Enclosed for your records is original Resolution No. 13-91/92
relating to the Eastwinds Landing drainage easement abandonment.
The Resolution was recorded in the public records of Palm Beach
County, Florida, on May 12, 1992, in Official Record Book 7240,
Page 1851. Also enclosed are photocopies of each of the recorded
Release of Rights of Easements which were executed by the
Homeowners Association and all of the waterfront lot owners.

A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, VACATING AND
ABANDONING CERTAIN PORTIONS OF A DRAINAGE EASEMENT ON i
THE PLAT OF EASTWINDS LANDING, AS RECORDED IN PLAT
BOOK 62, PAGES 94 & 95, PUBLIC RECORDS OF PALM BEACH
COUNTY, FLORIDA.
WHEREAS, the owners of the lands containing the
property hereinafter . described in Exhibit "A" attached hereto,
have petitioned the Village of Tequesta to abandon certain
portions of a drainage easement located over and across the
land more fully hereinafter described and as shown on Exhibit
"A"; and
WHEREAS, the existence of said drainage easement
precludes the full use of the land wherein said drainage
easement is located over and across; and
WHEREAS, an alternative drainage plan with adequate
and acceptable drainage facilities is being provided in order
to offset the removal of the existing drainage facilities
within the drainage easement being vacated and abandoned; and
WHEREAS, the Village Council of the Village of
Tequesta does hereby find and determine that the necessity for
the drainage easement as described in Exhibit "A" attached
hereto, does not serve any public purpose and is not necessary
for public use, in that adequate and acceptable drainage
facilities are being provided to serve the Plat of Eastwinds
Landing;
NOW, THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL ,
OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS:
That that certain drainage easement as shown on the
Plat of Eastwinds Landing as recorded in Plat Book 62, Pages 94
& 95, Public Records of Palm Beach County, Florida, and as more
particularly described in Exhibit "A" attached hereto, be and
the same, is hereby vacated and abandoned.

THE FOREGOING RESOLUTION was offered by
Councilmember Ron T. Mackail -_ - who moved its
adoption. The motion was seconded by

RELEASE OF RIGHTS IN EASEMENT
This Release of Rights in Easement is made this j±play of
April, 1992 by RIVEREDGE DEVELOPMENT CORPORATION, a Florida
Corporation (the "Corporation" ) .
WHEREAS, the Corporation owns the following described real
property (the "Property" ) :
Lots 1, 2, 3 and 4, of EASTWINDS LANDING,
according to the plat thereof, recorded in
Plat Book 62, Page 94, of the Public Records
of Palm Beach County, Florida.
WHEREAS, the Plat of Eastwinds Landing recorded in Plat Book
62, Page 94, Public Records of Palm Beach County, Florida (the
"Plat" ) , contains a dedicated drainage easement (the "Drainage
Easement Area" ) , which Drainage Easement Area abuts the Loxahatchee
River waterway continguous to the rear property • lines of Lots 1,
2, 3, 4, 5, 6, 7 and 8 of the Plat (the "Waterfront Lots") ; and,
WHEREAS, the Property and the Plat are within the Village of
Tequesta; and,
WHEREAS, the Village of Tequesta has vacated the Drainage
Easement Area; and,
WHERAS, by virtue of owning the Property which abuts the
Drainage Easement Area, the Corporation may have private rights in
and to the Drainage Easement Area for drainage easement purposes.
NOW THEREFORE, in consideration of the release of rights by
the owners of the other Waterfront Lots and other good and valuable
consideration, the receipt and sufficiency is hereby acknowledged:
1. The Corporation hereby releases and forever disclaims any
and all right, title and interest in and to the Drainage Easement
Area for drainage easement purposes.
2. The Corporation hereby further agrees that this release of

binding and enforceable against and as to any and all successors

WHEREAS, the Property and the Plat are within the Village of
Tequesta; and,
WHEREAS, the Village of Tequesta has vacated the Drainage
Easement Area; and,
WHERAS, by virtue of owning the Property which abuts the
Drainage Easement Area, we may have private rights in and to the
Drainage Easement Area.
NOW THEREFORE, in consideration of the release of rights by
the owners of the other Waterfront Lots and other good and valuable
consideration, the receipt and sufficiency is hereby acknowledged:
1. We hereby release and forever disclaim any and all right,
title and interest in and to the use of the Drainage Easement Area
for drainage purposes.
2 . We hereby further agree that this release of the Drainage
Easement Area for drainage easement purposes is binding and
enforceable against and as to any and all successors in title,
heirs, assigns, guardians and personal representatives.

RELEASE OF RIGHTS IN EASEMENT
This Release of Rights in Easement is made this Ne day of
JUNE, 1992 by EASTWINDS LANDING HOMEOWNERS ASSOCIATION, INC. , a
Florida Corporation (the "Corporation" ) .
WHEREAS, the Plat of Eastwinds Landing recorded in Plat Book
62, Page 94, Public Records of Palm Beach County, Florida (the
"Plat" ) , contains a dedicated drainage easement (the "Drainage
Easement Area" ) , which Drainage Easement Area abuts the Loxahatchee
River waterway continguous to the rear property lines of Lots 1,
2, 3, 4, 5, 6, 7 and 8 of the Plat (the "Waterfront Lots") ; and,
WHEREAS, the Property and the Plat are within the Village of
Tequesta; 'and,
WHEREAS, the Village of Tequesta has vacated the Drainage
Easement Area; and,
WHERAS, by virtue of the Plat's dedication of the Drainage
Easement Area to the Corporation, the Corporation may have private
rights in and to the Drainage Easement Area for drainage easement
purposes.
NOW THEREFORE, in consideration of the release of rights by
