RESOLUTION NO. 39-00/O1
A RESOLUTION OF THE VILLAGE OF TEQUESTA
CERTIFYING THAT THE LIGHTHOUSE HABITAT
FOR HUMANITY PROGRAM OPERATING IN THE
VILLAGE OF TEQUESTA IS CONSISTENT WITH
THE COMPREHENSIVE PLAN AND THE
DEVELOPMENT REGULATIONS OF THE VILLAGE,
ENABLING LIGHTHOUSE HABITAT FOR
HUMANITY TO PARTICIPATE IN THE STATE OF
FLORIDA'S COMMUNITY IMPROVEMENT ACT OF
1980; PROVIDING AN EFFECTIVE DATE.

WHEREAS, it is necessary and in the public
interest that the Village of Tequesta certify
that the Lighthouse Habitat for Humanity program
is consistent with local plans and regulations in
order to comply with the provisions of the
Community Improvement Act of 1980; and
WHEREAS, the Lighthouse Habitat for Humanity
program is a specific program designed to offer
home ownership to low income residents in an
effort to stem decline in eligible areas and
should receive full endorsement and support from
the Village of Tequesta; and
WHEREAS, the Community Improvement Act of
1980 requires that a resolution be passed by the
local government certifying that a project
applying for approval from the State of Florida
under the Act is consistent with local plans and
regulations.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN
COUNCIL OF THE VILLAGE OF TEQUESTA AS FOLLOWS:
Section 1. That the Lighthouse Habitat for
Humanity program complies with all local plans
and regulations for the improvement of income
eligible areas. This Resolution shall be

forwarded to the State of Florida, Department of
Community Affairs, to enable Lighthouse Habitat
for Humanity to participate in the State of
Florida's Community Improvement Act of 1980.

Councilmember Dalack, who moved its adoption.
The motion was seconded by Councilmember
von Frank and upon being put to a vote, the
vote was as follows:

The Mayor thereupon declared the Resolution duly

Subject: Resolution No. 38-00/Ol - Water service Agreement Between D. V.B.
Development Corporation and Village of Tequesta; Agenda Item
The Water Service Agreement is a standard contractual agreement between the Developer and the
Village for water provision. It states the terms and conditions for provision of said service,
requiring, among other things, that the Developer provide for all of the necessary appurtenances
on their property for water service, all necessary utility easements needed to accommodate said
service request and, in return for payment of required capital connection charges, that the Village
will reserve the requested capacity for the Developer. Once approved, the Water Service
Agreement will be recorded in the public records of Martin County, Florida.
It is recommended that the Village Council approve Resolution No. 38-00/O1 authorizing the
Village Manager to execute the above referenced Water Service Agreement on behalf of the
Village.
