PRESENT: Special Master Paulette Torcivia; Code Enforcement Officer Sy Steinsaltz;

• The hearing was called to order at 10:05 A.M.
A. Code Enforcement Special Master Torcivia approved the minutes of the
November 29, 2001 hearing as submitted.

The Respondent, Raymond Cooper, was not present at the hearing; however
Timothy Rhoten, Mr. Cooper's tenant, was present. The Special Master found
that the owner of the property was not given proper notice. The Tequesta
Code Enforcement Officer testified to the violation.
Special Master Paulette Torcivia ordered that this case shall be dismissed.
The Village may re-file this case should Mr. Rhoten illegally park his truck
again.

The Respondent, Gordon Rypma was present at the hearing and testified he
was not the owner of the property. The Tequesta Code Enforcement Officer
testified to the violation. The Special Master found that the owner of the
property was not given proper notice.

Special Master Paulette Torcivia ordered that if home construction on the
property has not commenced by the 24th day of April, 2002, Respondent
Robert J. Kraft shall attend a status hearing on the 25th day of April, 2002 at
10:00 a.m. at the Wachovia Bank Building, 250 Tequesta Drive, Suite 300,
Tequesta, Florida.

(a)(b), noise violation, page 713.
The Respondent, David A. Kyle I I, was not present at the hearing, however,
there was a finding of proper notice. The Tequesta Code Enforcement Officer
testified to the violation and introduced the police reports into evidence.
Conclusion of law was that Respondent is in violation of Chapter 12-1
Prohibited Paragraph (a)(b), noise violation, of the Code of Ordinances of the
Village of Tequesta.
Special Master Paulette Torcivia ordered that Respondent, David A. Kyle II,
shall comply with Chapter 12-1 Prohibited Paragraph (a)(b), noise violation, of
the Code of Ordinances of the Village of Tequesta., of the Code of
Ordinances of the Village of Tequesta by the 25th day of January, 2002.
If respondent does not comply within the time specified, a fine of one hundred
dollars ($100.00) per day shall be assessed for each day the violation
continues to exist. A copy of this Order may be recorded in the Public
Records of Palm Beach County, Florida, and once recorded shall constitute a
lien against the property of the original amount upon which the violation
existed and upon any other real or personal property Owned by the
respondent, pursuant to Chapter 162, Florida Statutes, for the original amount.

The Respondent, Jack Pardue, was not present at the hearing. The Tequ
Code Enforcement Officer testified that he had informed the respondent h
would request dismissal of the case.
