I looked at it and it is obvious that some type of sewage is running onto the ground and appears to be from the rear building on the property. The homeowner at 19 Shay advised that you have his permission to go onto his property to evaluate the complaint. FYI it is easily observable from the Northwest corner of his property at the fence line. Thanks! Address: 479 Seabrook Road Tequesta, Florida 33469 Legal Description: 25-40-42, N 130 FT OF W 635 FTOF NE 1/4 OF SE 1/4 (LESS N 117 FT OF E 25 FT OF W S55 FT 8t ELY 46.04 FT R/W SEABOOK PCN: 60-42-40-25-00-000-5320 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Special Magistrate Hearing held on the 26m day of February, 2009 and based on the evidence and testimony presented, the following Findings of Fact, Conclusions of Law and Order are hereby entered: FINDINGS OF FACT 1. The Respondent(s) is/are the owner(s) for the above-described property. 2. The Respondent(s) was not present at the hearing, however; there was a finding of proper notice. 3. The Tequesta Code Enforcement Officer testified to and produced photos of the violation. CONCLUSIONS OF LAW Page 1 of 3 The above-stated facts constitute a violation of Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta and such violation constitutes a serious threat the health, safety and welfare of the public. ORDER It is the Order of the Code Compliance Special Magistrate that Respondent(s) shall comply with Chapter 30 Article II Section 30-33 of tine Code of Ordinances of the Village of Tequesta immediately. FURTHERMORE, PURSUANT TO §§162.06(4) AND 162.09(1 F.S., THE VILLAGE OF TEQUESTA IS HEREBY AUTHORIZED TO ENTER UPON THE PROPERTY AND ABATE THE HEALTH, SAFETY AND WELFARE VIOLATIONS IF RESPONDENT HAS FAILED TO DO SO AFTER ONE WEEK FROM THE RENDERING OF THIS ORDER SUCH AUTHORIZATION DOES NOT CREATE A CONTINUING OBLIGATION ON THE PART OF THE VILLAGE TO MAKE FURTHER REPAIRS OR TO MAINTAIN THE PROPERTY. A fine assessment hearing is hereby scheduled for March 26, 2009 at 10:00 am at the Village Hall Council Chambers, 345 Tequesta Drive, Tequesta, Florida. 33469. Should you violate the same Section of the Code again, you may be subject to a fine of up to five hundred dollars ($500.00) per day for such repeat violation. Additionally, the Code Officer is not required to give a reasonable time to correct the repeat violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. Respondent(s) shall be assessed $480.06 for administrative costs to be paid immediately. Additionally, any costs incurred by the Village to abate the health., safety~and welfare violation shall be assessed against Respondent. Additionally, a fine in an amount not to excel $250.00 per day maybe imposed against Respondent if Respondent fails to comply with this Order. Upon complying in any code compliance matter, it is always the responsibility of the Respondent(s) to contact the Code Compliance Division at (561) 575-3826 to request a reinspection of the property.
