REQUEST: Site Plan Modification for a set of two (2)-story 69-unit fee simple townhomes
and amenities in the R-2 Zoning District. The application includes a
landscaping plan and a monument sign, and requests three (3) waivers from the
Village Planned Residential Development (PRD) Code. The subject property is
located at 746 US Highway 1 and 734 N. US Highway 1, Tequesta, Florida,
33469.
ORDER GRANTING SITE PLAN MODIFICATION
This cause came on to be heard upon the above application and the Village Council of the
Village of Tequesta having considered the evidence presented by the Applicant and other interested
persons at a hearing called and properly noticed, and the Village Council of the Village of Tequesta
being otherwise duly advised,
THEREUPON, THE TEQUESTA VILLAGE COUNCIL FINDS AS FOLLOWS:
The subject property is located in the R-2 Zoning District in the Village of Tequesta.
2. The Applicant has submitted all documents required by the Village's Code of Ordinances
for Village Council Site Plan Modification review and final action.
3. The application and all supporting documentation and presentation materials as reviewed
by the Village Council at its January 14, 2021 meeting, and as kept on file by the Village,

are made a part hereof and are hereby incorporated by reference.
4. According to section 78-334, approval by the Village Council is required.
5. According to section 78-226, the Village Council in its review and approval may accept
an Applicant's proposed modifications, or waivers, to the Planned Residential
Development (PRD) code requirements, provided that the spirit and intent of the Village
Zoning Code are complied with in the total development of the PRD.
6. The Applicant has applied for approval of a site plan modification to build a set of two
(2)-story 69-unit fee simple townhomes and amenities, including a landscaping plan and
a monument sign and with three (3) requested waivers from the Village PRD Code, all in
accordance with the application and all supporting documentation and presentation
materials which are hereby made a part of this Order by reference as if fully set forth
herein.
7. Under the Village Code of Ordinances, the Village Council has the right, power and
authority to act upon the Applicant's request.
IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE
COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS:
The application for a site plan modification review to build a set of two (2)-story 69-unit fee
simple townhomes and amenities including a landscaping plan and monument sign and with three (3)
requested waivers from the Village PRD Code, all as described in the supporting documentation and
presentation materials at the above -referenced property in the Village of Tequesta, Palm Beach
County, Florida, in accordance with the application and other materials reviewed and considered by
the Village Council and attached to this order as Exhibit A is hereby APPROVED. The following
conditions of approval shall apply hereto:
1. Homeowner Association documents, in form acceptable to the Village Attorney, will be
provided, approved, and recorded prior to the issuance of any building permits.
2. Prior to issuance of the building permit, the Applicant must comply with the following
recommendations provided by Air, Water, & Soil Engineering, Inc. (AWSE) on the Phase
I Environmental Site Assessment (ESA) report:
a. "AWSE recommends that proper abandonment of the former domestic water
supply well on the 734 North US Highway 1 parcel and removal of the abandoned
septic tank."

b. "AWSE recommends that the US Geological Survey Salinity Monitor Well, PB-
872, be located on the 746 North US Highway I parcel and the US Geological
Survey notified of the redevelopment of the property with respect to their well
location."
3. Applicant shall coordinate with the south -adjacent commercial plaza to develop a
pedestrian path that ensures both safety and connectivity for pedestrians traveling between
the subject property and commercial plaza.
4. Applicant shall provide electric power and connectivity to the North and South pedestrian
gates, to ensure that the two gate entrances are `camera ready' if the Homeowner
Association wishes to install cameras.
Please note:
■ The term Applicant(s) as used here shall include all successors and assigns.
■ The Applicant's site plan approval shall expire in twelve (12) months unless a building permit has
been obtained in accordance with Sec. 78-334(h). If the building permit expires or is voided, the
site plan approval also expires or becomes void.
