Regular Council STAFF MEMO a Meeting: Regular Council - May 14 2020 Staff Contact: Matthew Hammond, Utilities Department: Utilities Director Approve Work Authorization KH-U20.02 - WTP Concentrate Disposal Relocation for FDOT Jupiter Federal Highway Bridge Replacement - Professional Engineering Services - Kimley-Horn I C1lnnnnAD The Utilities Department has a need to relocate the concentrate disposal pipe and diffuser adjacent to the Jupiter Federal Highway (US1) Bridge. Concentrate is a byproduct left behind when groundwater is pushed through reverse -osmosis membranes and is typically disposed of via surface water discharge or deep -injection well. The concentrate generated at the Village Water Treatment Plant (WTP) is disposed via a permitted discharge into the Loxahatchee River through the Florida Department of Environmental Protection (FDEP) which is the same method of disposal used by the Town of Jupiter. The Florida Department of Transportation (FDOT) is in the design -phase of replacing the existing Jupiter Federal Highway Bridge and has notified the Village that the current location of the concentrate disposal main within the FDOT US1 right-of-way will need to be moved to accommodate the new bridge. Note: The portion of the Village's concentrate disposal main located within FDOT rights -of -way was permitted through an FDOT Utility Permit which requires the relocation of utilities, at the utility providers cost, whenever required for District projects. Village staff and Kimley-Horn & Associates have been coordinating with FDOT and FDEP for over a year to identify a feasible and cost-efficient plan for the required relocation. The proposed relocation plan agreed to in concept by FDOT and FDEP involves temporarily moving the discharge point to the west side of the bridge until the bridge construction is complete when it will be moved back. The permitting of this relocation is made additionally challenging due to number of regulatory agencies involved and the proximity to the Loxahatchee River Aquatic Preserve immediately west of the bridge. Staff recommends the professional engineering services for this project be completed by Kimley-Horn & Associates, one of the Village's on -board engineering consultants. The proposed Work Authorization KH-U20.02, in the amount of $80,350, includes the design, permitting and bidding services required for the temporary relocation of the concentrate disposal main. A subsequent work authorization for the relocation of the concentrate disposal main to its permanent location will be submitted at a later date. VILLAGE OF TEQUESTA ENGINEERING SERVICES WORK AUTHORIZATION REJECT DISPOSAL MAIN RELOCATION AT THE US1 BRIDGE— PHASE 1 INDUSTRIAL WASTE PERMIT MODIFCATION AND DESIGN SERVICES This Work Authorization authorizes Kimley-Horn and Associates, Inc. to perform work set forth herein and is issued pursuant to The Professional Engineering Services Agreement, between the Village of Tequesta ("Client" or "Village") and Kimley-Horn and Associates, Inc. ("Kimley-Horn" or "Consultant"), dated May 12, 2016 ("Agreement"). All terms and conditions of said Agreement are hereby incorporated and made part of this Work Authorization. PROJECT UNDERSTANDING The Village's RO Water Treatment Plant discharges the plants reject fluid (a highly concentrated brine solution that the RO process generates) through a dedicated 12-inch reject disposal main that discharges into the Jupiter Inlet on the east side of the US 1 bridge. The Village maintains an Industrial Waste Permit with the Florida Department of Environmental Protection (FDEP) that allows them to discharge into the Inlet at the permitted location. The Florida Department of Transportation (FDOT) has determined that the US 1 bridge is beyond its designed life expectancy and has become structurally deficient and should therefore be replaced. The FDOT and their Bridge Consultant have commenced with design plans for the complete replacement of this bridge. Because of the proposed bridge replacement, the Village's reject disposal main conflicts with the bridge construction activities and the new bridge layout. The Village is required to relocate the reject disposal main (Note that the reject disposal mains current location is by means of a FDOT permit, and not by an easement, thereby requiring the Village to relocate the reject main at their cost). Over the last twelve months, Kimley-Horn and the Village have had numerous meetings and discussions with FDOT, the Bridge Consultant, FDEP, the Army Corp of Engineers (ACOE) and the Village on the bridge construction impact, and how to best address the reject main relocation to minimize the impact on the Village, while meeting regulatory concerns and the new bridge layout. The resulting resolution is a phased approach that will address the required permit modification and a temporary reject disposal main discharge location as Phase 1. Phase 2 will consist of design and permitting renewal (note that the current Industrial Waste Permit expires on November 21, 2021 and requires the permit renewal to be submitted 180 days prior to the expiration date) for a permanent discharge location to be completed at some point during the bridge construction activities. This will allow for the permanent location to be constructed, and abandonment of the temporary reject main constructed under Phase 1. Kimley-Horn will provide the Phase 1 services as outlined below. 1 Page 239 of 308 Agenda Item #6. SCOPE Kimley-Horn will perform the following services: 1. Prepare a site and bathymetric survey of the proposed Phase 1 corridor, out to the proposed outfall location. 2. Prepare permit applications and supporting documentation to the following Regulatory Agencies; • FDEP WW Facility/Activity Permit Application Form 1 — General Information • FDEP Permit to Discharge Demineralization Concentrate — Form 2DC • FDEP Notice of Intent to Use an Environmental Resource General Permit • Jupiter Inlet District Notification • U.S. Coast Guard Section 9 Permit • ACOE Individual Permit 3. Prepare a model of the proposed temporary discharge location to simulate the potential surface discharge plume for the determination of mixing zones as required by FDEP. Kimley-Horn will use the EPA model "Visual Plumes". 4. Prepare a Cultural Resource Assessment Survey (CRAS) for the area surrounding the temporary discharge location as required by the Army Corp of Engineers. 5. Conduct pre -application meetings with the U.S. Coast Guard, Army Corp of Engineers and the Jupiter Inlet District. 6. Conduct two (2) meetings with FDEP to review the submittal package and the first RAI received from them. 7. Address up to two (2) RAI's from US Coast Guard and ACOE. 8. Prepare 90% design plans for the reject main relocation and associated discharge location at a scale of 1" = 20' for the project to include the following; • Title Sheet (1 sheet) • General Notes (1 sheet) • Reject Main Plan and Profile (1 sheet) • Reject Main Connection/Diffuser Details (1 sheet) • Standard Construction Details (1 sheet) 9. Provide Village staff with 90% plans for review and comment. 10. Prepare Final design plans addressing Village comments. 11. Prepare technical specifications for the project to be incorporated into the bidding documents, along with Village front end documents. 12. Provide bid assistance to the Village consisting of the following; • Respond to Contractor questions and prepare addendums as necessary. • Attend the bid opening at Village Hall. • Evaluate the bids, investigate the Contractor qualifications and provide a letter that summarizes the bid and makes recommendation of award. 4 Page 240 of 308 Agenda Item #6. DELIVERABLES The Consultant shall provide the deliverables to the Village. 1. Project site survey. 2. 90% and Final design plans, paper copies and digital copies in PDF. 3. Engineers cost estimates with the 90% and Final design plans. 4. Copies of Permit Applications and associated permit supporting documentation. 5. Regulatory Agency RAI's received during the permit process. 6. Copies of Permits acquired for the project as noted above. 7. Project Specifications. 8. Copies of correspondence related to the Project. 9. Copies of Addendums. ADDITIONAL SERVICES Any services not specifically provided for in the above scope will be considered additional services and can be performed at our current hourly rates as requested by the Village in writing. Additional services could consist of; 1. Construction Administration/Inspection Services 2. Chemical and physical data that could be required for the Visual Plumes model, see the second note after "Assumptions" below. INFORMATION AND SERVICES PROVIDED BY THE VILLAGE Kimley-Horn assumes that all information provided by the Village can be relied upon in the performance of professional services. The following information shall be provided to Kimley-Horn and/or the following services will be performed by the Village. • Reject main water main location information • Associated permit application fees. • Bidding of project in a local newspaper/bid on-line service. ASSUMPTIONS • The FDEP and ACOE requires a seagrass survey as a part of their permit applications. The FDOT has performed a seagrass survey as a part of their proposed bridge work. Kimley-Horn has gained approval of these agencies to use the FDOT seagrass survey as long as the permit application is filed this year. FDOT will provide the seagrass survey to the Village. • The EPA Visual Plumes model requires several inputs, both chemical and physical type data. The Consultant has had discussions with several agencies and has gathered this information for use within the model. 3 Page 241 of 308 Agenda Item #6. SCHEDULE Kimley-Horn will complete the work set forth herein within with the schedule outlined below after receipt of an executed Work Authorization and Purchase Order, exclusive of delays beyond the control of the Consultant. In doing so the constituates in the groundwater that are undesireable for drinking water are removed. The remaining "concentrate" is diluted and disposed of underneath the north side of the Jupiter Federal Bridge through a right-of-way permit with the FDOT. FDOT is in the design process of replacing the existing bridge which will require the Village to relocate the concentrate disposal piping in phases to accomodate the new bridge footprint and construction schedule.
