CALL TO ORDER
The Special Magistrate Kevin Wager began this meeting at 10:00 am.

REPEAT VIOLATION HEARINGS

Findings of Fact were that the Respondents were not present at the hearing; however, there was a
finding of proper notice. Code Compliance Officer Michael Filipkowski provided testimony and
evidence of the repeat violation, as contained in the Village's evidentiary case file which was
accepted into evidence. Based upon the evidence and testimony presented, the Special Magistrate
finds that the property was in violation of Section 46-73 of the Code of Ordinances of the Village
of Tequesta. This is a repeat violation of the same Village Code section(s) from an "Order Finding
Violation" dated February 5, 2018,
It was a Conclusion of Law that the above-stated facts, Respondents are in repeat
violation of Chapter 46, Article III, Section 46-73 of the Code of Ordinances of the
Village of Tequesta.
The Special Magistrate ordered the Respondents are hereby ordered to comply with Section 46-73
of the Code of Ordinances of the Village of Tequestaon or before October 11, 2019. If the
Respondents fail to achieve compliance on or before October 11, 2019, a daily Fine of Twenty-Five
Dollars ($25.00)per day may be imposed for each day the violation continues to exist. Please take
notice that you must appear at the Fine Assessment Hearing which will be held on thel 2th day of
November, 2019 at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta,

Florida 33469, unless the Code Enforcement Officer certifies that you have timely brought your
property into compliance.
Respondents are further assessed the Village's administrative costs in the amount of$193.80 for the
October 8,2019 hearing.

Findings of Fact were that the Respondents were not present at the hearing; however,
there was a finding of proper notice. By the "Order Finding Violation and Permitting Village
Abatement dated August 22, 2019, the Special Magistrate ordered the Respondents to
comply with Sections 30-33 and 301.3 of the IPMC per Section 14-121 of the Code of
Ordinances of the Village of Tequesta within fourteen (14)days of the date of the order(by
September 5, 2019). The previous order also authorized the Village to abate the violation
of Sections 30-33 and 301.3 of the IPMC per Section 14 121 of the Code of Ordinances of
the Village of Tequesta regarding the height of the weeds and grass and unsafe and
unsecure condition of the vacant structure. Based upon the evidence, pictures and
testimony presented at the hearing on October 8, 2019, the Special Magistrate found that
the property came into compliance with Sections 30-33 and 301.3 of the IPMC per Section
14 121 of the Code of Ordinances of the Village of Tequesta on September 5, 2019.
It was a Conclusion of Law that the above-stated facts, constitute a violation of Sections
30-33 and 301.3 of the IPMC per Section 14 121 of the Code of Ordinances of the Village
of Tequesta.
It is the Order of the Special Magistrate that a Fine of Two Hundred Dollars ($200.00) is
hereby assessed, at Twenty-Five Dollars ($25.00) per day, for the violations which have
existed on the property beginning from September 6, 2019 through September 13, 2019,
a period of eight (8)days. Administrative costs in the amount of Two Hundred Eight Dollars
and Sixty Cents ($208.60)for administrative costs incurred for the August 13, 2019 hearing
are also reaffirmed.
Should you violate the same Section of the Code again, you may be subject to a fine of up
to Five Hundred Dollars ($500.00) per day for such repeat violation. Additionally, the Code
Officer is not required to give a reasonable time to correct the repeat violation and the case

may be presented to the Special Magistrate even if the repeat violation has been corrected
prior to the Special Magistrate hearing.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and, once recorded, shall constitute a lien against the property upon which the
violation exits and upon any other real or personal property owned by the Respondents,
pursuant to Chapter 162, Florida Statutes.
