A. Code Enforcement Special Master Torcivia approved the minutes of the November 29, 2001 hearing as submitted. B. Fine Imposition Hearings: None C. Violation Hearings: Case No. 0201-06P Raymond E. Cooper 261 Golf View Drive Tequesta, Florida 33469 Legal: Tequesta in the Pines 60-42-40-26-01-000-3781 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several or to all • Districts (L) Commercial Vehicles and Trucks, Page No. 1185 Recycled Paper • The Respondent, Raymond Cooper, was not present at the hearing; however Timothy Rhoten, Mr. Cooper's tenant, was present. The Special Master found that the owner of the property was not given proper notice. The Tequesta Code Enforcement Officer testified to the violation. Special Master Paulette Torcivia ordered that this case shall be dismissed. The Village may re-file this case should Mr. Rhoten illegally park his truck again. Legal: Coconut Lane Lot 12 60-43-40-30-40-000-0120 The Respondent, Gordon Rypma was present at the hearing and testified he was not the owner of the property. The Tequesta Code Enforcement Officer testified to the violation. The Special Master found that the owner of the property was not given proper notice. Kraft (owner) 48 Coconut Lane Tequesta, Florida 33469 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Appendix A-Zoning, Section X, Appendix A - (K)1(a)(b)(c), Trailers or Temporary Structures or Vehicles, Page 1183 Special Master Paulette Torcivia ordered that if home construction on the property has not commenced by the 24th day of April, 2002, Respondent Robert J. Kraft shall attend a status hearing on the 25th day of April, 2002 at 10:00 a.m. at the Wachovia Bank Building, 250 Tequesta Drive, Suite 300, Tequesta, Florida. Case No. 01-11-018P David A. Kyle II 229 Golf Club Circle Tequesta, Florida 33469 Special Master Hearing January 24, 2002 Page 3 Legal: Plat of Tequesta 60-42-40-26-01-000-0850 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Chapter 12-1 Prohibited Paragraph (a)(b), noise violation, page 713. The Respondent, David A. Kyle I I, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation and introduced the police reports into evidence. Conclusion of law was that Respondent is in violation of Chapter 12-1 Prohibited Paragraph (a)(b), noise violation, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, David A. Kyle II, shall comply with Chapter 12-1 Prohibited Paragraph (a)(b), noise violation, of the Code of Ordinances of the Village of Tequesta., of the Code of Ordinances of the Village of Tequesta by the 25th day of January, 2002. If respondent does not comply within the time specified, a fine of one hundred dollars ($100.00) per day shall be assessed for each day the violation continues to exist. A copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property Owned by the respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. Case No. 02-01-02P Jack Pardue 117 Fairview East Tequesta, Florida 33469 Legal: Tequesta in the Pines 60-42-40-26-01-000-5400 Nature of Violation: • Violation of Code of Ordinances of the Village of Tequesta, Florida, Special Master Hearing January 24, 2002 Page 4 Section 12-1 (b) Loud and Unnecessary Noise by Animals The Respondent, Jack Pardue, was not present at the hearing. The Tequ Code Enforcement Officer testified that he had informed the respondent h would request dismissal of the case. Special Master Paulette Torcivia ordered that this case shall be dismissed D.
