The hearing was called to order at 10:00 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the August 22, 2002 Special Master Hearings as submitted. B. Fine Imposition Hearings: None C. Violation Hearings: • The Respondent, Gayla Dorris, was present at the hearing. The Tequesta Code Enforcement Officer testified to the violation. • Special Master Hearing September 26, 2002 Page 2 • Conclusion of law was that Respondent is in violation of Chapter 464 R-1-A Zone, Section X - L (3} of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Peter and Gayla Dorris, shall comply with Chapter 464 R-1-A Zone, Section X - L (3) of the Code of Ordinances of the Village of Tequesta by the 28th day of September, 2002. If Respondents do no# comply within the time specified, a fine of Fifty Dollars ($50.00) per day shalt be assessed for each day the violation continues to exist. Case No. 02-74349 Andrew J. Biegler and Irene Romeo 427 Tequesta Drive Tequesta, FL 33469 Legal: Jupiter in the Pines Sec B Lt 6 Blk 19 60-42-40-25-06-019-0060 Violation of Code of Ordinances of the Village of Tequesta Chapter 355, Appendix A, Recreation/Commercial Section X-L (2J -Page 1184 The Respondent, Andrew J. Biegler, was present at the hearing. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Chapter 355 X - L (2) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Andrew J. Biegler and Irene Romeo, shall comply with Section 355 X - L (2) of the Code of Ordinances of the Village of Tequesta by the 28th day of September, 2002. If Respondents do not comply within the time specified, a fine of Fifty Dollars ($50.00) per day shall be assessed for each day the violation continues to exist. r: • Special Master Hearing September 26, 2002 Page 3 :7 • Ms. Friedman was in attendance; however, her case had not been listed on the agenda. The Tequesta Code Enforcement Officer advised that the citation had been voided. Special Master advised that if she was on the agenda next month she would not have to appear. Case No. 02-75096 Daniel Dane Prairie 314 Country Club Drive Tequesta, FL 33469 Legal: Tequesta in PB 25 Pgs 7 to 15 Inc 60-42-40-26-01-000-1500 Violation of Code of Ordinances of the Village of Tequesta Chapter 464 R-1-A Zone, Section X-L (3) Restricted Parking The Respondent, Daniel Dane Prairie, was present at the hearing. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Chapter 464 X - L (3) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Daniel Dane Prairie, shall comply with Chapter 464 X - L (3) of the Code of Ordinances of the Village of Tequesta by the 28th day of September, 2002. If Respondent does not comply within the time specified, a fine of Fifty Dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Case No. 02-74341 Albert Soriano 458 Dover Road Tequesta, FL 33469 Legal: Jupiter in the Pines Sec B Lot 16 Block 15 60-42-40-25-06-015-0160 • Special Master Hearing September 26, 2002 Page 4 Violation of Code of Ordinances of the Village of Tequesta Chapter 355, Appendix A, Recreation/Commercial Section X-L (2) Page 1184 The Respondent, Albert Soranzo, was present at the hearing.. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Chapter 355, Appendix A, Recreation/Commercial Section X-L (2) Page 1184 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Albert Soranzo, shall comply with Chapter 355, Appendix A, Recreation/Commercial Section X-L (2) Page 1184 of the Code of Ordinances of the Village of Tequesta by the 28th day of September, 2002. If Respondent does not comply within the time specified, a fine of Fifty Dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Case No. 02-74346 Anthony C. Stumpp 80 Yacht Club Place Tequesta, FL 33469 Legal: Tequesta Lot 505 60-420-26-01-000-5050 Violation of Code of Ordinances of the Village of Tequesta Chapter 464 R-1-A Zone, Section X-L (3) - Restricted Parking, Page 1185 The Respondent, Anthony C. Stumpp, was present at the hearing. The Tequesta Code Enforcement Officer requested this case be dismissed. Conclusion of law was that Respondent is not in violation of Chapter 464- R-1- A Zone, Section X-L(3) of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that this case be dismissed. • • Special Master Hearing September 26, 2002 Page 5 Case No. 02-76097 Elizabeth M. Ciancio-Gansberg 510 Dover Road North Tequesta, FL 33469 Legal: Jupiter in the Pines Sec B Lot 4 Blk 16 60-42-40-25-06-016-0040 Repeat Violation of Code of Ordinances of the Village of Tequesta Chapter 511 Leash Law, Section 4- 7(a)(b) 8~ 4-13, Page 257 The Respondent, Elizabeth M. Ciancio-Gansberg, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the repeat violation. Conclusion of law was that Respondent is in repeat violation of Chapter 511 Leash Law, Section 4-7(a)(b) 8~ 4-13, Page 257. Special Master Torcivia • ordered that a fine of seventy-five dollars ($75.00) is hereby assessed in accordance with Chapter 511 Leash Law, Section 4-7(a)(b) & 4-13, Page 257 for the violation that has existed. Said fine shall be paid in full by the 15th day of October, 2002. A copy of this order shall be recorded in the Public Records of Palm Beach County, Florida, and once recorded shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the respondents, pursuant to Chapter 162, Florida Statutes for the original amount. Case No. 0274344 Hugh M. Evans and Thomas Raiford 227 Fairway East Tequesta, FL 33469 Legal: Tequesta in PB 25 Pgs 7 to 15 Inc. 60-42-40-26-01-000-2360 Repeat Violation of Code of Ordinances of the Village of Tequesta • Chapter 464 R-1-A Zone, Section X- L(3), Restricted Parking, Page 1185 • Special Master Hearing September 26, 2002 Page 6 The Respondents Hugh M. Evans and Thomas Raiford, were not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondents are in violation of Chapter 464 R-1-A Zone, Section X-L(3), Restricted Parking, Page 1185 of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondents Hugh M. Evans and Thomas Raiford shall comply with Chapter 464 R-1-A Zone, Section X-L(3), Restricted Parking, Page 1185 of the Code of Ordinances of the Village of Tequesta. Respondents shall keep gate closed at all times when enclosing vehicle. Should respondents repeat this violation, a fine of seventy-five dollars ($75.00) per day shall be assessed until there is compliance. • Case No. 02-75116 Danny J. Mingle 305 Country Club Drive Tequesta, FL 33469 Legal: Tequesta in PB 25 Pgs 7 to 15 Inc. 60-42-40-26-01-000-2130 Repeat Violation of Code of Ordinances of the Village of Tequesta Chapter 464 R-1-A Zone, Section X- L(3~, Restricted Parking, Page 1185 The Respondent, Danny J. Mingle, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Chapter 464 R-1-A Zone, Section X-L(3), Restricted Parking, Page 1185 of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondent Danny J. Mingle shall • comply with Chapter 464 R-1-A Zone, Section X-L(3), Restricted Parking, Page 1185 of the Code of Ordinances of the Village of Tequesta. • Special Master Hearing September 26, 2002 Page 7 Respondent shall keep gate closed at all times when enclosing vehicle. Should respondents repeat this violation, a fine of seventy-five dollars ($75.00) per day shall be assessed until there is full compliance. Case No. 02-75094 Peter M. Buchanan 8z Chris Panebianco 40 Pine Tree Place Tequesta, FL 33469 Legal: Tequesta in PB 25 Pgs 7 to 15 Inc. 602-40-26-01-000-5840 Repeat Violation of Code of Ordinances of the Village of Tequesta Chapter 464 R-1-A Zone, Section X- L(3), Restricted Parking, Page 1185 The Respondents Peter M. Buchanan 8~ Chris Panebianco were not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondents are in violation of Chapter 464 R-1-A Zone, Section X-L(3), of the Code of Ordinances of the Village of Tequesta. Young and Kirk Bielski, were present at the hearing. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondents are in violation of Chapter 355, Appendix A, Recreation/Commercial Section X-L (2) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Ronald M. Young and Kirk Bielski, shall comply with Chapter 355, Appendix A, Recreation/ Commercial Section X-L (2) Page 1184 of the Code of Ordinances of the Village of Tequesta by the 28th day of September, 2002. If Respondents do not comply within the time specified, a fine of Seventy Five Dollars ($75.00) per day shall be assessed for each day the violation continues to exist. Case No. 02-75118 Silvestre Mendoza 360 Evergreen Avenue Tequesta, FL 33469 Legal: Jupiter in the Pines Sec B Lot 1 Block 23 60-42-40-25-06-023-0010 Violation of Code of Ordinances of the Village of Tequesta Chapter 355, Appendix A, Recreation/Commercial Section X-L (2) Page 1184 The Respondent, Silvestre Mendoza, was not present at the hearing. The Tequesta Code Enforcement Officer testified to the violation. • Special Master Hearing September 26, 2002 Page 9 Conclusion of law was that Respondent is in violation of Chapter 355, Appendix A, Recreation/Commercial Section X-L (2) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Silvestre Mendoza, shall comply with Chapter 355, Appendix A, Recreation/ Commercial Section X-L (2) of the Code of Ordinances of the Village of Tequesta by the 28t" day of September, 2002. If Respondent does not comply within the time specified, a fine of Seventy Five Dollars ($75.00) per day shall be assessed for each day the violation continues to exist. Case No. 02-75092 Edwin C. Wattles 284 River Drive Tequesta, FL 33469 Violation of Code of Ordinances of the Village of Tequesta Chapter 464 R-1-A Zone, Section X-L(3), • Restricted Parking, Page 1185 The Respondent, Edwin C. Wattles, was not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Chapter 464 R-1-A Zone, Section X-L(3), of the Code of Ordinances of the Village of Tequesta. Special Master Torcivia ordered that Respondent Edwin C. Wattles shall comply with Chapter 464, R-1-A Zone, Section X-L(3) of the Code of Ordinances of the Village of Tequesta by the 28'" day of September, 2002. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. D. Status Hearings: None E.
