MINUTES
LOCAL PLANNING AGENCY MEETING
VILLAGE OF TEQUESTA, FL
OCTOBER 17, 2019 5:30 PM COUNCIL CHAMBERS
CALL TO ORDER AND ROLL CALL
The meeting was called to order by Board Chair, Janet Strand at 5:30 p.m. A roll call was taken by
Community Development Planner, Lance Lilly. Present were: Board Chair, Janet Strand, Elizabeth
Schauer, Ashley Warren, Leslee Dasher, Marguerite Wilson, and Molly Young. Also present were Village
Attorney, Amity Barnard and Community Development Director, Nilsa Zacarias. Absent were: Vice Chair,
Steven Eagen and Theresa Maggio.
1. APPROVAL OF AGENDA
MOTION: Schauer made a motion to approve the agenda. Dasher seconded the motion. Carried
unanimously 5-0.
2. APPROVAL OF MINUTES
MOTION: Dasher made a motion to approve the previous meeting minutes of July 18, 2019.
Member Warren seconded the motion. Carried unanimously 5-0.
AGENDA ITEMS
3. ORDINANCE NO. 23-19:AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER
78. ZONING. SEC. 78-745. PROHIBITIONS IN ALL ZONING DISTRICTS. BY ALLOWING
RETAIL USES TO HAVE ONE OUTDOOR DISPLAY OF MERCHANDISE UNDER CERTAIN
CONDITIONS; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION
OF CHAPTER 78 SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY
ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND
AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE, AND FOR OTHER
PURPOSES.
Village Attorney, Amity Barnard introduced the agenda item with a brief description of the
ordinance. The ordinance would allow for outdoor display and merchandise in certain
situations/locations in the Village.
MOTION:Schauer made a motion to approve Ordinance 23-19. Member Dasher seconded the
motion. Carried unanimously 5-0.
4. ORDINANCE 27-19: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER
78. ZONING. ARTICLE X. OFF-STREET AND ON -STREET PARKING AD LOADING
REGULATIONS, TO CREATE AN ENTIRELY NEW SECTION 78-707. ALTERNATIVES FOR
MEETING REQUIRED NUMBER OF PARKING SPACES. TO PROVIDE FOR OFF -SITE
PARKING, SHARED PARKING AND REDUCTION OF REQUIRED PARKING SPACES, AND
TO PROVIDE REGULATIONS AND REQUIREMENTS FOR SAME; ALSO CONFORMING
EXISTING LANGUAGE IN THIS ARTICLE FOR INTERNAL CONSISTENCY; PROVIDING
THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 78. SHALL
REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A
CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY;
PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
Village Attorney, Amity Barnard introduced the subject ordinance into the record. Community
Development Director, Nilsa Zacarias explained that the Village is in a phase of redevelopment
and the subject ordinance would provide flexibility for locations that cannot meet the current
parking code. The ordinance would accommodate upcoming redevelopment and infill
development.
Board Member Dasher questioned the differences between off street parking, off -site parking and
shared parking. Ms. Zacarias explained that off -site parking would allow a location to enter into an
agreement with a separate site, to meet the parking requirements. The off -site parking location
would be required to be within 500 feet.
Shared parking is for locations that are within the same site/plaza. The agreement would be
based on peak times/demands.
On street parking would allow sites to park on the street rather than in the plaza/site and this
parking would be included in their parking counts.
If any off -site, on street, or shared parking do not apply, the applicant may provide the Village with
a parking study, conducted by a certified transportation professional (traffic engineer/planner).
The Village's traffic engineer would review the subject study.
MOTION: Member Schauer made a motion to approve Ordinance 27-19. Member Dasher
seconded the motion. Carried unanimously 5-0.

MOTION: Member Schauer made a motion to adjourn at 5:42 pm Member Warren seconded the
