THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER 50. NATURAL RESOURCE

CONNECTION AND BACKFLOW PREVENTION. TO ALLOW REVISIONS TO THE
VILLAGE CROSS CONNECTION AND BACKFLOW PREVENTION POLICY BY
RESOLUTION; PROVIDING THAT EACH AND EVERY OTHER SECTION AND
SUBSECTION OF CHAPTER 50. NATURAL RESOURCE PROTECTION. SHALL REMAIN
IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS
CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
The Village of Tequesta maintains an active Cross Connection Control (CCC) Program in accordance
with state statutes to protect the potable water supply from contaminants and pollutants at the point of
connection and to ensure that proper backflow preventers are installed where hazards exist. This
program is comprehensive and applies to all customers connected to the potable water system.
The CCC Program was implemented in 1990 through Ordinance 411 and is referenced in Section 50-
186 of the Code of Ordinances. All aspects of the CCC Program are detailed in the CCC Plan
attached to Ordinance 411. The CCC Plan is part of the Village Utility Policies and Procedures, which
includes the Water Service Policy, CCC Plan, Design Criteria & Specifications, Standard Details,
Rate Schedule and other policies and procedures adopted by the Village Council, as all of the same
may be amended from time to time.
Florida Statutes related to backflow prevention have been amended numerous times since the
inception of the Village CCC Program requiring update to the 30+ year old CCC Plan. In order to
amend the CCC Plan a corresponding modification to Section 50-186 of the Code of Ordinances is
needed to allow for the Council to approve updates to the plan moving forward as required. The

updated CCC Plan is planned to be presented to Council for approval following second reading and
approval of proposed Ordinance No. 06-21.

WHEREAS, the Village established a Cross Connection and Backflow Prevention
Policy as part of Ordinance No. 411 on August 23, 1990; and
WHEREAS, the Village Council seeks to revise the cross connection and backflow
prevention policy from time to time by resolution to reflect changes to the law, best practices,
and other purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: Chapter 50. Natural Resource Protection. of the Code of Ordinances of the
Village of Tequesta is hereby amended at Article VI. Water Protection and Conservation. by
amending Section 50-186. Cross Connection and Backflow Prevention. to provide for the
amendment of the cross connection and backflow prevention policy as necessary by resolution of
the Village Council; providing that Section 50-186 shall hereafter read as follows:
Sec. 50-186. — Cross Connection and Backflow Prevention.
All potable and irrigation water service distribution and plumbing systems shall
meet the requirements of the village cross connection and backflow prevention policy
attached to Ordinance No. 411 as exhibit A, as amended from time to time as necessary
by resolution of the Village Council, which is on file in the village clerk's office, filuy

village cross connection and backflow prevention policy and the adopted plumbing code
of an affected governmental agency, the more stringent requirement shall be adhered to.
Section 2: Each and every other section and subsection of Chapter 50. Natural
Resource Protection. shall remain in full force and effect as previously adopted.
Section 3: All Ordinances or parts of Ordinances in conflict herewith be and the same
are hereby repealed.
