VARIANCE REQUESTED: Variance from Sec. 78-705 (`Required number of parking
spaces') to allow for 55 parking spaces, where the code requires 60 parking spaces.
ORDER GRANTING VARIANCE
This cause was heard upon the application for a variance and the Tequesta Village Council
considered the evidence presented by the Applicant and other interested persons at a hearing called
and properly noticed. The Village Council being otherwise duly advised, THEREUPON, THE
TEQUESTA VILLAGE COUNCIL FINDS AS FOLLOWS:
1. The Applicant has applied for a variance from Section 78-705, Village Code of
Ordinances.
2. The subject property is located in the R/OP zoning district in the Village of Tequesta.
3. Pursuant to Section 78-61, Village Code of Ordinances, the Village Council has the
authority to consider and issue variances relating to all properties and structures located
within the R/OP zoning district of the Village of Tequesta.
4. The Applicant submitted all documents required by the Village's Code of Ordinances
for Village Council review and final action.
5. The application, all supporting documents, and presentation materials were reviewed
by the Village Council at a meeting on August 13, 2020, and as kept on file by the
Village, are made a part of this order and are hereby incorporated by reference.

6. Under the Village Code of Ordinances, the Village Council has the right, power and
authority to act upon the Applicant's request.
IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE
COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS:
The application in case number VAR 4-20 for a variance from:
1. Section 78-705, Village Code of Ordinances, to allow for 55 parking spaces,
where the code requires 60 parking spaces.
at the above -referenced property in the Village of Tequesta, Palm Beach County, Florida, attached
to this order as Exhibit "A" is hereby GRANTED.
The Village Council finds that the Applicant has provided competent, substantial evidence that
satisfy the statutory criteria at Section 78-65, Village Code of Ordinances, to be granted a variance
from Section 78-705.
Please note:
+ The term Applicant(s) shall include all successors and assigns.
4 Under Section 78-68, Village Code of Ordinances, if no time limit was specified by the Village
Council, then this variance shall expire within six months from the date of this order unless a
building permit based upon and incorporating this variance is issued within six months from
the date of the order and construction has commenced.
