MINUTES
SPECIAL MAGISTRATE MEETING
VILLAGE OF TEQUESTA, FL
JULY 14, 2020 10:00 AM COUNCIL CHAMBERS
CALL TO ORDER
The Special Magistrate Judge Kevin Wager began this meeting at 10:00 am. and the Pledge of
Allegiance was led by Special Magistrate Kevin Wagner. Present were Special Magistrate Kevin
Wagner, Code Enforcement Officer Michael Filipkowski and Village Attorneys Amity Barnard
and Matthew Pritchett.
The following cases were heard by the Special Magistrate who swore in three people involved in
Quasi -Judicial cases.
REPEAT VIOLATION HEARINGS

Legal Description: RIDGEWOOD HOMES SEC 2, LOT 76
Findings of Fact were that the Respondent was the owners of the above -described
property. The Respondents were represented by Robert Miller at the hearing; there
was also a finding of proper notice. Code Compliance Officer Michael Filipkowski
provided testimony and evidence of the violation, as contained in the Village's
evidentiary case file which was accepted into evidence. Based upon evidence and
testimony presented at the hearing on July 14, 2020, the Special Magistrate found that
the property was in violation of Section 30-33 of the Code of Ordinances of the Village
of Tequesta from June 5, 2020 through July 1, 2020, for a period of twenty-six (26)
days. This is a repeat violation of the same Village Code section from an "Order
Finding Violation" dated August 21, 2017 (Case No. 2017-00190).
Conclusions of Law were that the above stated facts, Respondents are in repeat
violation of Chapter 30, Article II, Section 30-33 of the Code of Ordinances of the

Village of Tequesta. The Special Magistrate Ordered that a Fine of Three Hundred
Ninety Dollars ($390.00) is hereby assessed at a daily amount of Fifteen Dollars
($15.00) per day for the repeat violation which existed on the property from June 5,
2020 through July 1, 2020, a period of twenty-six (26) days. The Respondents are also
assessed the Village's administrative costs in the amount of $192.80.
Should they violate the same Village Code section again, they may be subject to a fine
of up to five hundred dollars ($500.00) per day for such repeat violation. Additionally,
the Code Inspector is not required to give a reasonable time to correct the repeat
violation and the case may be presented to the Special Magistrate even if the repeat
violation has been corrected prior to the Special Magistrate hearing.
