BRYAN C. MCGILVRAY & NOELLE MCGILVRAY, Respondents. RE: Violation of Chapter 14, Article II, Section 14-31 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Sixth Edition). Address: 323 Leigh Road Tequesta, Florida 33469 Legal Description: JUPITER IN THE PINES SEC D LOT 6 BLK 36 PCN: 60-43-40-30-04-036-0060 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Special Magistrate Hearing held on the 1211 day of January, 2021, and based on the evidence and testimony presented, enters an Order Assessing Fine. The following Findings of Fact, Conclusions of Law and Order are hereby entered: FINDINGS OF FACT The Respondents are the owners of the above -described property. 2. The Respondents were represented at the hearing by Bryan C. McGilvray; there was also a finding of proper notice. Page 1 of 2 3. By the "Order Finding Violation" dated October 16, 2020, the Special Magistrate ordered the Respondents to comply with Section 14-31 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Sixth Edition) on or before December 31, 2020. 4. Based upon the evidence, pictures and testimony presented at the hearing on January 12, 2021, the Special Magistrate found that the property remained in violation of Section 14-31 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Sixth Edition). CONCLUSIONS OF LAW The above -stated facts constitute a continuing violation of Section 14-31 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Sixth Edition). 1' 1_: Respondents are hereby granted ten (10) additional days in which to comply and therefore ordered to comply with Section 14-31 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Sixth Edition) on or before January 22, 2021. If the Respondents fail to achieve compliance on or before January 22, 2021, it is further the order of the Special Magistrate that a fine of Twenty -Five Dollars ($25.00) is hereby assessed, beginning on January 23, 2021, and continuing to accrue at Twenty -Five Dollars ($25.00) per day until compliance is achieved, without the need for additional hearing. The Respondents also are assessed One Hundred Eighty -Three Dollars and Ninety Cents ($183.90) for administrative costs incurred by the Village for the January 12, 2021 hearing. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exists and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes. Upon complying in any code compliance matter, it is always the responsibility of the Respondents to contact the Code Compliance Division at (561) 768-0519 to request a reinspection of the property.
