverside Oaks, LLC, was represented at the hearing by the owner, David Spear. Mr. Spear provided witnesses Dan Amold, a representative of Bradco Roofing; Jonathan Reagle, Superintendent of the project; and Marvin Cean, Supervisor for Southern State. The Tequesta Code Enforcement OfFcer testified to and provided photographs of the violations. Conclusion of law is that the Respondent was in violation of Ordinance #199 Section 6 and Ordinance #211 Section 12 of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondent, Riverside Oaks, LLC, shall continue to comply with Ordinance #199 Section 6 & Ordinance #211 Section 12 of the Code of Ordinances of the Village of Tequesta. A fine of one hundred fifty dollars ($150.00) is hereby assessed for the violation that has existed. The fine is imposed for the day of June 25, 2003. Said fine shall be paid by the 22"d day of August, 2003. If Respondent is found in repeat violation of Ordinance #199, Section 6 and 211 and Section 12 of the Code of Ordinances of the Village of Tequesta, a fine of one hundred fifty dollars ($150.00) per day shall be assessed for each day the violation continues to exist. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the properly of the original amount upon which the violation existed and upon any Special Master Hearing July 24, 2003 Page 4 other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. Case No. 03-103420 Wade B. Harrouff 267 River Drive Teques~, Florida 33469 Legal: Tequesta Lot 68 & S 5 Ft of Lot 69 60-42-00-26-01-000-0680 Violation of Code of Ordinances, #511, Section 413, Page 259, Running at Large Prohibited The Respondent, Wade B. Harouff, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law is that the Respondent is in violation of Section 4-13 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent Wade B. Harouff shall continue to comply with Section 4-13 of the Code of Ordinances of the Village of Tequesta. Respondent shall be assessed a fine of fifty dollars ($50,.00) to be paid by August 22, 2003. If respondent is found in repeat violation of Section 4-13 of the Code of Ordinances of the Village of Tequesta, Respondent shall be assessed a fine of one hundred dollars ($100.00). A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Case No. 03-101392 Marianne C. Jarski 406 Tequesta Drive • Tequesta, Florida 33469 Legal: Jupiter in the Pines Sec B Lt 13 Blk 22 • Special Master Hearing June 26, 2003 Page 5 602-40-25-06-022-0130 Repeat Violation of Code of Ordinances, #355, Appendix A, Section VIII (c), Page 1138.13 Drainage and I~laintenance The Respondent, Marianne C. Jarski, was not present at the hearing. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law is that the Respondent is in violation of Ordinance #355, Appendix A, Section VIII(c) of the Code of Ordinances of the ~Ilage of Tequesta. Special Master Paulette Torcivia ordered that this matter be continued and a Status Hearing will be held before the Special Master on the 25~' day of September, 2003, at 10:00 a.m. at the Council Chambers, Tequesta • Recreation Center, 399 Seabrook Road, Tequesta, Florida. Case No. 03-102352 Charles 8 Francis Mooneyhan 19428 Pine Try Drive Tequesta, Florida 33469 Legal: Pt of S 100.48 Ft. of N 446.7 Ft of GOV LT 5 E of Rd in DB 1053P126 60-42-40-25-00-005-0130 Violation of Code of Ordinances, #511, Section 4-13, Page 259, Running at Large Prohibited The Respondents, Charles and Francis Mooneyhan, were not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law is that the Respondent is were violation of Ordinance #511, Section 413 of the Code of Ordinances of the vtlage of Tequesta. Special Master Paulette Torcivia ordered that Respondent Chaves and Francis Mooneyhan shall continue to comply with Ordinance #511, Section 4 13 of the Code of Ordinances of the Village of Tequesta. If respondents are found in repeat violation of Ordinance #511, Section 4-13 of the Code of Ordinances of the ~Ilage of Tequesta, Respondent shall be assessed a fine of one hundred dollars ($100.00) per day for each day the violation continues to exist. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. E. Violation Hearing Case No. 03-101503 Jacob Demerac III 359 Cedar Ave. Tequesta, Florida 33469 • Legal: Jupiter in ~e Pines SEC B Lot 5 Blk 26 60-420-06-01-026-0050 Violation of Code of Ordinances, #512, Secdon 9-55, Page 539 Schedule of User Fees The Respondent, Jacob Demerac III, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. The date of the emergency medical transportation was February 16, 2003. Conclusion of law is that the Respondent is in violation of Ordinance #512, Section 9-55 of the Code of Ordinances of the village of Tequesta. Special Master Paulette Torcivia ordered that Respondent Jacob Demerac III shall reimburse the Village of Tequesta in the amount of three hundred thirty three dollars and seventy five cents ($333.75) by the 22"d day of August, 2003.. Case No. 03-101910 Mary Stephen 343 County Club Drive Tequesta, Florida 33469 Legal: Tequesta Lt 129 60-420-26-01-000-1290 • Violation of Code of Ordinances, #377, Appendix A, Section X(H)(15), Page 1178.8 Landscape Maintenance Required The Respondent, Mary Stephen, was not present at the hearing The Tequesta Code Enforcement Officer testfied that the Respondent is no longer in violation. Conclusion of law is that the Respondent is no longer in violation of Ordinance #377, Append'oc A, Section X(H)(15)of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Mary Stephen, shall continue to comply with Ordinance #377, Appendix A, Section X(H)(15) of the Code of Ordinances of the Village of Tequesta. Case No. 03-102633 Dean B. Young 104 Fairview West Tequesta, FL 33469 Legal: Tequesta Lt 553 60-62-40-26-01-000-5530 Violation of Code of Ordinances of the Village of Tequesta, Ordinance #355, Appendix A, Section VIII (c), Special Master Hearing July 24, 2003 Page 8 Page 1138.13 Drainage and Maintenance The Respondent, Dean B. Young, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. Conclusion of law is that the Respondent is in violation of Ordinance #355, Appendix A, Section VIII(c)of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Dean B. Young, shall comply with Ordinance #355, Appendix A, Section VIII(c) of the Code of Ordinances of the Village of Tequesta by the 15~' day of August, 2003. If Respondent does not comply within the time specfied, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. ~~ If Respondent does not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 28~' day of August, 2003 at 10:00 a.m., at the Tequesta Recreation center Main Meeting Room (Council Chambers), 399 Seabrook Road, Tequesta, Florida. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the properly of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statut®s for the original amount. F. Fine Reduction Hearing Case No. 03-97404 03-97250 Robert H. King 366 Elm Avenue Tequesta, FL 33469 Legal: Jupiter in the Pines Sec B Lt 2 Blk 25 60~2~0-25-0625-0020 • Violation of Code of Ordinances of the Village of Tequesta, Ordinance • Special Master Hearing June 26, 2003 Page 9 The Respondent, Robert J. King, was not present at the hearing. The Tequesta Code Enforcement Officer testfied that Respondent had contacted him regarding May 29, 2003 Order. Conclusion of Law was Respondent was not in repeat violation of Ordinance #355, App. A of the Code of Ordinances of the Village of Tequesta as ordered on May 29, 2003. Special Master Paulette Torcivia ordered that the Order dated May 29, 2003 is hereby rescinded and Respondent is not liable for the fine as ordered. • G.
