WHEREAS, the Village of Tequesta is owner of that real property described in
Exhibit "A" attached hereto; and
WHEREAS, it is the intention of the Village to construct a Village Hall on a
portion of said property incorporating said Village Hall with the Village of Tequesta
Public Safety Facility and Memorial Fountain Park so as to provide a centralized civic
center and recreation area for the Village; and
WHEREAS, in consideration of the issuance of permits for construction of said
facilities on these properties. and for other good and valuable consideration, the Village
of Tequesta hereby agrees to restrict the use of the properties described herein in the
following manner:
1. That said property shall be considered as one plot and parcel of land, and
that no portion of said plot and parcel of land shall be sold, transferred, devised or
assigned separately except in its entirety as one plot or parcel of land.
2. That this condition, restriction and limitation shall be deemed a covenant
running with the land, and shall remain in full force and effect, and binding upon the
undersigned, their heirs and assigns until such time as the same may be released in
writing by the Village, pursuant to the approval of the Village Council..
3. That this instrument shall be recorded In the Pub;iu Records of Falm
Beach County, Florida.
