HomeMy WebLinkAboutResolution_08-01/02_11/08/2001• • • RESOLUTION NO.8-01/02 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, SUPPORTING THE PASSAGE OF LEGISLATION BY THE LEGISLATURE OF THE STATE OF FLORIDA RELATING TO TREATED WOOD; PROHIBITING USE OF WOOD PRODUCTS TREATED WITH CHROMATED COPPER ARSENATE IN PUBLICLY FUNDED PLAYGROUND EQUIPMENT; PROVIDING DEFINITIONS; PROVIDING APPLICABILITY; PROVIDING FOR ENFORCEMENT ON STATE LANDS BY THE DEPARTMENT OF ENVIRONMENTAL PROTECTION; REQUIRING THE DEPARTMENT OF EDUCATION TO PROVIDE NOTICE TO AND DEVELOP GUIDELINES FOR SCHOOL DISTRICTS REGARDING THE SEALING OF WOOD TREATED WITH CHROMATED COPPER ARSENATE; PROHIBITING STATE AGENCIES FROM PURCHASING WOOD TREATED WITH CHROMATED COPPER ARSENATE; PROVIDING EXCEPTIONS; PROVIDING FOR GRANTS FOR CONVERSION OF WOOD TREATING COMPANIES TO OPERATIONS USING PRESERVATIVES THAT DO NOT CONTAIN ARSENIC; SPECIFYING PERSONS WHO MUST PROVIDE NOTICE TO CONSUMERS OF WOOD OR WOOD PRODUCTS CONTAINING CHROMATED COPPER ARSENATE; PROVIDING CONTENTS OF SUCH NOTICE; PROVIDING A PENALTY FOR FAILURE TO PROVIDE NOTICE; PROVIDING APPROPRIATIONS; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Village Council has a responsibility to its residents to ensure as safe an environment as feasible; • • • WHEREAS, enforcement shall be provided by the Department of Environmental Protection on state lands. WHEREAS, the Department of Education shall annually notify school districts that a nontoxic sealant must be applied every two years to any such treated wood that is likely to come into contact with children. WHEREAS, the Department of Education shall develop sealant application guidelines, in consultation with the wood treating industry and the Departments of Health and environmental Protection. WHEREAS, grants to schools shall be provided to offset the cost of sealing playground equipment. WHEREAS, state agencies shall be prohibited from purchasing such treated wood for most applications and exceptions shall be specified. WHEREAS, grants shall be provided for conversion of wood treating companies using chromated copper arsenate to use of preservatives that do not contain arsenic. WHEREAS, retailers and contractors shall provide notice to certain consumers of wood or wood products containing chromated copper arsenate and refunds shall be provided when such notice is not provided. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY; FLORIDA, as follows: Section 1. The Village Council of the Village of Tequesta strongly urges the State of Florida to pass legislation prohibiting the use of any wood product containing chromated copper arsenate in the construction of any playground equipment, and for use as decorative mulch or groundcover associated with playground equipment, for which public funds are used and which are constructed or contracted for on or after October 1, 2002; Section 2. The Village Clerk is directed to transmit a copy of this resolution to Representative Larry Crow, District 4, Governor Jeb Bush, Palm Beach County Commissioners, and Palm Beach County Municipalities. • THE FOREGOING RESOLUTION was offered by Councilmember von Frank, who moved its adoption. The Resolution was seconded by Vice Mayor Capretta, and upon being put to a vote, the vote was as follows: FOR AGAINST Mayor Geraldine A. Geneo Vice Mayor Joseph N. Capretta Councilmember Sharon D.
