10 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN
11 OF JUPITER FLORIDA, RECOGNIZING POTENTIAL
12 HUMAN AND ENVIRONMENTAL HAZARDS
13 ASSOCIATED WITH THE USE OF GLYPHOSATE
14 PRODUCTS, CALLING FOR A REDUCTION IN THE USE
15 OF HERBICIDES CONTAINING GLYPHOSATE IN TOWN
16 CONTRACTS AND ON TOWN PROPERTY, AND
17 ENCOURAGING A REDUCTION IN THE USE OF
18 GLYPHOSATE PRODUCTS BY THE PUBLIC. PROVIDING
19 FOR AN EFFECTIVE DATE.

21 WHEREAS, glyphosate is a commonly used herbicide that is applied to the
22 foliage of plants to kill both broadleaf plants and grasses; and
23 WHEREAS, the Town recognizes that glyphosate has been determined to be
24 safe by numerous agencies including the United States Environmental Protection
25 Agency, when used in accordance with the manufacturer's instructions, the Town also
26 recognizes that other organizations, including the World Health Organization's
27 International Agency for Research on Cancer ("IARC"), have concluded that glyphosate,
28 the key ingredient in various herbicides is "probably carcinogenic in humans;" and
29 WHEREAS, while not definitive, it is suspected that there are potential cancer
30 risks associated with glyphosate based weed killers such as Round-Up and Ranger Pro;
31 and
32 WHEREAS, the Town of Jupiter ("Town") has determined that it is desirable to
33 reduce the potential risk to human health, animal health and the environment by
34 minimizing the use of certain herbicides; and
35 WHEREAS, the Town has determined that the use of certain herbicides on lands
36 within the Town creates a risk, potentially contributing to adverse effects on surface
37 and/or ground water; and

1 WHEREAS, in an effort to protect the Loxahatchee river and improve water
2 quality throughout the region, the Town has determined that reducing the use of
3 herbicides containing glyphosate by any Town employee or applicator on Town-owned
4 property is desirable and in the best interest of the public and the Loxahatchee River;
5 and
6 WHEREAS, Policy 1.5.10 of the Conservation Element of the Town's
7 Comprehensive Plan encourages a reduction in the use of fertilizers, pesticides and
8 other potentially harmful materials; and
9 WHEREAS, the Town wishes to diminish the potential risks associated with
10 herbicide products containing glyphosate and therefore seeks to reduce the application
11 of glyphosate containing herbicides such as Round-Up and Ranger Pro by all Town
12 employees and commercial applicators in the performance of landscaping and
13 maintenance work on all Town — owned or managed properties and direct Town
14 departments to take all actions necessary to accomplish the aforestated objectives.
15 WHEREAS, the Town wishes to further protect the public health, safety, and
16 welfare of its residents, employees, and contractors by reducing their exposure to
17 potentially harmful and carcinogenic substances used in the maintenance of
18 landscaping and natural areas within Town owned lands by:
19 • Minimizing the use of products containing glyphosate in parks, playgrounds and
20 landscape areas with human traffic;
21 • Considering potential alternatives that are safe and effective;
22 • Limiting the use of products containing glyphosate to areas of minimal human
23 and animal traffic such as landscape medians and exotic plant management in
24 natural areas;
25 • Following best management practices for the use and application of pesticides;
26 • Ensuring that all applicators, whether Town employees or an applicator on Town
27 owned property, are fully trained and are licensed by the Florida Department of
28 Agriculture and Consumer Services;
29 WHEREAS, the Town Council also seeks to encourage the public to reduce the
30 use of products containing glyphosate through education and outreach.

2 NOW, THEREFORE, BE IT RESOLVED THAT,
3 Section 1. The above recitals are fully acknowledged and incorporated into the
4 body of this Resolution as fully set forth herein.
5 Section 2. Tire Town Council of the Town of Jupiter hereby directs the Town
6 Manager to take all actions necessary to reduce the use of herbicides containing
7 glyphosate by all Town of Jupiter employees and contract applicators in the
8 performance of landscaping, and maintenance work on all properties owned, leased, or
9 operated by the Town of Jupiter.
10 Section 3. The Town Council of the Town of Jupiter hereby directs the Town
11 Clerk to transmit a copy of this Resolution to the Florida Department of Agriculture, the
12 Florida League of Cities, the Florida League of Counties, the South Indian River Water
13 Control District, the North Palm Beach Heights Water Control District, the North Palm
14 Beach County Improvement District, the Florida Department of Transportation, the
15 South Florida Water Management District, the Loxahatchee River Environmental
16 Control District, the Jupiter Inlet District and the Palm Beach County Board of County
17 Commissioners.
18 Section 4. The Town Council and Town staff will continue to evaluate and
19 implement best management practices aimed at the reduction of use of fertilizers,
20 pesticides and other potentially harmful chemicals based on available research.
21 Section 5. The Town Manager will provide the Town Council an annual update
22 on the status of these reduction efforts.
23 Section 6. Effective date. This Resolution shall take effect immediately upon
24 execution, as provided by law.
