HomeMy WebLinkAboutResolution_52-99/00_03/09/2000• RESOLUTION NO. 52-99/00 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING A CONTRACT WITH REESE, MACON & ASSOCIATES, INC., OF LAKE WORTH, FLORIDA, FOR DESIGN AND PERMITTING TASKS Al-7, IN CONNECTION WITH COUNTRY CLUB AND BERMUDA TERRACE PHASE II WATER DISTRIBUTION/DRAINAGE SYSTEM IMPROVEMENTS IN THE AMOUNT OF $59,500, AS IT RELATES TO ENCON'S PLANNED SEWERING PROJECT OF THE TEQUESTA PENINSULA WITH FUNDS BEING APPROPRIATED FROM THE WATER ENTERPRISE FUND UNDESIGNATED RESERVES IN THE AMOUNT OF $30,525, AND THE STORMWATER ENTERPRISE FUND UNDESIGNATED RESERVES IN THE AMOUNT OF $28,975, AND AUTHORIZING THE VILLAGE MANAGER TO EXECUTE THE APPLICABLE CONTRACT ON BEHALF OF THE VILLAGE. • • NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Engineering Services in connection with Design and Permitting Tasks Al-7 of the Country Club and Bermuda Terrace Phase II, Water Distribution/Drainage System Improvements with Reese, Macon & Associates, Inc. of Lake worth, Florida, attached hereto as Exhibit "A" and incorporated by reference as a part of this Resolution is hereby approved and the Village Manager of the Village of Tequesta is authorized to execute the same on behalf of the Village of Tequesta. Box 3273 Tequesta, FL 33469-0474: Attn: Josef Grusauskas, Utilities Director RE: Water Distribution/Drainage System Improvements Tequesta Country Club (Phase II) Dear Mr.Grusauskas, Exhibit "A" February 24, 2000 We are pleased to submit this proposal for engineering services in connection with design, permitting, bidding and construction services for the above referenced project. REESE, MACON and ASSOCIATES, INC., hereinafter referred to as the Engineer, shall perform the services as documented below for The Village of Tequesta, hereinafter referred to as the Village. SCOPE The Engineer understands this authorization is to cover engineering services related to the design, • permitting, bidding and construction services for the water main replacement and associated drainage system improvements within the Tequesta Country Club (Phase II) subdivision. This proposal anticipates one bid package will be assembled to include water and drainage improvements within areas of the Country Club. The Engineer understands that some community involvement may be required, such as attendance at homeowner's meetings or special council meetings to outline the scope of construction. A scope item has been included for this service, which includes one (1) meeting with the homeowner's association and one (1) meeting with the Village Council. The following specific tasks will be performed by the Engineer: A. DESIGN SERVICES 1. Prepare design plans and specifications for the water main and drainage system improvements within Phase II of the Country Club. The improvements will consist of replacing the existing asbestos cement (AC) pipe with either PVC/DIP/FIDPE. All new services up to the existing meter box, hydrants, and valves are also included. The existing AC pipe will be abandoned in place and filled with grout/flowable fill. 2. Attend two (2) meetings with ENCON and the Village to coordinate the design aspects as . they relate to the proposed sewer project in Phase II of the Country Club. 3. Prepare and submit, where applicable, permit applications with support documentation to the following agencies: Village of Tequesta Palm Beach County Health Department Florida Department of Environmental Protection Prepare an updated Engineer's estimate of construction cost. 6. Prepare bid documents, advertise the project, respond to questions from potential bidders, attend bid opening, evaluate the bids and make a recommendation of award. 7. Prepare and submit permit applications for the drainage improvements to the South Florida Water Management District for proposed drainage system and outfall upgrades. B. CONSTRUCTION SERVICES • The Engineer and the Village understand that the purpose of this scope of services is to identify the Engineer's responsibilities for engineering services during construction and contract/project administration for the water distribution and drainage system improvements construction contract and for overall project management/Village liaison duties for the planned sewer improvements within Phase II of the Country Club portion of the project. Services related to the sewer improvement project are required to ensure that the Village's interests, including specifically the interests of the residences within the project area, are protected as they relate to costs, scheduling, restoration timing and adequacy, continuous access concerns, coordination of various work activities to minimize disruption and general construction administration. It is the intent and desire of the Village and the Engineer to work cooperatively with Encon and their design engineer while ensuring that the Village interests are protected and preserved to the extent they may differ from the interests of other parties. The following specific tasks will be performed by the Engineer: Provide Engineering services during construction and non-full time construction observation services for the planned water distribution system improvements and drainage system improvements to include the following: • Preparation of contract documents and contract administration; Preconstructionrneeting attendance; Shop drawing review; Pay request review and recommendation; Non-full time construction observation; Record drawing preparation; Project certification to the regulatory agencies. • Josef Grusauskas, Utilities Director RE: Water Distribution/Drainage System Improvements Page 3 Note that the non-full time construction observation services shall include a site visit three (3) times a week and presence at the following events:. main taps, outfall tie-ins, placement of structures, and pressure tests. The Engineer will also confirm monthly quantities with the Contractor for pay requests and develop punch list items. 2. Act as the Village's liaison with -Encon and their representatives for the sewer improvement construction activity planned within the peninsula. The following specific items will be included: - Attendance at regular construction progress meetings (at least once per 2 week period); - Review and coordination of project schedules as they relate to other construction work with particular emphasis on maintenance of access, restoration timing and minimization of overall disruption to residents; - Review of all proposed change orders, work directives and design changes which may impact schedules or other matters relevant to the Village and the impacted residents; , - Provide bi-weekly status reports to the Village on project work schedules/costs; • - Provide quarterly summary updates on construction issues and progress for Council. 3. Provide additional non full time on site construction observation services for the proposed gravity sewer components, to include three (3) site visits per week. The above scope is predicated on the assumption that the Village shall furnish, at no cost to the Engineer, all available pertinent information including previous reports, plans, specifications, permits and other data relevant to the performance of the above services for the project. It is also assumed that the sewer system improvements construction contract will contain provisions for input from the Village representatives and that Encon and its representatives will work cooperatively with the Engineer in the performance of this work. In addition, the Village shall designate, in writing, a person to act as the representative for services performed under this agreement and provide for a member of the Utilities Department staffto perform construction observation of the project when the Engineer is not on site. It is assumed the Village inspectors will submit daily observation reports to the Engineer. (Forms and format will be supplied by the Engineer). The Village inspectors will work with and through the Engineer on matters related to the contract administration. The following specific information and/or items shall be furnished at no cost to the Engineer: 1. Surveys, topographic, property, boundary, right-of way, permanent reference monuments, permanent control points and plats. • 2. Data prepared by or services rendered by others such as subsurface explorations laboratory tests and inspections of samples. 3. All permit application and government inspection fees. • Josef Grusauskas, Utilities Director RE: Water Distribution/Drainage System Improvements Page 4 TIME OF PERFORMANCE The Engineer shall commence work upon receipt of an executed authorization and shall complete the design services work, (Part A), scope items 1 through 7, within 150 days of authorization, exclusive of delays beyond the control of the Engineer. Scope items 1 through 3 under the construction services, (Part B), will be completed commensurate with the construction schedule which is anticipated to be 6 months to substantial completion. FEES For Scope Items 1-6 of the Design Services, (Part A), the Engineer shall be paid a lump sum fee of Fifty Three Thousand Five Hundred Dollars ($53,500.00). For Scope Item 7 of the Design Services, (Part A), the Engineer shall be paid according to the following schedule on the basis of actual time spent plus any applicable sales tax and reimbursement- . for non-salary expenses including, but not limited to, automobile travel at $:30/mile, reproduction and long distance telephone. We estimate the total cost for the services provided under the scope item • will not exceed Six Thousand Dollars ($6,000.00). This amount shall not be exceeded without prior written approval by the Village. For Scope Item 1 of the Construction Services, (Part B), the Engineer shall be paid a lump sum fee of Forty Nine Thousand Five Hundred Dollars ($49,500.00). For Scope Items 2 and 3 of the Construction Services, (Part B), the Engineer shall be paid according to the following schedule on the. basis of actual time spent plus any applicable sales tax and reimbursement for non-salary expenses including, but not limited to, automobile travel at $.30/mile, reproduction and long distance telephone. We estimate the total cost for the services provided under the scope items 2 and 3 will not exceed Thirty Three Thousand Dollars ($33,000.00). This amount shall not be exceeded without prior written approval by the Village. Note that the fees stipulated above, assume "normal" construction problems and progress. It further assumes that substantial and final completion of the project, within the construction time lines outlined above, will be met for each part of the work. Project Manager. $70.00/HR. Senior Engineer $65.00/HR. Engineer/Sr. Technician $55.00/HR. Designer $50.00/HR. Draftsman $40.00/HR. • Technician $3 7.50/HR. Secretary $25.00/HR. • Josef Grusauskas, Utilities Director RE: Water Distribution/Drainage System Improvements Page 5 If services are required in the performance of the above scope, beyond those normally provided by the Engineer, which must be sublet, the Engineer shall order the work after obtaining the written authorization of the Village. The subcontractor shall bill the work directly to the Village. If the Engineer is requested to subcontract the work directly, a 10% handling charge will be added to the subcontractors invoice. Invoices for services rendered are issued on a monthly basis and are due within thirty (30) days of the invoice date. Interest at a compound rate of one and one-half percent per month shall be charged to any past due statements. Interest shall be computed on past due statements from the date of the invoice. COST ESTIMATES Construction cost estimates are developed from knowledge of market conditions and based on the experience of the Engineer. However, the Engineer exercises no control over the competitive bidding process and, therefore, makes no guarantee of the accuracy of the estimate when compared to previous estimates or actual bids. , • TERMINATION This agreement may be terminated by either party by giving thirty (30) days written notice. The Engineer shall be paid for all services rendered prior to the termination date. ACCEPTANCE Acceptance of this proposal may be indicated by executing this document in the space provided below. This contract shall be considered void if not executed within thirty (30) days from the above date. Upon execution of this agreement the Village shall return one copy to the Engineer.
