Approval of Minutes Special Master Donlon approved the minutes of the September 22, 2005, Special Master Hearing as submitted. B. Fine Imposition Hearing -None C. Violation Hearing Case No. 05-27882 Daniel Robillard 140 Country Club Drive, Tequesta, Florida 33469 Legal: COUNTRY CLUB POINT LT 1 BLOCK 5 PCN: 60-42-40-25-12-005-0010 Violation of Code of Ordinance Chapter 10 Article I sec. 8 Page CD 10:4 Animals Creating Nuisance The Respondent, Daniel Robillard was not present at the hearing. This case was continued to the December Meeting to allow for proper notice of hearing. Case No. OS-30717 Almont Villas LLC 405 N Cypress Drive, Tequesta, FL 33469 Legal: ALMONT VILLAS COND UNIT 1 PCN: 60-43-40-30-23-000-0010 Violation of Code of Ordinance Chapter 30 Article II sec 33 Page CD 30:5 Prohibited Conditions Violation of Code of Ordinance Chapter 30 Article VII sec. 233 Page CD 12:13 Dumpster Required The Respondent, Almont Villas LLC was not present at this hearing. Mr. David Cooper mentioned the case has been removed from the agenda due to voluntary compliance. 1 D. Status Hearings • Case No. OS-20123 John Rich 282 Golfview Drive, Tequesta, FL 33469 Legal: TEQUESTA LT 276 PCN: 60-42-40-26-01-000-2760 Violation of Code of Ordinance International Property Maintenance Code Sec. 303.2 Page 9 Exterior Structure Violation of Code of Ordinance Chapter 30 Article II sec. 30-33 Page CD 30:5 Prohibited Conditions The Respondent, John Rich, was represented at the hearing by his partner, Marlyce Pederson, and there was a finding of proper notice. Conclusion of Law is that Respondent, John Rich, is in violation of Chapter 30 Article II sec. 30- 33, Page CD 30:5, of the Code of Ordinances of the Village of Tequesta. The Respondent's partner, Marlyce Pederson, testified at the hearing on behalf of the property owner. Mr. Rod Taylor, of T-Systems, Inc., also testified. • The Tequesta Code Enforcement Officer testified and produced photographs of the on-going violation. The parties requested that this case be set for a Status and Fine Assessment hearing in January 2006. A Fine Assessment Hearing will be held before the Special Master on the 26th day of January, 2006, at 10:00 a.m., at the Village of Tequesta, Code Compliance Division, 399 Seabrook Road, Tequesta, Florida. A Certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount.
