RESOLUTION NO. 45-99/00
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA,
APPROVING A CONTRACT WITH REESE, MACON &
ASSOCIATES, INC., OF LAKE WORTH, FLORIDA, TO
PERFORM ENGINEERING SERVICES IN CONNECTION WITH
THE CONSTRUCTION/PROJECT ADMINISTRATION SERVICES
FOR COUNTRY CLUB/BERMUDA TERRACE - PHASE I WATER
DISTRIBUTION/DRAINAGE SYSTEM IMPROVEMENTS IN THE
AMOUNT OF $88,500 AND FOR PROVIDING PROJECT
ADMINISTRATION DUTIES AS IT RELATES TO THE ENCON
SEWER PROJECT IN THE AMOUNT OF $38,500, FOR A
TOTAL AMOUNT OF $127,000, WITH FUNDS BEING
APPROPRIATED FROM THE WATER ENTERPRISE
UNDESIGNATED RESERVES IN THE AMOUNT OF $102,000;
AND THE STORMWATER UTILITY FUND CAPITAL BUDGET,
HAVING A FY 1999/2000 BUDGET ALLOCATION OF
$25,000, AND AUTHORIZING THE VILLAGE MANAGER TO
EXECUTE THE APPLICABLE CONTRACT ON BEHALF OF THE
VILLAGE.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA,
AS FOLLOWS:
Section 1. A contract with Reese, Macon & Associates,
Inc., in the total amount of $127,000, for the Tequesta
Country Club/Bermuda Terrace Water Main Replacement and
Drainage System Improvements - Phase I, attached hereto
as Exhibit "A" and incorporated by reference as part of
this Resolution is hereby approved and the Village
Manager is authorized to execute the Contract on behalf
of the Village.
THE FOREGOING RESOLUTION WAS OFFERED by
Councilmember
Schauer who moved its adoption. The motion was
seconded by Councilmember Walker and upon
being put to a vote, the vote was as follows:

We are pleased to submit this Proposal for engineering services in connection with providing
services during contitructionlprc~ject adminislration services for the above referenced Project.
REESE, MACON and ASSOCIATES, INC:., hereinafter referred to as the Engineer, shall
perform the services as documented below far The Village of Tequesta, hereinafter referred to as
the Client.
SCOPE
T'hc Gnginccr and the Client understand that the purpose of this scope of services is to identify
the Engineer's respansihilities for engineering services Burins construction and contr~tcUproject
administration for the water distribution and drainage system improvements construction
contract (Part A) and for overall project rnanagctnetttlclicnt liaison duties for the planned sewer
improvements within the above project (Part B). The "Part A" services are reyuircd for the
Ettginccr to observe tttc construction, adtnit-istcr the contract and certify complctiatt of the
project. 'These services will be performed for the water distribution and drainage system
improvctntntfi. Certification of construction complrtion far the drainage improvement; will he
based upon the design plans as prepared by Shalloway, Foy, ltayman & Ncwcll (SrRN). ")cart
ti" services are required to ensure that the Village's interests, including specifically the intcrc,-~ts
oI'lhc residences within the project arcs, arc protected as they relate to costs, schcdulins,
restoration timing anti adequacy, cUntinuaus ac;c;cSS concerns, coordination of various work
activities to minimire ditiruption and general construction adtninistratihn. It is the intent and
desire of the Village and the Engineer to work cooperatively with ENCON and STRN while
ensuring that the Village interests arc protected and preserved to the extent they may differ from
the interests of other parties. 'f'he following specific tasks will be perforn--ed by the Engineer:

Part A (Water Distribution and Drainage Improvements)
i. Provide );ngineering services during construction and non-full time construction observation
services for the planned water distribution and drainage system improvements to include the
following:
- Preparation of contract documents and contract administration
- Preconstnuction meeting attendance
- Shop drawing review
- Pay reQuest review and recommendation
- Non-full time construction observation
- Record drawing preparation (Note thaf the drainage rtxord drawing inforniation
will be provided in tabular farm cm the RMtI water main replacement drawings)
- T'raject ccrtitieat.ion to the regulatory agencies
Note that t11e non-full timi: conslrttction observation services shall include a site visit three (3)
times a week and presence at the following events; main taps, outfall tie-ins, placement of
structures directional bores and pressure tests. The Lngirteer will also cnnfirm monthly
quaniilit;.s with Contractor for pay requests and develop punch list itcrtls.
Fart B (Sewer Improvements)
Act as the Village's liaison with Fncon and their rcpresctttativcs for the sewer improvement
construction activity planned within the peninsula. The following speciCe items will be
incIudcd:
- Attendattec at regular construction progress meetings (at least once per 2 week
period)
^ Review and ccfordintttion of project schedules as they relate to other construction
work with partiettlar emphasis on maintenance of access, restoration timing and
rninimi7ation of overall disruption to residents.
- Review and approval of all proposed change orders, work directives and design
changes which tnay impact scheciule:s or other matters relevant to the Village and
the impacted residents.
- Provide bi-wc:c:kly status reports to the Village on project work schcdules/costs.
- T'rovidc cluartcrly summary updates on construction issues and progress for
Council.

2. Provide additional non full time on site construction observation Services for the proposed
gravity sewer cornponcnts, to include three (3) site visits per week.
The above scope is predicated on the assumption that the Client shall furnish, .~t no cost to the
Engineer, all available pertinent infom>tation including previous reports, plans, specifications,
permits and other data relevant to the pcrforrnancc of the above services for the; project. It is also
aSSUtned t113t the Sealer System imprUVements constru[;tiUn Contract Wlll Contain prUVrsrons for
input from the Village representatives and that l;rlcon and its representatives will work
cuopcrativcly wish the Fnginccr in the performance of this work. In addition, the Caient shall
designate, in writing, a person to act as the representative for services performed under this
agreement and provide: for a tncmbcr of the Utilities !)epartment staff to pcribrm construction
observation of the project when the Fnginccr is not on site. It is assumed the Village inspectors
will submit daily c~bscrvation reports to flit Engineer. (!~orn~s and fnrmat will be supplied by the
Fnginccr). The Village inspectors will work with and through the Fnginccr on matters related to
the contract administration.
'1'IMN, t7iN P>N ItFORMANCE
7'he Engineer acknowledges that the time frame far this project is critical.
Item 1 of the Scope of Services under "Part A", will be completed commensurate with the
construction schedule. (Substantial Completion within 8 months and Hinal C:ornptction within 9
months of tltc Notice to Proceed.)
Fur "Pori B", Scope Items ]and 2 of the Scope of Services will be completed commensurate
with the construction schedule. (Substantial C:ompletiort within li months and Final Completion
within 9 months of the Notice to Proceed.)
FEES
For Scope Item 1 under "Part A" the Engineer shall be paid a lump sum fee of Eighty-bight
Thousand Fivc Hundred l.)oltan ($ 88,500.00).
l~or Scope Items 1 and 2 under "Part B" the Lnguleer shall he paid according to the following
schedule on the basis of actual titnc spent plus any applicable sales tax and reimbursement for
non-salary expenses including, but nut limited to, automobile travel at $.30/mile, reproduction
and long distance telephone. We estimate the total cost for the services provided under the scope
itcrns will not exceed Thirty Light Thousand Fivc Hundred Dollars ($ 38,500.OOj. This amount
shall not be exceeded without prior written approval by the Client.

If services arc rcyuircd in the petfonnance of the above scope, beyond those normally provided
by the Cnginccr, which must be suhlel, the Lttginccr shall order the wt~rk aRcr obtaining the
written authorisation of the Client. The subcontractor shall bill the work directly to the Cli~tt. If
the Cnginecr is requested to subcontract llte work directly, a ! 0% handling charge will be added
to the subcontractors invoice.
Invoices fpr services rendered arc issued on a monthly basis and arc due within thirty {30} days
of the invoice date. Interest at a compound rate cif one and one-half percent per month shall be
charged to any past due statements. Interest shall be computed on past due statctttents frtam the
date of the invoice.

This agreement may be terminated by either party by giving thirty (3Q) days written notice_ Thn

below. This contract shall be considered void if not executed within thirty (3d) days from the
