A RESOLUTION OF THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH
COUNTY, FLORIDA, VACATING AND
ABANDONING A FIVE FOOT WIDE UTILITY
EASEMENT LOCATED ON THE NORTHEASTERLY
PORTION OF PROPERTY COMMONLY KNOWN AS
110 RIVER DRIVE, IN THE VILLAGE OF
TEQUESTA.

WHEREAS, a petition has been made to abandon
a utility easement, five feet in width, located
on the northeasterly portion of property commonly
known as 110 River Drive in the Village of
Tequesta, as set forth in the Plat and restated
in the Declaration of Covenants and Restrictions
affecting the property, recorded in Official
Record Book 3761, Page 1562, public records of
Palm Beach County; and
WHEREAS, all utilities using said easement
have agreed to the abandonment; and
WHEREAS, the Village Council of the Village of
Tequesta does hereby find and determine that the
necessity for the five foot wide utility easement
located on the following described property is no
longer necessary and does not serve any public
purpose, nor is it necessary for public use.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL.
OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AS FOLLOWS:
Section 1. That certain five foot wide utility
easement located on northeasterly portion of property
commonly known as 110 River Drive, Tequesta, Florida,
more particularly described as follows, to-wit:
Lot 427, Tequesta, according to the Plat thereof
as recorded in Plat Book 25, Page 7, public
records of Palm Beach County, Florida
•
Be and the same is hereby vacated and abandoned.
•
Section 2. The Village Clerk is hereby authorized
to record this Resolution pursuant to law.
Section 3. This Resolution shall become effective
immediately upon passage.
THE FOREGOING RESOLUTION WAS OFFERED BY Councilmember

motion was seconded by Councilmember

vote, the vote was as follows:
