Date Prepared: 511112020 Proposal No.: 19-06512 Page: 1 of 4 LANDSCAPE ARCHITECTURAL DESIGN SERVICE PROPOSAL OVERVIEW: Chris Wayne and Associates, Inc., 15863 971h Drive N., ,Jupiter, FL 33478, herein referred to as CONSULTANT, offers to provide landscape architectural design services for The Village of Tequesta, 345 Tequesta Drive, Tequesta, FL, 33469, herein referred to as CLIENT_ CONSULTANT shall develop a rendered conceptual master plan for Tequesta Park, Village of Tequesta, Palm Beach County, FL. SCOPE OF SERVICES: The CONSULTANT shall provide the following task: TASK 1 — Develop Conceptual Master Plan Rendering 1. Develop new Conceptual Master Plan rendering for Tequesta Park_ Plan shall depict the program elements provided by the CLIENT. These program elements include but are not limited to; sport fields, restrooms, concession, parking, walking trails, spectator seating, entry features, maintenance facilities, playgrounds, open space, pavilions, etc. Deliverables: 1. Submit one 22" x 34' .pdf format, 90% complete drawing for CLIENT review. 2. Submit one 22" x 34' ,pdf format, 100% complete drawing for CLIENTS final approval. 3. Submit one 22" x 34" .pdf format, scale to be determined, color rendered concept master plan. Schedule: To be completed as follows: 1. 90% review 20 days. 2. 100% CLIENT approval 35 days. 3. Color rendering 60 days from receipt of notice to proceed. CLIENT shall be responsible for review and approval. CLIENT shall provide CONSULTANT with written review comments at 901/6 complete. If any plan changes are required, CONSULTANT shall modify plans one time and provide CLIENT with revised plans. All other revisions shall be made with CLIENT approval and shall be billed as per the Hourly Rate Schedule, see Attachment "A", plus expenses. Date Prepared: 511112020 Proposal No.: 19-06512 Page: 2 of 4 CLIENT RESPONSIBILITIES: The CLIENT shall assist the CONSULTANT by furnishing at no cost to the CONSULTANT, all available pertinent information including previous reports, as -built drawings, legal descriptions of the property, Boor plans and elevations, building sections, landscape and irrigation plans, recent survey and any other data relative to performance of the above services which may be relied upon to verify existing conditions and/or new design. It is stipulated that the available drawings provided shall be substantially like the existing conditions. In the event that the existing conditions are not in concurrence with the documentation, the CONSULTANT fee may be adjusted accordingly as agreed upon by both parties. COMPENSATION: CLIENT shall pay CONSULTANT total lump sum in the amount of $4,000.00 for completion of tasks as follows: Task 1 - Develop Conceptual Master Plan Rendering $4,000.00 Total $4,000.00 Invoices for services rendered shall be presented on a monthly basis based on the percentage of completion for fixed fee items. Payment is due and payable at the date of invoice. Payments which are not received within fifteen nays from the date of the invoice will be considered delinquent and will be considered sufficient cause for the CONSULTANT to discontinue performing and providing services until payment in full is received. ADDITIONAL SERVICES: If additional work is deemed necessary by CLIENT, the work will be prepared under an additional services agreement to this contract. Additional services will be provided upon mutual written agreement. Value of the additional services will be based on the tasks requested and man-hours agreed upon at the man-hour rate schedule found in Attachment "A". The fallowing items are not included in this Scope of Services, and are considered additional services. 1. Plan revisions beyond this Scope of Services stated above 2. Meetings beyond this Scope of Services with CLIENT, VILLAGE, TOWN, ARCOM HOA, or public entities with governing authority 3. Construction or Construction Services 4. Applications, permits andlor fees 5, Plan review meetings with CLIENT, VILLAGE, TOWN, ARCOM, CITY, or public entities with governing authority 6. Surveys, tree location or relocation plans 7. Site Plan, Irrigation Plan, Lighting Plan S. Environmental assessment 9. Material testing, which will be provided by a testing agency retained by others 10_ Specialty engineering items 11. After 30 days Chris Wayne and Associates, Inc. reserves the right to review and make necessary changes. Price may or may not change. In reference to the term 'days', days shall he calculated as business days, not included in business days are national observed holidays. Proposal is for work described above. By accepting service of Chris Wayne and Associates, Inc. customer agrees to the following: 1. A service charge on delinquent invoices not paid within specified terms. in the Compensation section, shalf be $75.00 per 30 days for up to 90 days. After 90 days legal collection efforts shall begin. 2. For invoices due: a. Payment must be received within 30 days from invoice date. b. A fee of $45.00 shall be collected on all returned check items. c. Customer agrees to pay all court costs, damages and attorney fees if collection efforts become necessary.
