HomeMy WebLinkAboutResolution_25-20_8/13/2020RESOLUTION NO. 25-20 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, CONFIRMING BY PROCLAMATION THE STATE OF EMERGENCY DECLARATIONS ISSUED ON APRIL, 10, 2020, APRIL 17, 2020, APRIL 24, 2020, MAY 1, 2020, MAY 8, 2020, MAY 15, 2020, MAY 22, 2020, MAY 29, 2020, JUNE 5, 2020, JUNE 12, 2020, JUNE 19, 2020, JUNE 26 2020, JULY 3, 2020, JULY 10, 2020, JULY 17, 2020, JULY 24, 2020, JULY 31, 2020 AND AUGUST 7, 2020 (A CONTINUANCE OF RESOLUTIONS NO. 11- 20, 15-20, AND 18-20) FOR THE VILLAGE OF TEQUESTA DUE TO COVID-19 (CORONAVIRUS), ALL EMERGENCY REGULATIONS ACTIVATED UNDER THE PROVISIONS OF CHAPTER 26 OF THE VILLAGE CODE OF ORDINANCES, AND THE DESIGNATION OF THE FIRE CHIEF AS THE EMERGENCY MANAGEMENT DIRECTOR FOR THE VILLAGE FOR SO LONG AS THE LOCAL STATE OF EMERGENCY CONTINUES IN EFFECT; PROVIDING AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. WHEREAS, as of March 13, 2020, the number of confirmed CoVid-19 (Coronavirus) in Florida was 45, 5 Florida cases repatriated, and 6 non -Florida residents (Florida Department of Health); WHEREAS, as of March 13, 2020 there are 221 pending test results, 365 people currently being monitored, with a total of 1413 people monitored to date (Florida Department of Health); and WHEREAS, as of March 13, 2020 there are 2 confirmed cases in Palm Beach County (Florida Department of Health), and WHEREAS, as of March 13, 2020, President Trump declared a National Emergency encouraging States to set up emergency operations and to activate emergency preparedness plans; and WHEREAS, on March 13, 2020,.as a precautionary measure to prevent the possible spread of COVID-19, and to ensure the health and well-being of our residents and visitors, the Village of Tequesta canceled all special events hosted by the Village of Tequesta until further notice, which included Shred It, Coffee with a Cop, Volunteer Recognition, the Volunteer Recognition, and our Easter Egg hunts. WHEREAS, on March 18, 2020, the Village closed Village Hall and Village facilities to the public, except essential operations (public safety and water plant) and personnel continued to be available to serve the citizens, and WHEREAS, on March 20, 2020, the Village's playgrounds were closed to the public, Governor's Office issued Executive Order 20-70 closing all restaurants, bars, nightclubs, pubs, taverns, banquet halls, cocktail lounges, cabarets, breweries, cafeterias, and any other alcohol and/or food service with seating for more than ten people within Palm Beach County closed to on premise service (excluding take out and delivery services), and the Village re -issued its Emergency Declaration, and WHEREAS, on March 23, 2020, Palm Beach County issued Amendment to Emergency Order No. 1, closing within Palm Beach County, including all municipalities therein, all boat docks, ramps, marinas, and any other venues utilized for launching any vessels to be used for recreational purposes, including, but not limited to, fishing charters, boat tours, diving excursions, and the like; and WHEREAS, on March 24, 2020, the Governor's Office issued Executive Order 20-82 directing all persons who enter the State of Florida from an area with substantial community spread, to include the New York Tri-State Area (Connecticut, New Jersey and New York), to isolate or quarantine for a period of 14 days from the time of entry into the State of Florida; and WHEREAS, on March 25, 2020, Palm Beach County issued Emergency Order No. 3 closed all parks and golf courses to public access in Palm Beach County; and WHEREAS, on March 26, 2020, Palm Beach County issued Emergency Order No. 2 closing all noncritical retail and commercial business locations except to the extent necessary to perform Minimum Basic Operations, and WHEREAS, on March 27, 2020, the Governor's Office issued Executive Order 20-82 directing all persons who enter the State of Florida from the State of Louisiana to isolate or quarantine for a period of 14 days from the time of entry into the State of Florida; and WHEREAS, on March 27, 2020, the Governor's Office issued Executive Order 20-87 ordering all parties engaged in rental of vacation rental properties, as defined in section 509.242(1)(c), Florida Statutes, to suspend vacation rental operations; and WHEREAS, on March 27, 2020, the Village re -issued its Emergency Declaration, and WHEREAS, on March 29, 2020, Palm Beach County Emergency Order 2020-003a, effective March 30, 2020 at 12:01 a.m., strongly urged residents to stay home or at their place of residence, except to obtain necessary services and supplies, and WHEREAS, on March 30, 2020, there were 5276 confirmed cases in Florida and 407 confirmed cases Palm Beach County (Florida Department of Health), and WHEREAS, on April 3, 2020, the Village re -issued its Emergency Declaration; and WHEREAS, on April 3, 2020, Palm Beach County extended the State of Emergency effective date of April 3, 2020, by seven days which expired on April 10, 2020; unless extended in 7 day increments pursuant to Section 252.38(3)(a)(5), Florida Statutes; and WHEREAS, on April 10, 2020, Palm Beach County extended the State of Emergency effective date of April 10, 2020, by seven days which expired on April 17, 2020; unless extended in 7 day increments pursuant to Section 252.38(3)(a)(5), Florida Statutes; and WHEREAS, on April 17, 2020, Palm Beach County extended the State of Emergency effective date of April 17, 2020, by seven days which expired on April 24, 2020; unless extended in 7 day increments pursuant to Section 252.38(3)(a)(5), Florida Statutes; and WHEREAS, on April 24, 2020, Palm Beach County extended the State of Emergency effective date of April 24, 2020, by seven days which will expire on May 1, 2020; unless extended in 7 day increments pursuant to Section 252.38(3)(a)(5), Florida Statutes; and WHEREAS, on April 29, 2020, Florida Governor DeSantis signed Executive Order 20- 112, implementing a "Phase 1, Safe Smart Step -by -Step Plan" for Florida's Recovery, which for purposes of re -opening certain business services, excluding Palm Beach County at this time; and WHEREAS, on May 1, 2020, Palm Beach County extended its State of Emergency Declaration by 7 days pursuant to Section 252.38(3)(a)(5), Florida Statutes; and shall continue in full force and effect through May 8, 2020, and WHEREAS, on May 5, 2020, there were 37,439 confirmed cases in Florida, 339 confirmed cases in Palm Beach County, and 11 confirmed cases in Tequesta, and WHEREAS, on May 15, 2020, Florida Governor DeSantis signed Executive Order 20- 123, implementing a "Phase 1 opening, Safe Smart Step -by -Step Plan" for Florida's Recovery, which for purposes of re -opening certain business services, to include Palm Beach County, and WHEREAS, on June 3, 2020, Florida Governor DeSantis signed Executive Order 20- 139, implementing a "Phase 2, Safe Smart Step -by -Step Plan" for Florida's Recovery, which for purposes of re -opening and extending certain business services, excluding Palm Beach County at this time; and WHEREAS, on April 10, 2020, April 17, 2020, April 24, 2020, May 1, 2020, May 8, 2020, May 15, 2020, May 22, 2020, May 29, 2020, June 5, 2020, June 12, 2020, June 19, 2020, June 26 2020, and July 3, 2020 the Village re -issued Emergency Declarations. WHEREAS, on June 11, 2020, the Village Council re -affirmed the Renewal of State of Emergency Declaration Due to COVID-19 as required by the Village Code Sec. 26-5 (d). NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1 As designated by Section 26-5 of the Village Code of Ordinances, the Mayor (Abigail Brennan), the Village Manager (Jeremy Allen), and the Emergency Management Director (James Trube) issued a State of Emergency Declaration on Friday, March 13, 2020 for the Village due to CoVID-19 (Coronavirus). Section 2 Section 26-3 of the Village Code of Ordinances designates the Fire Chief as the Emergency Management Director in order to accomplish all coordination, direction and implementation of all disaster management functions. Section 3 Pursuant to Section 26-5 of the Village Code of Ordinances, the Village Council of the Village of Tequesta hereby confirms by Proclamation the State of Emergency Declarations issued on April, 10, 2020, April 17, 2020, April 24, 2020, May 1, 2020, May 8, 2020, May 15, 2020, May 22, 2020, May 29, 2020, June 5, 2020, June 12, 2020, June 19, 2020, June 26 2020, July 3, 2020, July 10, 2020, July 17, 2020, July 24, 2020, July 31, 2020, and August 7, 2020. For the Village of Tequesta due to CoVid-19 (Coronavirus), all emergency regulations activated under the provisions of Chapter 26 of the Village Code of Ordinances, and the designation of the Fire Chief as the Emergency Management Director for the Village for so long as the local state of emergency continues in effect. Section 4 This Resolution shall become effective immediately upon passage.
