HomeMy WebLinkAboutMinutes_Special Master_8/11/2020(Approved) KIL ,Y MINUTES SPECIAL MAGISTRATE MEETING VILLAGE OF TEQUESTA, FL AUGUST 11, 2020 10:00 AM COUNCIL CHAMBERS CALL TO ORDER and PLEDGE OF ALLEGIANCE - Special Magistrate Kevin Wagner The hearing was called to order at 10:00 a.m. and the Pledge of Allegiance was led by Special Magistrate Kevin Wagner. Present were Special Magistrate Kevin Wagner, Code Enforcement Officer Michael Filipkowski, Building Official Jose Rodriguez and Village Attorneys Amity Barnard and Matthew Pritchett. The following cases were heard by the Special Magistrate who swore in three people involved in Quasi -Judicial cases. REPEAT VIOLATION HEARINGS None were presented at this meeting. FINE ASSESSMENT HEARINGS/ STATUS HEARINGS VIOLATION HEARINGS 1. Case Number: E200066 William Anthony Pisani and Lena Pisani 89 Teakwood Cir. Tequesta, FL 33469 Ch. 14 Art. H Sec. 14-31 and Florida Building Code (Sixth Edition) 105.1 PCN: 60-42-40-25-25-000-0840 Legal Description: TEQUESTA PINES LOT 84 Findings of Fact were that the Respondent was the owner of the above -described property. The Respondents were represented at the hearing by William Anthony Pisani; there was also a finding of proper notice. Code Enforcement Officer Michael Filipkowski provided testimony and evidence of the violation, as contained in the Village's evidentiary case file which was accepted into evidence without objection. Building Official Jose Rodriguez also provided testimony of the violation. Based upon evidence and testimony presented, the Special Magistrate finds that the property was in violation of Section 14-31 Page 1 of 3 Approved of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code from July 1, 2020 through July 29, 2020, a period of twenty-eight days (28) days, but came into compliance on July 30, 2020. Conclusions of Law were that the above -stated facts constitute a violation of Section 14- 31 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code. The Special Magistrate ordered the Respondents to continue to comply with Section 14- 31 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code. The Respondents were further ordered to appear at the Fine Assessment Hearing which will be held on the 8th day of September, 2020 at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469, at which time a fine in the amount of Fifteen ($15.00) dollars per day would be assessed for the violation which existed on the property from July 1, 2020 through July 29, 2020, a period of twenty-eight days (28) days. Respondents were also assessed the Village's administrative costs in the amount of $191.80 for costs incurred by the Village prior to the August 11, 2020 hearing. Should they violate the same Section of the Code again, they would be subject to a fine of up to five hundred dollars ($500.00) per day for such repeat violation. Additionally, the Code Inspector would not required to give a reasonable time to correct the repeat violation and the case would be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. 2. Case Number: E200070 Michael Mattson and Jennifer S. Mattson 23 Starboard Way Tequesta, FL 33469 Ch. 46 Art. ill Sec. 46-73 PCN: 60-42-40-25-12-004-0060 Legal Description: COUNTRY CLUB POINT LOT 6 BLK 4 Findings of Fact were that the Respondent was the owner of the above -described property. The Respondents were not present at the hearing; however, there was a finding of proper notice. Code Enforcement Officer Michael Filipkowski provided testimony and evidence of the violation, as contained in the Village's evidentiary case file which was accepted into evidence. As of the hearing on August 11, 2020, based on testimony presented by Code Enforcement Officer Michael Filipkowski, the property was in compliance with Section 46-73, but had not achieved compliance within the time specified in the Notice of Violation. Conclusions of Law were that the above -stated facts constitute a violation of Section 46- 73 of the Code of Ordinances of the Village of Tequesta. The Special Magistrate ordered the Respondents to continue to comply with Section 46- Page 2 of 3 Approved 73 of the Code of Ordinances of the Village of Tequesta. Respondents also were assessed $ 202.80 for administrative costs incurred by the Village prior to August 11, 2020. Should they violate the same Section of the Code again, they would be subject to a fine of up to five hundred dollars ($500.00) per day for such repeat violation. Additionally, the Code Inspector would not required to give a reasonable time to correct the repeat violation and the case would be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. FINE REDUCTION HEARINGS None were presented at this meeting. FORECLOSURE AUTHORIZATIONS None were presented at this meeting. ANY OTHER MATTERS None were presented at this meeting.
