RESOLUTION NO. 26-00
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE
OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AWARDING A
BID TO WILLIAM H. MURPHY, GENERAL CONTRACTOR, INC.,
OF HOBE SOUND, FLORIDA, FOR RENOVATION OF TEMPORARY
OFFICE SPACE AT COUNTY LINE PLAZA (POLICE AND FIRE-
RESCUE ADMINISTRATIVE OFFICES) IN THE AMOUNT OF
$64,736 WITH FUNDS BEING APPROPRIATED AND
TRANSFERRED FROM THE $5,000,000 LINE OF CREDIT
(BANK OF AMERICA), AND AUTHORIZING THE VILLAGE
MANAGER TO EXECUTE THE APPLICABLE CONTRACT ON
BEHALF OF THE VILLAGE.

WHEREAS, The Village of Tequesta, Florida, has identified the
need for a new Public Safety Complex for the Police and Fire
Rescue Departments; and,
WHEREAS, the Police department and Fire Rescue administration,
along with some support functions must be relocated to
temporary locations during the construction of the new Public
Safety Complex; and
WHEREAS, the Village of Tequesta, has secured space and
executed the necessary leases at County Line Plaza to
effectuate the temporary relocation of these services; and
WHEREAS, the Police Chief and Fire Chief deem it necessary to
modify the existing spaces for appropriate working environment
and to conduct the business of the Police and Fire Rescue
Departments,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Awarding the building renovation RFP #Ol-Ol to
William H. Murphy General Contractor, Inc., of Hobe Sound,
Florida, in the amount of $64,736.00, for modifications to the
two least spaces at County line Plaza for temporary relocation
of the Police Department and Fire Rescue administrative
offices, along with other necessary support functions,
attached hereto marked as Exhibit "A" and incorporated by
reference as part of this resolution is hereby approved and
the Village Manager if the Village of Tequesta is authorized
•
to execute the necessary documents to execute the same on
behalf of the Village.

• This Request for Proposals (RFP) provides guidelines for proposal submissions, along
with general specifications and requirements thereof, hereinafter referred to as
"Renovations". Submissions of proposals shall be made to the Village of Tequesta, for
complete renovation of two spaces at County Line Plaza for the Village's Police
Department and Fire Rescue Administrative offices.
INSTRUCTIONS TO BIDDERS:
Sealed bids must be received on or before 2:00 p.m. (local time), Wednesday, February
21, 2001, at the Fire Rescue Administrative Offices, 357 Tequesta Drive, Tequesta,
Florida 33469. Normal business hours are 8:30 a.m. to 5:00 p.m., Monday through
Friday, except holidays. All bids will be publicly opened and read at 2:05 p.m. on
February 21, 2001, in the Fire Rescue administrative conference room at the above
address. It is anticipated that the bid will be awarded at the Special Village Council on
February 27, 2001.
Bids received after the designated time will NOT be considered. Bids may be delivered
in person or by mail. All bids must be submitted in sealed envelopes, clearly marked as
follows:

Envelopes received that do not have the above information clearly marked on the
outside of the envelope SHALL BE REJECTED.
A bidder may withdraw his bid at any time prior to that fixed for opening bids without
prejudice to himself.
Bidders are invited to be present at the bid opening. Bids received after the set time
frame for the opening will be returned to the bidder unopened.
The Village reserves the right to reject any or all bids, in whole or in part, with or without
cause, to waive any informalities or technicalities, and to make awards either as
individual items or as a total combined bids, whichever it considers to be in the best
interest of the Village of Tequesta.
No bidder may withdraw his bid for a period of sixty (60) days after the date set for the
opening thereof.
Bids received on separate sheets and not attached to the complete specifications will
be considered informal and may be rejected as such. All prices must be clearly stated
in figures with ink on the line provided. Any variations from these specifications must
• be clearly stated by the bidder on the proposal blank.

• Bids must be signed in ink, by the bidder with the signature in full. When a firm is a
bidder, the agent who signs the firm name to the proposal shall state, in addition, the
names and addresses of the individuals composing the firm. The signature shall be in
the following form:

When a corporation is a bidder, the person signing shall state under the laws of what
state the corporation was chartered, and the name and title of the officer having
authority under the by-laws to sign contracts. Anyone signing the proposal as agent,
must file with it legal evidence of his authority to do so. Post office address, county and
state, must be given after the signature.
Bidders are cautioned to fill in all information as requested on the proposal form to
serve as a basis for making awards.
All state and federal tax exemptions applicable to municipal corporations will apply and
appropriate certification shall be furnished.
A bidder is expected to fully inform himself as to the requirements of the specifications;
failure to do so will be at his own risk. A bidder shall not expect to seek relief on the
• plea of error.
Any deviation from the specifications must be explained in detail on a separate sheet
attached to the Bid Form.

GENERAL TERMS AND CONDITIONS
GENERAL INFORMATION
These documents constitute the complete set of specification requirements and bid
forms. IT IS THE RESPONSIBILITY OF THE BIDDER TO ENSURE THAT ALL
PAGES ARE INCLUDED. Therefore, all bidders are advised to closely examine this
package. Any questions regarding the completeness of this package shall be
immediately directed to James M. Weinand, Fire Chief, at P.O. Box 3273, Tequesta,
Florida 33469-0273. ALL BIDS MUST BE SUBMITTED ON THE PROVIDED "BID
FORM". BID PROPOSALS ON VENDOR LETTERHEAD/QUOTATION BID FORMS
WILL NOT BE ACCEPTED.
All bids must be typewritten or handwritten in ink and must be signed by an officer or
employee having authority to bind the company or firm. Signatures are required where
indicated. Failure to do so may be cause for rejection of bid.
Bidders shall not be allowed to modify their bids after the opening time and date. Bid
files may be examined during normal working hours, after bid opening, by appointment
only.
• Each bid must be delivered to the De artment Head on or before these

The bid time must be and shall be strictly observed. Under no circumstance shall a bid
delivered after the time specified be considered. Such bids shall be returned to the
vendor unopened. ft is the sole responsibility of the bidder to ensure that his or her bid
reaches the Department Head on or before the closing date and time. The Village shall
in no way be responsible for delays caused by any occurrence. Offers by telephone,
telegram or facsimile shall not be accepted.

ACCEPTANCE<REJECTION
The Village reserves the right to reject any or all bids, in whole or in part, with or without
• cause, to waive any informalities or technicalities, and to make awards either as

individuals items or as a total combined bid, whichever it considers to be in the best
interest of the Village of Tequesta.
CONFLICT OF INTEREST
The award hereunder is subject to the provision of State Statues, Village Ordinances
and Administrative Policies. All bidders must disclose in his or her bid the name of any
officer, director or agent who is also an employee of the Village. Further, all bidders
must disclose the name of the Village employee who owns, directly or indirectly, interest
of ten percent (10%) or more of the proposer firm or any of its subsidiaries.
LEGAL REQUIREMENTS
Federal, state, county and local laws, ordinances, rules and regulations that in any
manner affect the items covered herein apply. Lack of knowledge by the bidder will in
no way be a cause for relief from responsibility.
1. Vendors doing business with the Village are prohibited from discriminating
against any employee, applicant for employment or client because of race,
creed, color, ancestry, religion, national origin, sex, or age with regard to, but not
limited, to the following: Employment practices, rates of pay or other
compensation methods and training selection.
2. A person or affiliate who had been placed on the convicted vendor list following a
conviction for a public entity crime may not submit a bid contract to provide any
goods or services to a public entity for the construction or repair of a public
building or public work, may not submit bids on leases of real property to a public
entity, may not be awarded or perform work as a contractor, supplier,
subcontractor, or consultant under a contract with any public entity, and may not
transact business with any public entity in excess of the threshold amount
provided in Section 287.017, for CATEGORY TWO for a period of 36 months
form the date of being placed on the convicted vendor list.
3. The obligations of the Village under this award are subject to the availability of
funds lawfully appropriated for this purpose.
4. This request for bid shall be included and incorporated into the final award.
BIDDER'S RESPONSIBILITY
Each proposer is required, before submitting his or her proposal, to carefully examine
the bid specifications and to completely familiarize himself or herself with all of the
terms and conditions that are contained within this document. Ignorance on the part of
the bidder will in no way relieve him or her of any of the obligations and responsibilities,
which are a part of this bid.
CONTRACTUAL AGREEMENT
• This Invitation to Bid shall be included and incorporated in the final award. The order of
contractual precedence will be the purchase order, bid document and response. Any
and all legal action necessary to enforce the award will have venue in Palm Beach

• County and the contractual obligations will be interpreted according to the laws of
Florida. Any contract or agreement required by vendor must be enclosed at the time of
bid submittal.
PUBLIC RECORDS LAW
In conformance with the Florida Public Records law, all proposal documents or other
material submitted by the bidder in response to this request other than any financial
statements submitted, shall upon bid opening, be available for public inspection by any
person.
CODE OF ETHICS
If any bidder violates the Code of Ethics of the State of Florida with respect to this bid,
such bidder may be disqualified from performing this work and future work for the
Village.

INTENT OF SPECIFICATIONS:
It is the intent of these specifications to describe the required construction renovation of
two spaces at County Line Plaza for the Village of Tequesta's Police Department and
Fire Rescue Administrative offices. Bidders shall submit a complete turnkey renovation
package, which when completed is ready for occupancy.
With a view to obtaining the best results and the most acceptable renovation package
for the Village of Tequesta, these specifications cover only general requirements as to
the type of features, options, construction, and certain details as to the renovations
must conform to. Minor details of construction and types of materials not otherwise
specified are left to the discretion of the contractor, who shall be solely responsible for
the design, construction and appearance of the renovated spaces.
GENERAL REQUIREMENTS:
This is an engineer, design, construct, deliver type specification and it is not the
intention of this Department to write out any bidder of similar or equal construction
methods than the type specified. It should be noted, however, that these specifications
are written to describe the renovation of these spaces for the Village of Tequesta, and
around specific needs of these departments.
Because of this fact, price may not be the sole consideration in awarding the RFP.
RFP award shall be given to the vendor whose proposal comes closest to meeting
these specifications, or to the bidder who shows proof to this agency that their
exceptions are deemed equal to or superior to these specifications, at the most
competitive price. This agency will solely determine which products are equal to or
superior to the specifications. Any vendor taking exception to any part of this
renovation package and specifications must clearly state (in writing) the section or items
that they are taking exception to. Any vendor making measureless statements such as
"total exception" to the specification will result in immediate rejection of RFP.
Each bidder is required, before submitting their proposal, to be thoroughly familiar with
the specifications contained herein and the site(s) upon which the renovations are to
take place. No additional allowances will be made because of lack of knowledge of
these conditions. It is the responsibility of the successful bidder to ascertain if any
components of this specification are unsafe or do not meet the required standards of
applicable State law or those of Federal.
Completion date: Since delivery proposals by the vendor will weigh heavily in the
determination of award of RFP, the delivery schedules that are submitted by the Vendor
and agreed upon by the purchaser shall automatically become binding upon the
successful vendor. The delivery date specified by the vendor must be actual, and may
be the determining factor in awarding this contract.

• Failure to complete the renovation project upon the terms agreed upon by both parties,
may be consideration by the purchaser as a breach of contract, in which case the work
may be rejected, and the purchaser has the right to withhold payment for charges until
the terms of these specifications are fulfilled.

Clarifications or corrections to these specifications shall not be valid unless they are in
written form and signed by the Administrator of this Department or his assigned
authority.
When a bidder requests a clarification, a copy of the request and this Department's
reply will be forwarded to all bidders.

SCOPE OF WORK
Bidders are to completely renovate the two spaces at County Line Plaza for the Village
of Tequesta for its Police Department, Dispatch and Fire Rescue Administration
employees.
1. Bidders shall include any and all demolishing in their proposals.
2. Both spaces are to have all the existing walls repaired and patched as
needed.
3. Both spaces shall have any and all damaged or stained ceiling tiles
replaced as needed.
4. Bidders shall construct interior walls as noted on plans with 3-5/8" 25 gage
metal studs 16 inches on center.
5. Bidders shall install electrical outlets, fixtures and switches as noted on
plans, along with any and all code requirements, if not shown on
drawings.
6. Bidders shall install phone, cable and computer data lines as denoted on
plans. All phone, cable and computer data lines shall be complete with
proper fixtures. Computer data cables shall be Category V, with RJ
connectors.
7. Price shall include modifications to the air conditioning ventilation system
as shown on plans, and or as required to have swell-balanced ventilation
system.
8. New office walls to be insulated for sound control. Walls in the dispatch
office area shall have 3" sound attn. blankets, for higher sound quality and
control.
9. All new walls shall have %2' gypsum wallboard from to ceiling line. Ceiling
line to be finished with J bead, or other acceptable method. All existing
walls shall have all holes patched and or wall board added in locations
missing such.
10. All wallboard joints shall be finished and walls shall be free from
imperfections.
11. Gypsum wallboard shall have at least one coat of primer sealer rolled on
before final paint. Final paint shall include the entire space(s) and shall
be painted with proper paining techniques and Benjamin Moore materials.
12. Price to include the purchase and installation of doors. Office doors shall
be hollow-core paint grade.
13. All offices to be trimmed with clamshell baseboard and door trim.
14. Trim to be properly prepared, primed and final paint to semi-gloss paint.
15. Price to include modification to the fire protection sprinkler system as
noted on plans and as required by code.
16. Existing the floor in the police department space shall be cleaned and
repaired as needed.
17. Existing carpet in the fire rescue space shall be removed and a mid grade
commercial carpet shall be installed, specify allowance.

• 18. Price shall include the necessary documents for permit and all permitting
costs.
19. Price shall include a final cleaning of entire space and windows.
20. The Police Department will operate and be equipped with a standby
generator and automatic transfer switch (by others), but the contractor
shall make the necessary improvements to the electrical system to accept
this emergency standby power system.
