ORDINANCE NO. 04-21, FIRST READING, AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER 78. ZONING. AT ARTICLE IX.
SUPPLEMENTAL REGULATIONS. DIVISION 1. GENERALLY. BY REVISING SECTION 78-282.
STRUCTURES EXEMPT FROM HEIGHT LIMITATIONS. TO PROVIDE ADDITIONAL
RESTRICTIONS FOR SUCH STRUCTURES; PROVIDING THAT EACH AND EVERY OTHER
SECTION AND SUBSECTION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND
EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY
CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.

WHEREAS, the Code of Ordinances for the Village of Tequesta, Florida currently
exempts certain architectural structures from the building height limitations established in the
Village's Zoning Code; and
WHEREAS, the Village Council of the Village of Tequesta wishes to retain the building
height limit exemption for these architectural structures, but also desires to codify additional
restrictions for such structures; and
WHEREAS, the Village Council of the Village of Tequesta has determined that the
proposed code revision will be in the best interests of the health, safety, and welfare of the
citizens of the Village of Tequesta.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: Chapter 78. Zoning. of the Code of Ordinances of the Village of Tequesta
is hereby amended at Article IX. Supplemental Regulations. by revising Section 78-282.
Structures exempt from height limitations. to provide additional restrictions for such structures;
providing that Section 78-282 shall hereafter read as follows:
Sec. 78-282. - Structures exempt from height limitations.
In all zoning districts, chimneys, water tanks, elevator lofts, church spires, and flagpoles,
may,
. be erected no more than
forty aercent (40%) above the height of the building on which it is located. In all zoning districts,

parapet walls and turrets may be erected no more than twenty percent (20%) above the height of

the building on which it is located. However, the hi hest vertical projection of a chimney may
exceed the overall height of the building on which it is located by no more than four (4) feet. All
such structures located upon the roof area shall not cover in the aggregate a roof area greater than
ten (10) percent of the ground floor area of such building or structure.
Section 2: Each and every other section and subsection of Chapter 78. Zoning. shall
remain in full force and effect as previously enacted.
Section 3: All Ordinances or parts of Ordinances in conflict herewith be and the same
are hereby repealed.
Section 4: Should any Section or provision of this Ordinance or any portion thereof,
any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder of this Ordinance.
Section 5: Specific authority is hereby granted to codify this Ordinance.
Section 6: This Ordinance shall become effective immediately upon passage.
