Regular Council STAFF MEMO Meeting: Regular Council -Jul 09 2020 Staff Contact: Gus Medina, Police Chief Department: Police 19" Approve Termination Agreement between the Village of Tequesta and Palm Beach County to Deprogram the Tequesta Police Department Motorola Radios This is an agreement to pay Palm Beach County to deprogram the Tequesta Police Department Motorola radios. The radios cannot be surplussed until being deprogrammed. The cost is approximately $812.50. Recommend to approve. Palm Beach County Page 63 of 191 Agenda Item #5. TERMINATION AGREEMENT This Termination Agreement is made as of , by and between Palm Beach County, a political subdivision of the State of Florida, ("County") and the village of Tequesta, a municipal corporation of the State of Florida ("Municipality"). wITNESSETH WHEREAS, on December 17, 2019, the County approved an Interlocal Agreement R2019-1902 (the "Agreement") which provided the Municipality with direct access to the County's Public Safety Radio System through July 20, 2024; and WHEREAS, on February 13, 2020, the Municipality approved the migration of its dispatch services to the City of Palm Beach Gardens, to be effective on October 11 2020; and WHEREAS, the Municipality will not require the services provided by the Agreement when the approved contract takes effect and has requested an early termination of the Agreement; and WHEREAS, County is agreeable to the early termination of the Agreement; and WHEREAS, the parties desire herein to set forth the terms and conditions for the termination of the Agreement. Nov, therefore, in consideration of the mutual promises contained herein, the County and Municipality agree as follows: 1. The Agreement terminates effective at 11:59 pm on September 30, 2020. 2. The Municipality shall contact the County to arrange for the deprograming of all their equipment no later than October 16, 2020. 3. The Municipality shall pay the following sums for the deprograming of the County channels from the Municipality's equipment at a rate of $65/hour. a) $568.75 for 8.75 hours to deprogram thirty eve (35) radios/ 4 radios per hour; and b) $113.75 for 1.75 hours to deprogram seven (7) radio consoles/ 4 per hour; and c) $130 for 2 hours of travel to and from the Municipality's Police Department to the Facilities, Development &Operations office. Within 30 days of County deprogramming the channels from Municipality's equipment, the Municipality shall pay County for this service and send payment to: Facilities Development & Operations Fiscal Manager 2633 vista Parkway West Palm Beach, FL 33411-5603 Attn: 800 MHz Interlocal Agreement # , Invoice # 5. This Termination Agreement supersedes and replaces conflicting terms and conditions contained in the Agreement and to the extent of, and in the event of a conflict, the provisions of this Termination Agreement prevail.
