Workshop STAFF MEMO Meeting: Workshop - Mar 02 2020 Staff Contact: Jeremy Allen, Village Manager ITHMUM Discussion on Sidewalk Code Current Village of Teguesta Code Sec. 66-336. - Sidewalks and crosswalks. Sidewalks/pathways and crosswalks shall be commercial areas and along all arterial highways greater. Proposed Wording Regarding Sidewalks Department: Building required in all residential, multiple -family and Sidewalks/pathways shall be four feet in width or The granting of a building permit for new construction or substantial improvement shall automatically require the property owner construct or improve sidewalks adjacent to all street rights -of -way. Said sidewalks shall be at the expense of the property owner and shall be constructed the length of the developed or improved property in accordance with Village specifications and approved by the Village Engineer-, however, this requirement may be waived by a majority vote of the Village Council. Sidewalks. (1) Sidewalks shall be constructed to a minimum width as outlined in (5), four inches in thickness, and constructed of a minimum 3,000 psi concrete. An alternative may be substituted if approved by the Village Engineer. (2) Sidewalks shall be designed to comply with the Americans with Disabilities Act and Florida Accessibility Code standards. (3)When pedestrian crossings are provided at mid -block locations, raised crosswalks (or other traffic - calming measure(s) shall be located at all points where the pedestrian crossing traverses the lane of vehicle travel. When pedestrian crossings are provided at intersection locations, the requirements in intersection design and traffic calming, shall follow Palm Beach County standards. (4)ln special areas designed as permanent or occasional plaza areas, curbs between on -street parking and sidewalk are optional. (5)Sidewalks are required along both sides of internal streets within Activity Centers and shall conform to the following minimum standards- Single family attached/multifamily/nonresidential excluding commercial (eight -foot sidewalks), Commercial/mixed use (ten -foot sidewalks). Single Page 3 of 55 Agenda Item #1. family detached shall provide either six-foot sidewalks or a ten -foot multiuse path if the front of the homes are oriented to the path. Sidewalk widths shall be clear of any obstructions. (6)Sidewalks shall be constructed a minimum one foot (1') from the property line within the street Right -of -Way and shall extend along the full street frontage including both sides of corner lots and block ends. Definition SUBSTANTIAL IMPROVEMENT. Any repair, reconstruction, rehabilitation, alteration, addition or other improvement of a building or structure, the cost of which equals or exceeds 50 percent of the market value of the structure before the improvement or repair is started. If the structure has sustained substantial damage, any repairs are considered substantial improvement regardless of the actual repair work performed. The term does not, however, include either: 1.Any project for improvement of a building required to correct existing health, sanitary or safety code violations identified by the building official and that is the minimum necessary to assure safe living conditions. 2. Any alteration of a historic structure provided that the alteration will not preclude the structure's continued designation as a historic structure. Upon direction of the Council, staff will bring the recommended code back in proper format for Council consideration at a regular Village meeting. Page 4 of 55
