A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, APPROVING A TEMPORARY WATER UTILITY
BILLING ADJUSTMENT POLICY TO ASSIST CUSTOMER BILLING
ASSOCIATED WITH THE INSTALLATION AND IMPLEMENTATION OF
NEW WATER METERS; PROVIDING AN EFFECTIVE DATE; AND FOR
OTHER PURPOSES.
WHEREAS, the Village's water utility has installed new digital electronic water meters
for its customers which provide for better accuracy in reading actual customer consumption; and
WHEREAS, the improved accuracy of the new meters over the old mechanical meters
results systemically in increased billing because the new meters more accurately read the actual
consumption compared to the old meters which due to age and technology consistently provide
readings that do not capture all consumption; and
WHEREAS, the Village Council of the Village of Tequesta, Florida, desires to assist water
system customers with this transition by approving a temporary policy to allow for certain
adjustments to individual water bills under certain circumstances; and
WHEREAS, the Village Council has determined that the approval and adoption of a
temporary policy to allow for certain adjustments to individual water bills under certain
circumstances will serve the best interests of the Village's water utility customers without
jeopardizing the viability of the utility itself.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: The above recitals are true and accurate and are hereby fully incorporated
into this resolution.
Section 2: The Village Council of the Village of Tequesta, Florida, hereby approves
and adopts the Billing Period Adjustment and Excessive Variance Step Adjustment New Meter
Installation Relief Policy attached hereto as Exhibit A.
Section 3: This Resolution shall take effect immediately upon adoption.

Billing Period Adjustment
For a period ranging from 10/01/19 through 9/30/2020, any individual water bills that billed for a
longer period than 35 days and that as a result captured water usage of a quantity that caused the total
usage on that individual water bill to be charged at a higher step rate than the lower step rate which
would have been charged had the individual water bill been for a period of 31 days or less, will be
credited the difference between the higher step rate and the lower step rate.
Excessive Variance Step Adjustment New Meter Installation Relief
The Utility Director may approve an excessive usage credit (EUC) to a water bill for the billing periods
of July 2020 and August 2020, which, due to circumstances created by the Advanced Meter
Infrastructure installation project which caused unforeseen increased water usage due to higher meter
accuracy, and which reflects consumption in an amount that is at least two times the customer's
monthly usage over the previous three (3) month period of actual usage. No customer shall be eligible
for such an adjustment other than during the billing periods specified. No adjustment shall be granted
in the event that the adjustment would cause a violation of Village Code Section 74-78 regarding
prohibited free service, or Village Code Section 74-81 regarding the provision of adequate revenue to
cover all costs of operation, maintenance and debt service. Any downward adjustment shall be made
based on the Village's current step rates. The lowest step rate that results in an adjusted water bill
commensurate with the customer's average water bill over matching month's billing shall be applied.
In the event that application of the lowest step rate results in an adjustment that continues to exceed an
amount that is double the customer' s average water bill over the previous three (3) months period of
actual usage, then an adjustment equal to an amount equivalent to double the customer's average water
bill over the previous three (3) months of billing shall be made.
