The hearing was called to order at 10:00 A.M. • A. Code Enforcement Special Master Donlon provided a copy of the minutes of the October 24, 2002 Special Master Hearing, which had been signed and approved by Special Master Paulette Torcivia as submitted. B. Fine Reduction Hearings: Case No. 0277192 Richard Bums 7557 SE Pelican Way Hobe Sound, FL 33455 Violation of Code of Ordinances, Chapter 11-24 -Occupational License Required The Respondent, Richard Bums, was present at the hearing. The Tequesta Code Enforcement Officer testified that the Village of Tequesta records show the Respondent to be current on occupational licenses. Conclusion of law is that the Respondent, Richard Bums, is no longer in violation of Chapter 11-24 of the Code of Ordinances of the Viltage of Tequesta. • Recycled Paper Special Master Hearing January 23, 2003 Page 2 Special Master Lara Donlon ordered that Respondent's fine shall be reduced to zero. Case No. 0279924 Lady Bug Lawn Care 101510"' Street Lake Park, Florida 33403 Violation of Code of Ordinances, Chapter 11-24 -Occupational License Required The Respondent, Lady Bug Lawn Care, was present at the hearing and offered testimony regarding attempts to obtain the proper licenses. The Tequesta Code Enforcement Officer testified that a fine reduction was appropriate. Conclusion of law is that the Respondent, Lady Bug Lawn Care, is currently in • violation of Chapter 11-24 of the Code of Ordinances of the Village of Tequesta. Special Master Donlon ordered that Respondent's fine shall be reduced to one hundred dollars ($100.00). this amount shall be paid by the 23`~ day of February, 2003, or the original fine will be reinstated. It was further ordered that Respondent shall bring his licenses current by paying $87.50 to obtain same and provide the necessary documentation to the Village of Tequesta by the 23`~ day of February, 2003, or the original fine will be reinstated. B. Fine Imposition Hearings: Case No. 0282134 Kirk Bielski 0282959 454 Dover Road 0284758 Tequesta, FL 33469 • Legal: Jupiter fn The Pines Sec B Lot 17 Blk 15 60-02-40-25-06-015-0170 Repeat Violation of Code of Ordinances of the Village of I Special Master Hearing • January 23, 2003. Page 3 Tequesta, Chapter 355, Appendix A, Recreational/Commercial Parking, Section X-L (2), Page 1184 The Respondent, Kirk Bielski, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the ongoing violation. Conclusion of law was that Respondent remains in violation of Chapter 355, Appendix A, Section X-L(2) of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Kirk Bielski, shall immediately comply with Chapter 355, Appendix A, Section X-L(2) of the Cade of Ordinances of the Village of Tequesta. A fine of One Hundred Fifty Dollars ($150.00) was assessed for the violation that has existed. The fine was imposed for the period October 24, 2002 through January 23, 2003. A certified copy of this Order shall be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Case No. 0282144 0286279 David J. Rivera, Jr. 3 Leeward Circle Tequesta, FL 33469 Legal: Country Club Point Lt 1 Blk 3 60-42-40-25-003-0010 Repeat Violation of Code of Ordinances of the Village of Tequesta Chapter 355, Appendix A, Recreational/Commercial Parking, Section X-L(2), Page 1184 I • Special Master Hearing January 23, 2003 Page 4 The Respondent, David J. Rivera, Jr., was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the ongoing violations. Conclusion of law was that Respondent remains in violation of Section 355 Appendix A, Recreational/Commercial Parking, Section X-L(2), Page 1184 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, David J. Rivera, Jr., shall comply wi#h Section 355, Appendix A, Recreational/Commercial Parking, Section X - L (2) page 1184 of the Code of Ordinances of the Village of Tequesta. A fine of five hundred dollars ($500.00) is hereby assessed for the violation that has existed regarding Section X-L (2) of the Code of Ordinances of the Village of Tequesta. Respondent shall also comply with Section VIII C, Drainage and Maintenance by the 9th day of March 2003. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any • other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. C. Violation Hearings Case No. 0283053 Joseph and Lori Cannon 7 Chapel Circle Tequesta, FL 33469 Legal: Chapel Court Sec 2 as in PB47P 1~, Lt 27 60-42-40-25-32-000-0270 Violation of Code of Ordinances of the Village of Tequesta Chapter 355, Appendix A, Recreational/Commercial Parking, Section X-L(2), Page 1184 The Respondents, Joseph and Lori Cannon, were not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. • Special Master Hearing . January 23, 2003 Page 5 Conclusion of law was that Respondents are in violation of Chapter 355, Appendix A, Recreational/ Commercial Parking, Section X-L(2), Page 1184 of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondents, Joseph and Lori Cannon, shall continue to comply with Chapter 355, Appendix A, Recreational/ Commercial Parking, Section X-L(2), Page 1184 of the Code of Ordinances of the Village of Tequesta. If Respondents fail to continue to comply, a fine may be assessed if the violation reoccurs. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Dolorme 130 Fairview West a Tequesta, FL 33469 Legal: Tequesta Lt 547 60-42-40-26-01-000-5470 Violation of Code of Ordinances of the Village of Tequesta Chapter 464 Appendix A, Restricted Parking, Section X-L (3) -Page 1185 The Respondent, Keith R. Dolorme, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. The Tequesta Code Enforcement Officer tested further that the Respondent had complied with Chapter 464 Appendix A, Restricted Parking, Section X-L (3) prior to the hearing. Conclusion of law was that Respondent is currently in compliance with Chapter 464, Appendix A, Section X-L (3) of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Keith R. Dolorme, shall continue to comply with Chapter 464, Appendix A, Section X-L (3) of the Code Special Master Hearing • January 23, 2003 Page 6 of Ordinances of the Village of Tequesta. If Respondent fails to continue to comply, a fine may be assessed if the violation occurs. Forman 28 Shady Lane Tequesta, FL 33459 Legal: Shady Lane P1 1 Lot 7 60-42-40-25-29-000-0070 Violation of Code of Ordinances of the Village of Tequesta Chapter 464 Appendix A, Restricted Parking, Section X-L (3) -Page 1185 The Respondent, Walter H. Forman, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. The Tequesta Code Enforcement Officer testified further that the Respondent had complied with Chapter 464 Appendix A, Restricted Parking, Section X-L (3) prior to the hearing. Conclusion of law was that Respondent is currently in compliance with Chapter 464, Appendix A, Section X-L (3) of the Code of Ordinances of the Village of Tequesta. Special Master Tara Donlon ordered that Respondent, Walter H. Forman, shall continue to comply with Chapter 464 Appendix A, Restricted Parking, Section X-L (3). If Respondent fails to continue to comply, a fine may be assessed if the violation occurs. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Special Master Hearing • January 23, 2003 Page 7 Case No. 0285940 Lee Heaton 53 Pine Hill Trail West Tequesta, FL 33469 Legal: Tequesta Pines Lt 20 60-42-40-25-000-1200 Violation of Code of Ordinances of the Village of Tequesta Chapter 355, Appendix A, Recreation/Commercial Parking, Section X-L (2) -Page 1184 The Respondent, Lee Heaton, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. The Tequesta Code Enforcement Officer testified further that the Respondent had sold the subject property, no longer resides at the subject property, and had not caused a violation on the subject property since the date of sale. • Conclusion of law was that Respondent was in violation of Chapter 355, Appendix A, Section X-L (2} of the Code of Ordinances of the Village of Tequesta during the time Respondent owned the property. Respondent no longer owns the subject property. Special Master Lara Donlon ordered that the matter against Respondent, Lee Heaton, regarding compliance with Chapter 355 Appendix A, Section X-L (2) of the Code of Ordinances of the Village of Tequesta is hereby dismissed. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Case No. 0281071 Neal F. Ireland 316 Tequesta Drive Tequesta, FL 33469 Legal: Jupiter in the Pines Sec D Lt 3 Blk 35 60-43-40-30-04-035-0030 • • Special Master Hearing January 23, 2003 Page 8 Violation of Code of Ordinances of the Village of Tequesta Chapter 263, Section 13-31, Abandoned Vehicles, Page 778.2 The Respondent, Neal F. Ireland, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Ofi•icer testified to and produced photographs of the violation. The Tequesta Code Enforcement Officer testified further that the Respondent had complied with Chapter 263, Section 13-31 of the Code of Ordinances prior to the hearing. Conclusion of law was that Respondent is currently in compliance with Chapter 263, Section 13-31 of the Code of Ordinances of the Village of Tequesta. Specia{ Master Lara Donlon ordered that Respondent, Neal F. Ireland, shall continue to comply with Chapter 263, Section 13-31, (2) of the Code of Ordinances of the Village of Tequesta. If Respondent does not continue to comply, a fine may be assessed if the violation reoccurs. • A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Case No. 0283054 Jason and Gina Messenger 50 Chapel Court Tequesta, FL 33469 Legal: Chapel Court Sec 1 Lt 13 60-42-40-25-31-0-0130 Violation of Code of Ordinances of the Village of Tequesta Chapter 355, Appendix A, Recreation/Commercial Parking, Section X-L (2j -Page 1184 The Respondents, Jason and Gina Messenger, were not present at the • hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. • Special Master Hearing January 23, 2003 Page 9 The Tequesta Code Enforcement Officer testified further that the Respondent had complied with Chapter 355, Appendix A, Section X-L (2} of the Code of Ordinances of the Village of Tequesta. Conclusion of law was that Respondents are currently in compliance with Chapter 355, Appendix A, Section X-L (2) of the Code of Ordinances of the Village of Tequesta. Nunevilie, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. The Tequesta Code Enforcement Officer testified further that the Respondent had complied with Chapter 355, Appendix A, Section X L (2} of the Code of Ordinances of the Village of Tequesta. Conclusion of law was that Respondent is currently in compliance with Chapter 355, Appendix A, Section X-L (2) of the Code of Ordinances of the • Village of Tequesta. • Special Master Hearing January 23, 2003 Page 10 Special Master Lara Donlon ordered that Respondent, Dean E. Nuneville, shall continue to comply with Chapter 355 Appendix A, Section X-L (2) of the Code of Ordinances of the Village of Tequesta. Taylor, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. The Tequesta Code Enforcement Officer testified further that the Respondent had complied with Appendix A, Section XII (O)(5) of the Code of Ordinances of the Village of Tequesta. Conclusion of law was that Respondent is currently in compliance with Appendix A, Section XII (O)(5) of the Code of Ordinances of the Village of Tequesta. Special Master Lara Donlon ordered that Respondent, Matthew E. Taylor, shall continue to comply with Appendix A, Section XII (O)(5) of the Gode of Ordinances of the Village of Tequesta. if Respondent does not continue to comply, a fine may be assessed if the violation reoccurs.
