Regular Council STAFF MEMO Meeting: Regular Council - Sep 10 2020 Staff Contact: Matthew Hammond, Utilities Director Department: Utilities Approve Developer Agreement with Turnberry Beach Road LLC for Sea Glass Development Project Turnberry Beach Road LLC is developing a nine -story 21-unit multi -family condominium building at 1500 Beach Road referred to as Sea Glass (formerly known as Blowing Rocks Condominiums). The project received site plan approval from the Village Council on November 8, 2018 and a site plan modification on September 12, 2019. The proposed project use is an increased water demand over the previous use requiring a pro-rata share of Capital Connection Charges to be paid by the Developer as well as installation of onsite and offsite utility infrastructure. In addition, as a condition of the site plan approval, Turnberry is required to fund or construct the replacement of approximately 175 feet of water main along its road frontage to Beach Road. To effectuate these actions a Developer Agreement between Turnberry Beach Road LLC and the Village is required. The proposed Developer Agreement was prepared by the Village Attorney and reviewed by Turnberry's in-house legal counsel. Upon execution of the agreement Turnberry Beach Road LLC will be required to pay $126,844.50 to the Village Water Enterprise Fund ($56,798.29 for Capital Connection Fees and review costs and $70,046,21 for water main replacement).
