SITE PLAN EXTENSION CASE NO.: SPX-1-09 IN RE: Regions Bank Applicant, Michael Boo, on behalf of owners, Regions Bank PROPERTY LOCATION: 691 US Highway One North Tequesta, Florida 33469 LEGAL DESCRIPTION: PARCEL 1: REGIONS TEQUESTA PAR 1 PARCEL CONTROL NUMBER: 60-43-40-30-58-001-0000 PARCEL 2: REGIONS TEQUESTA PAR 2 PARCEL CONTROL NUMBER: 60-43-40-30-58-002-0000 PARCEL 3: REGIONS TEQUESTA PAR 3 PARCEL CONTROL NUMBER: 60-43-40-30-58-003-0000 PARCEL 4: REGIONS TEQUESTA PAR 4 PARCEL CONTROL NUMBER: 60-43-40-30-58-004-0000 Aggregate 1.05 acres f ORDER DENYING APPLICATION This cause came on to be heard upon the above application and the Tequesta Village Council having considered the evidence presented by the applicants and other interested persons at a hearing called and properly noticed, and the Tequesta Village Council, being otherwise duly advised, THEREUPON, THE TEQUESTA VILLAGE COUNCIL FINDS AS FOLLOWS: 1. The subject property is located in the C-2 Zoning District in the Village of Tequesta. 2. The applicant has submitted all documents required by the Village's Code of Ordinances. 3. The application and all supporting documentation and presentation materials as reviewed by the Village Council at its February 12, 2009 meeting and continued to its Page 1 March 12, 2009 meeting, and as kept on file by the Village, are made a part hereof and are hereby incorporated by reference. 4. According to Section 78-334(h), site plan approval remains valid for one (1) year from the date of issuance unless a building permit is issued within that year and the project is continuing in good faith. 5. The applicants applied for a one (1) year extension of their site plan approval on January 5, 2009 which was prior to the expiration date of January 9, 2009. 6. Under the provisions of the Village Code of Ordinances, the Village Council has the right, power and authority to act upon the request herein made since the request was made prior to the expiration date. IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: The application for Site Plan Extension, Case No. 1-09 with reference to the above described property within the Village of Tequesta, Palm Beach County, Florida, to permit the following: Extension of the existing site plan for one (1) additional year to expire on January 9, 2010 for property located at 691 US Highway One North, Tequesta, Florida 33469 is hereby DENIED since the applicants failed to appear at the meeting to present evidence as to how they meet the requirements set forth in Section 78-334(h) of the Tequesta Zoning Code for site plan extension. The term applicant(s) as used herein shall include all successors and assigns. The applicant's site plan approval has expired as of January 9, 2009.
