Tequesta Public Works Department Memorandum

Subject: Irrigation Backflow Replacement
Date: September 23, 2020
This Agenda item references replacing a 1-1/4" defective irrigation backflow
device at Paradise Park. Florida State Statues require a licensed Plumber to
install or replace a backflow device. The backflow device prevents the
undesirable reversal of flow of water, liquids, mixtures or substances into the
public water distribution system from any source other than its intended
source as a result of a cross connection.
Jupiter Plumbing has been issued a Permit to replace the backflow device.
The project cost is $821.69. Funds are available in Account 001-210-
546.309, Landscape and Irrigation Maintenance.

Tequesta Public Works Department Memorandum

Subject: Installation of Touchless Water Faucets
Date: September 23, 2020
This Agenda item references replacing building interior water faucets to
touchless water faucets. Touchless water faucets will be installed at the
Water Treatment Plant, Public Services and Public Safety facilities. The
water faucets at Village Hall were changed previously.
Installing touchless water faucets will prevent the spread of germs and save
water and energy.
Jupiter plumbing will remove the existing faucets and install touchless
faucets. The existing faucets will go through the surplus process and sold
through auction to recoup funds.
The cost for the associated work is as follows. $1,531.33 for the Public
Services Facility. $1,020.89 for the Water Treatment Plant. $3,020.93 for
the Public Safety Facility.

Subject: Bonded Lightning Protection Donation
Date: September 23, 2020
This Agenda item references a donation from Bonded Lightning Protection to
Install a commercial lightning protection system to the Public Safety Facility.
The building is not currently equipped with lightning protection.
The new lightning protection system will meet all National Standards
including the National Fire Protection Association requirements.
There are no costs or conditions associated with accepting the donation.
Bonded Lightning Protection will inspect the system every 3 years at no cost
to the Village. Bonded Lightning Protection will responsible for any and all
repairs to the system at no cost to the Village.
The estimated value of this donation is $10,000.

SUBJECT: Medical Director Contract
This Medical Director Agreement between the Village of Tequesta and Don Tanabe, M.D.
authorizes Dr. Don Tanabe to take on the duties and responsibilities of the Medical
Director for the Village of Tequesta Emergency Medical Service System. New provisions
in section III(A)ii specify updated terms for the Consumer Price Index procedure. See
backup documentation for full contract.

FIRST ADDENDUM TO
MEDICAL DIRECTOR AGREEMENT
This First Addendum to Medical Director Agreement is made and entered into this
day of October 2020, by and between the Village of Tequesta, Florida, a municipal corporation,
hereinafter called the "Village", and Don "Tanabe, M.D., a Florida licensed physician, hereinafter
called"Medical Director", both of whom understand as follows:
WHEREAS, the Village and Medical Director previously executed a Medical Director
Agreement on October 6, 2003, effective October 6, 2003, to provide medical director services
for the Village's fire rescue department as required by Sec. 401.265,Florida Statutes; and
WHEREAS, the 2003 Medical Director Agreement provides for automatic annual
renewals, and the parties have allowed such annual renewals to occur and desire to continue to
exercise annual renewals on a going forward basis with the amendments contained in this First
Addendum to Medical Director Agreement.
NOW, THEREFORE, in consideration of the mutual covenants herein contained, the
Village and the Medical Director agree to continue operating under the 2003 Medical Director
Agreement as amended by this First Addendum to Medical Director Agreement.
SECTION 1. RATIFICATION OF 2003 MEDICAL DIRECTOR AGREEMENT
The Medical Director Agreement dated October 6, 2003 is hereby ratified by the Village
and the Medical Director. All rights, responsibilities, and terms of the 2003 Medical Director
Agreement shall remain in full force and effect except as expressly amended by this First
Addendum to Medical Director Agreement.
SECTION 2. AMENDMENTS TO 2003 MEDICAL DIRECTOR AGREEMENT
A. The third WHEREAS clause is amended to refer to "Chapter 64J-1 of the Florida
Administrative Code"and reference to former"Chapter 64E-2"is deleted.
B. Paragraph H of Part II is amended to refer to the "Department of Health" and
reference to the former "Department of Health and Rehabilitation Services" is
deleted.
C. Paragraph M of Part II is amended to refer to all rules of the "Department of Health"
and reference to the former "Department of Health and Rehabilitation Services" is
deleted. This paragraph is also amended to refer to duties enumerated in"Section 64-
J1.004, Florida Administrative Code" and reference to duties enumerated in former
"Section 64E-2.004" is deleted.
D. Paragraph A ii of Part III is amended to eliminate any automatic downward
adjustment to the Medical Director's compensation based on CPI. This paragraph is
also amended to cap any automatic upward adjustment to the Medical Director's
compensation based on CPI to four percent(4%).
E. Part X is amended to provide that venue for any dispute resolution shall be a court of
competent jurisdiction in Palm Beach County, Florida.

F. An entirely new Part XII is added as follows:
XII. INSPECTOR GENERAL
Pursuant to Article XII of the Palm Beach County Charter, the Office of the Inspector
General has jurisdiction to investigate municipal matters, review and audit municipal
contracts and other transactions,and make reports and recommendations to municipal
governing bodies based on such audits, reviews, or investigations. All parties doing
business with the Village shall fully cooperate with the inspector general in the
exercise of the inspector general's functions, authority, and power. The inspector
general has the power to take sworn statements,require the production of records, and
to audit, monitor, investigate and inspect the activities of the Village, as well as
contractors and lobbyists of the Village in order to detect, deter, prevent, and
eradicate fraud, waste, mismanagement, misconduct,and abuses.
IN WITNESS WHEREOF, the Village of Tequesta has caused this First Addendum to
Medical Director Agreement to be signed and executed on its behalf by the Mayor of"1equesta
and duly attested by its Village Clerk, and Don Tanabe, M.D. has signed and executed this First
Addendum to Medical Director Agreement in the presence of a witness, the day and year first
above written.
