Re: Request to Waive Fees for a Time Extension Development Order from Pelican Square
691 Tequesta LLC. (Developer for Pelican Square) is requesting to the Village Council to waive fees for
a Time Extension of a previously approved Development Order. The fee for the subject request is
$2,500.
Pelican Square (SPR 2-18) is a mixed use development, which includes one (1) three-story, 21,688 sq.
ft. building (First floor professional offices, Second and Third floors residential) and one (1) two-story
multi-family residential building in the rear. The 1.05-acre parcel is located at 691 N. US Highway 1,
Tequesta, Florida. The subject site plan was approved on January 10, 2019.
On November 19, 2019, Pelican Square applied for a Time Extension due to two (2) Executive Orders
by the Governor of the State of Florida. Pursuant to Executive Orders 19-189 (Hurricane Dorian) and
Executive Order 19-234 (Extension to Executive Order 19-189), the applicant is requesting 303 days (60
days plus 6 months; plus 60 days) from the development orders expiration date of January 10, 2020.
Per Village Code, the application fee for a Time Extension is one-half of the original site plan review fee.
In June 2018, Pelican Square paid $5,000 in site plan review fees; which, the subject Time Extension fee
is $2,500.
Per the Village of Tequestas Land Development Fee Schedule, the Village Council may reduce or waive
applicable fees for requests for development order time extension:
Reduction or Waiver of Certain Fees by the Village Council:
Notwithstanding the above provisions of this Fee Schedule, the Village Council may, from time to
time, upon written request of the applicant, reduce or waive applicable fees for application
resubmittals to either the Planning & Zoning Board or the Village Council, or for requests for
development order time extensions when extenuating circumstances exist, which were not caused by
action or inaction of the applicant, and that warrant the granting of relief in the sole discretion of the
Village Council. All such requests shall be reviewed on a case-by- case basis. Any relief granted by
the Village Council pursuant to this provision may be up to full amount of the applicable fee or any
fraction thereof, in the sole discretion of the Village Council.
