HomeMy WebLinkAboutResolution_37-01/02_04/11/2002• RESOLUTION NO. 37 - Ol/02 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, COMMITTING ITS PORTION OF FUNDS ALLOCATED PURSUANT TO RESOLUTION R-2002-0192 ADOPTED BY THE PALM BEACH COUNTY BOARD OF COUNTY COMMISSIONERS ON FEBRUARY 5, 2002 IN ACCORDANCE WITH SECTION 318.21(10), FLORIDA STATUTES, TO THE MUNICIPAL PUBLIC SAFETY COMMUNICATIONS CONSORTIiJM COMMUNICATIONS PROJECT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSE. C7 HEREAS, Section 163.01 of the Florida Statutes, known as the Florida Interlocal operation Act of 1969, authorizes local governmental units to make the most efficient use their powers by enabling them to cooperate with other localities on a basis of mutual rantage and thereby to provide services and facilities in a manner and pursuant to forms of ~ernmental organization that will accord best with geographic, economic, population and per factors influencing the needs and development of local communities; and 3EREAS, it has been determined that the implementation of an interoperable Countywide nicipal public safety communications system will allow municipal public safety agencies improve their provision of public safety services by virtue of enhanced inter-agency nmunications and cooperation; and EAS, the Municipal Public Safety Communications Consortium (MPSCC) was through the cooperative efforts of various municipalities to plan and implement an arable County-wide municipal public safety radio communications system; and LEAS, the Village of Tequesta has joined 21 other municipalities located within Palm County to form the MPSCC and the Village of Tequesta has long been involved with to improve public safety communications; and -S, the MPSCC, through the diligent efforts of its member municipalities has a plan for a municipal county-wide interoperable communications system; and • LEAS, the MPSCC communications plan has been approved by the State of Florida of Technology as required by Florida Statute 282.111(5); and IEREAS, Section 318.21(10), Florida Statutes, permits any county which participates in intergovernmental radio communications program approved by the State of Florida -artment of Management Services to use $12.50 from each moving traffic violation fine to 3 that county's participation in the program; and U EREAS, a portion of the revenues collected are from violations which are written by icipal law enforcement officers with the municipal limits; and VHEREAS, the Board of County Commissioners allocated a portion of the revenues enerated by municipalities for their benefit under Resolution R99-2343D as amended on ebruary 5, 2002 by Resolution R-2002-0192 to encourage the interoperability of municipal ~mmunications systems and therefore enhancing the County's Intergovernmental Plan; and [EREAS, the member municipalities of the MPSCC desire to move forward with the struction of a supplement and enhancement to the County's interoperable countywide radio ~vork subject to the final approval of the capital budget provided in Section 12 of the SCC Interlocal Agreement. THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE GE OF TEQUESTA, PALM BEACH COUNTY, FLORH)A, THAT: The Village of Tequesta is a member of the Municipal Public Safety Communications Consortium (MPSCC) and supports its public safety communications plan. • Z. The Village of Tequesta supports the inclusion of the MPSCC communications plan as an enhancement and part of the State approved Palm Beach County Intergovernmental Radio Communications Program plan. The Village of Tequesta commits its full share of the $12.50 traffic fine revenues as allocated by the County through Resolution R-2002-0192 to the MPSCC for construction and implementation of its radio network for a period often years from the date of contract with the radio vendor. 4. This resolution shall become void if the Village of Tequesta should exercise its right to withdraw from the MPSCC as provided in Section 12 of the MPSCC Interlocal Agreement within the prescribed time frame following the receipt of the capital budget. The Village of Tequesta requests that the County provide its portion of the $12.50 traffic fine monies to the MPSCC for construction of the radio system following the procedures set forth in BCC Resolution R-2002-0192. • THE FOREGOING RESOLUTION WAS OFFERED BY Council Member VGA ~~-~~-- ,who moved its adoption.
