A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, DETERMINING THAT THE SALE OF THAT
PORTION OF THE WATER UTILITY SYSTEM USED TO
SERVICE NORTH JUPITER CUSTOMERS iS IN THE
PUBLIC INTEREST; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Village of Tequesta owns and operates a water utility; and
WHEREAS, the Town of Jupiter previously adopted Ordinance No. 11-73,
granting the Village of Tequesta a thirty year water service franchise within the Town
of Jupiter; and
WHEREAS, the governing bodies of the Village of Tequesta and the Town of
Jupiter have entered into an Interlocal Agreement, dated December 23, 2002,
providing for the terms pursuant to which the Village of Tequesta's water service
franchise within the Town of Jupiter will be terminated; and
WHEREAS, pursuant to Florida Statute 180.301, a municipality selling a water
utility shall hold a public hearing in regard to such sale and make a determination that
the sale is in the public interest; and
WHEREAS, in accordance with Florida Statute 180.301, the Village of
Tequesta's utility staff and consultants have prepared a statement showing the
Village's sale of the assets of that portion of its water system used to service North
Jupiter customers is in the public interest; and
WHEREAS, the Village Council of the Village of Tequesta has reviewed and
considered the statement prepared by the Village's utility staff and consultants
regarding whether the proposed sale by the Village of the assets of that portion of its
water system used to service North Jupiter customers during the term of the
franchise is in the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, as follows:
Section 1. The Village Council hereby determines that the sale of that
portion of the water utility assets of the Village used to service North Jupiter
customers during the term of the franchise, as provided in the Interlocal Agreement
between the Village of Tequesta and Town of Jupiter, dated .December 23, 2002, is
in the public interest.
